BEFORE THE
CITY COUNCIL
TO WHOM IT MAY CONCERN:
NOTICE IS HEREBY GIVEN THAT the City Council of the City of Fridley
will meet in the Council Chamber of the City Hall at 7:30 P.M. on Monday,
July 8, 1974 to consider the following matter:
A request for a variance of Section 205.053, 4A,
Fridley City Code, to reduce the minimum front
yard setback from 35 feet to 18 feet to allow
the construction of a detached garage to be
located ahead of tne existing dwellinq, located
on Lot 17, Block 7, Carlson's Summit Manor
North Addition, the same being 5465 Altura Road
N.E., Fridley, Minnesota. (Request by Mr. Michael

by the Engineering Department and the City Council. She sa' the Board is only
authorized to act on the variance request. She asked if ere was any objection

he had to work and could not be present. Chairwom Wahlberg informed Mrs. Halland
that her husband could come before the Council ' he wanted to state any objections
to the variance.
l�Ir. Willey added he has purposely left 8 eet between his garage and the lot line
so that he can put in a ditch drainag area for the roof run off.
MOTION by Plemel, seconded by Gab , to close the public hearing. Upon a voice
vote, there being no nays, the tion carried.
Mr. Plemel stated he could ee no need for a sidewalk to ever be installed and
considering that the hous to the north is already set back 19 feet, and because
this is on a cul-de-sa where the houses are not in line, he had no objection.
Mrs. Gabel said she,/agreec� with Mr. Plemel.
MOTION by Gabe seconded by Plemel, to recommend to the City Council, approval
of the varia e to reduce the front yard setback from 35 feet to 19 feet. Upon a
voice vote, there being no nays, the motion carried.
MOTION Plemel, seconded by Gabel, to recommend that the Council take notice of
the d ainage problems that exist in this area, as reported to the Board, and that
thi house might add to the problem, and to see if something can be worked out to
a eviate the problem. Upon a voice vote, there being no nays, the motion carried.

MOTION by Councilman Ut adopt the agenda as amended with the addition of the
letter received b ncilman Starwalt concerning the traffic, lighting and signs
in the area ohn Erickson Park. Seconded by Councilman Starwalt. Upon a voice
vote voting aye, Mayor Liebl declared the motion carried unanimously.

Mr. Michael Roback addressed the Council and explained he had been on the agenda of
the Board of Appeals P4eetSng of June 25, 1974, but was.not notified and the Board
of Appeals had not taken any action on the request because he was not present at the
meeting.
Mayor Liebl pointed out that this had been tabled by the Board of Appeals, it had
not been turned down by them. Mayor Liebl asked the applicant if he was in a hurry
to begin construction. Mr. Roback said he would like to get started as soon as
possible.
Mayor Liebl advised Mr. Roback that this would be taken.care of during the discussion
on the minutes of the Board of Appea7s meeting. .

CON DERATION OF BIDS FOR FENCI�� AT COMMONS PARK #1 (TAF3LED 6-1.0-74):
MOTION Councilman Utter to concur with the recommendation of the City Manager and
Director Parks and Recreation and award the contract for i:he fencing of Comm�ns
Park #1 to iking Fence in the amount of $6,285,00 with the stipulation that no
gates be inst lled and that there be free open walkways. Seconded by Councilman
Breider. Upon voice vote, all voting aye, Mayor Liebl declared the motion carried
unanimously.

MOTION by Councilman Breider to receive i:he communication from the Public Safety
Director, Mr. James Hill, concerning the ity employees serving on Council appointed
Boards and Commissions, dated June 21, 197 Seconded by Councilman Utter. Upon a
voice vote, all voting aye, Mayor L��bl deci ed the motion carried unanimously.
Mayor Liebl read the information concerning the pointment of a replacement to the
Human Relations Committee to the Council and audi ce. He indicated this Ntould be
; an appointment to replace Ms. Joyce E3enson, and the erm would expire in April

