Councilman Sheridan said that by ting on this motion, the
Council would have to resci,nd th motion of the previous m�eeting
wherein all the material is to e sent to the Chicago offi�e.
He said that he would ask tha th is motion be laid over to give
the firm a chance to reply t the letter as the Council re-
quested. Councilman Harris agreed with Councilman Sheridan and
said that as the Council s made the request, time should be
allawed for a reply from e home office. Councilman Samuelson
agreed.
Mayor Kirkham pointed out that the letter dated July 26, 1967
could, in effect, co stitute the City of Fridley's contract,
and no time limit w s specified. Councilman Liebl said that
the purpose of th' study was to have it before the election, and
said that he did ot feel that the firm had lived up to it's con-
tract. Mayor K kham said that the firm gave an estimate of
6 to 8 weeks, t that he did not feel that the company had
defaulted. C ncilman Samuelson said that he would like to have
the Motion n before the Council rescinded until the legal
staff could ook into this, and that the letter should be sent.
Councilman iebl said that he was in opposition to this letter.

T'he City Engineer explained the stipulations imposed by the Building
Standards - Design Control Sub�ommittee and said that this apart-
ment house would be north of Georgetpwn apartments, and south of
the elementary school. He then shaw�d the Council the plans and
said that he felt that this was a fa�rly nice addition ta t�is area.
He said that the apartment would face the river and the garages
would have the back facing Anna Avenue. Councilman Samuelson said,
while looking at the plans, that this would achieve a clean line as
opposed to a line of cars. The C�.ty Engineer said that there was
one additional item he would like to have included, which would be
to provide necessaxy right of way from $ie property to make the
road right of way 41' wide, and on the south end o� Anna Av�nue,
give an easement for a turn-around. He said that there is ��sc�
right of way between the garages and the area to the southP and that
it would probably be needed as eventually access be�ween t..���
Ge�orgetown apartments and the school would be needed. In �.�ie
interim the easement would be used by emsrger�cy equipment.
Councilman Lieb1 questioned the amount of brick included on the
plans. Mayor Kirkham pointed out that with an English Tudor
design, they would be using some stucco and paneling. He said that
the City's requirem�ents are 50% brick and this plan does meet
these sp�ecifications.
MOTION by Councilman Harris t.o approve the building permi.t subject
to the stipulations imposed by the Building Standaxds - Desi.gn
Control Subcommittee with the addition of Item #5: Provide ne-
cessary right of way from the property to make the �na Av�nue

Mr. Richard Harris asked about the handling of the traffic to

�� REQUEST FOR RENEWAL OF BUILDING PERMIT, 5920 ANNA AVENUE ( DAVID CAROLL):
L Councilman Liebl pointed out that all the information is in the Council
�(�a Agenda, and that it was granted once before and said that he would have
no objection to the issuance of the permit. The City Engineer said that
the permit was �pproved in August of 1968. A building permit expires
in 90 days. The applicant plans to build the building, then sell it. He
said that he would recommend approval with the same stipulations. This
would be just south of the present apartment buildings facing Anna Avenue.
MOTION by Councilman Liebl to approve the building permit request for 5920
Anna Avenue subject to the same stipulations placed on them by the Board of
Appeals and the Building Board and the Council last year. Seconded by
Councilman Samuelson. Upon a voice ��ot:�, all voting aye, Mayor Kirkham
declared the motion carried. ,
CONSIDERATION OF AN ORDINANCE FOR REZONING REQUEST (ZOA #69-
NELSON: (Generally located on the south side of Onondaga
of Lakeside Road) /

Mr. George Nelson Jr. was present and explained that is is for Lot
30 and the north � of Lot 31. There is 125' on Ono aga Street left for
R-1 as a buffer. The area was shown on the scree for clari�ication. He
said that he has agreed with the Planning Commis on to leave a 25'
easement to the middle line of the lots, if th rezoning is approved.
This is in case they would want to put a road hrouc�iin the future. Council-
man Sheridan asked if the property to the so th is Onan's. The City
Engineer said yes, and there is also a str' of land already zoned R-3
along 73rd Avenue. If this rezoning is a roved there would be a need
for some right of way for access on the est side. Councilman Sheridan
asked I�ir. Nelson if the building would e located on this parcel of
ground, or would it be used for park' g etc. Mr. Nelson said that he did
not know as yet. He said that ther would probably only be one building
"L" shaped facing Onan's. Council an Liebl said that Mr. Nelson's father
indicated that there would be R- on Onondaga Street and the building
would be faced toward 73rd Aven . He asked if he felt that he would be
providing an adequate buffer. r. Nelson said that there have been no
plans drawn as yet.
Mr. Dennis Herbst, 1482 O ndaga Street, owner of Lot 28 said that he did
not want a 3 story apar nt building right behind his house. Mr. Nelson

PERMIT: RATES AND CHARGES FOR CONNECTION AND USE: REOUIREMENTS THEREON:
All permits granted for connection to and use of any municipal sewer and the sewage disposal facilities
of the North Suburban Sanitary5ewer District are based and conditioned upon the accuracy of all informa-
tion contained in the application and the truth of all statements made therein. All of the information is
subject to further verification and correction that may be found necessary by the District and the Munici-
pality. All rates and charges for connection and use of the sewer, based upon such information and
statements, and any certification .thereof are nevertheless subject to such change and adjustment as may
be found necessary by the District and the Municipality to have the charges imposed accurately estab-
lished and in conformity with those provided under the laws,ordinances,rules and regulations applicable
(including payment of any assessments, availability charges or connection and use charges) and other-
wise due with respect to such sewer facilities and n�t paid, whether imposed by the District orthe Muni-
cipality. Unless otherwiseprovided, the chargas for connectien to and use of the sewer facilities,
imposed by the District, are collected by the Municipality together with and as a part of any separate
c:harges of the Municipality. The Connection Charges to be paicl to the District are due at the time of the
c�pplication for connection. Use Charges ta be paid (quarterly)ore due and accrue commencing not later
than the date of completion of the sewer connection (commencement of use of the sewer) unless a later
date is provided under provision of law or agreement with the Iv{unicipality.

RE: Pool for James Nelson Construction Company
5920-5940 Anna Street N.E.
Aladdin Pools, Stan Thayer, may proceed with the construction of
this pool subject to the notations on the plan. The plumbing needs to
be checked thoroughly, especially with the nearby sewer lines. I
assume Schedule 40 plastic pipe is required. We want good plastic
pipe if used. Plastic does have advantages over copper, especially
the corrosion problem. I solicit the help of the Plumbing Inspector
with this pool plumbing.
I will recommend approval of necessary permits for this pool.
I assume they will have ample make-up air and facilities for
exhausting.