of 1976.
� Mayor Liebl recommended the appointment of Mr. Walter Li kowski, 1402 Meadowmoor,
; 788-4303, to the Human Relations Committee.
MOTION by Councilman Breider to appoint Mr. Walter Lizakowsk:, 1402, Meadowmoor
to the Human Relations Cammittee with a term to expire on April , 1976. Seconded
by Councilman Starwait. Upon a voice vote, all voting aye, Mayor Liebl declared
the motion carried unanimously.
Mayor Liebl explained this appointment woutd replace Ms. Shirley Kenne for the
remainder of a one year term to expire on April 1, 1975.
Mayor Liebl recommended the appointment of Mr. Russel Houck, 75�.Overton Dri ,
560-3249, to the Environmental Quality Gommission. Mayor Liebi introduced Mtr.
Houck io the Gouncil and commented that Mr, HoucN is a long time resident of
Fridley and a cor�nunity minded citizen who is willirig to serve.

Mayor Liebl pointed out to the Council the drawing of the proposed construction
of the garage on page 12-J of the agenda.
Councilman Nee said he would have no objection to the variance, but would 7ike
an explanation of what is beir�g proposed.
P4r. Roback addressed the Council and explained that a considerable amount of back
fill �-�ould be rieeded if the variance was not granted and he would not be ab]e to
move the garaqe forward.
Councilman Nee asked if the garage would be in front of everyone else. Mr. Roback
said yes, 10 feet.
Councilman Nee asked Mr. Roback if he would be agreeable to a delay of this action
for a period of one week which wauld enable Counci�man Nee to visit the area and
look at the property. .
The Ci�y Manager said he Gaould send notices to the area property owners to determine
if thPre are any opposed to the var9ance being requested.
Councilman Breider questioned if it was normal procedure to have a Public Hearing
on such a matter at the Council level.

all voting aye, Mayor Liebl declared the motion carried unanimously and the Public
Hearing opened at 9:20 P.M.
Mayor Liebl asked if there was anyone present who opposed the variance and there
was no response.
MOTION by Councilman Nee to close the Public Hearing. Seconded by Councilman
Starwalt. Upon a voice vote, all voting aye, Mayor Liebl declared the motion carried
unanimously and the Pubiic Hearing closed at 9:21 P.M.
Councilman Nee said he F�ad visited the area and talked to the other property owners
and felt they had no real opposition to the approval of the variance, but he would
determine that they may not have wanted to express this type af feeling. Councilman
Nee indicated he felt it would be more satisfactory with the adjoining property
owners if the garage were pulied back a iittle. tie suggested the variance be
granted for 20 feet rather than the 18 feet requested by the applicant. He asked
if Mr. Roback his feelings on this proposaJ.
Mr. Roback addressed the Council and said he would rather leave the plans for
construction at the 18 foot setback iine, but if he had to move the garage back
he would.
Councilman Nee explained he felt that this construction would be better received ;�
by the neighbors this way. Ne said he felt the people did not want to say no to the
plan, but he thought they would oppose the larger variance.
MOTION by Councilman Nee to grant the var�ance request by Mr. Michael Roback at �
5465 Rltura Road for a front yard setback of 2d feet rather than the 18 feet as requested.
Seconded by Counciiman Starwalt. Upon a voice vote, all voting aye, Mayor Liebi declared
the motTOn carried unanimously.

The Gity Manager reiterated that there s some coneern about the cottstruction of
this large of an addition which would e used for the purposes of paint storage.
Ne further explained that the reque had been tabled for the gathering of addiiionat
information.
Mr. Glark said he had been in ntact with the applieant who had indicated the
paint he planned to store wou d be latex paint and this would not create the hazard
as enamel would.
Councilman Utter said th' kind of statement coutd be made today and later the property
owner would store the 1 base paints. He said there would have to be storage of some
solvents.
; Mr. Clark said the etitioner had talked to Mr. Aldrich, Deputy Fire Chief, who
had advised the plicant on what preventative measures would have to be taken
' to make this st age safe. Mr. Clark further expiained that the construction
would have to ontain some fire walls and if Mr. Aldrich would feel that the fire
walls are ne ded all the way around the construction, this would have to be done.
He added, i lacquer is being stored, there would have to be the installation of a
