In reference to your letter of July 24, 1970 concerning a"hi-rise" apartment
building, Section 45.071 of the zoning code provides under sub-section lA that
multiple dwellings and multiple dwelling complexes are a principle use of the
R-3 general multiple dwelling district. Paragraph 3 thereunder provides uses
pe rniitted with special use pennit but these would be applicable to both R-3 and
R-3A dis{;ricts since both are lumped together under one section and it would seem
to me that Paragraph H o-�ould be applicable to an R-3A district where with a
special use permit you might be able to build a"hi-rise" apartment but a"hi-rise"
apartment is certainly defined as a multiple d�•telling and is a permitted use under
R-3 so I don't believe a special use perinit would be required to build such a
multiple dwelling in an R-3 district although it would, of course, be required in
an R-3A district.
However, the building requirements under 45.074 prohibit a building in excess of
six stories so in order to build in excess of six stories a variance from 45.074
must be requested and granted.
Therefore, it would be my opinion in reference to your inquiry, although the matter
is ambiguous, that the applicant should request a variance rather than a special
use permit for the construction of a"hi-rise" apartment in an R-3 district.

In reply to your request regarding the Fire Department's position
relating to Hi Rise apartments, it can be briefly stated as follows:
Hi Rise buildings do not appreciably add to the problems of the
Fire Department. If the codes of the city are properly interpreted
and applied, certain safety factors are then required to be included
in the construction of the Hi Rise occupancy. Use of combustibles
is very severely restricted, fire proof and smoke proof towers for
egress froin the building are required, Additional fire fighting
appliances are necessary so the additional height of the structure
is of relatively small significance.

Mr. Emil Novak, representing N.C.R. Corporation, presented the request. Mr.
Novak stated he has been working witSi the property o�aner, Mr. Harold Panuska,
and had also talked with the City Engineer and the Fire Chiefs to make sure
that the buildin� caill comply with all the City Codes. He said kl�at they want
to do is to build something unique which will have a greater amount of grcen
area. They hope to give thc tenants a view and a prestige symbol, and to also
give thc,City a prestige symbol. .
Chairman Minish read a letter from tl�c Fire Prcvention Chief which stated

Chairman Mini.sh stated there had been some questions on whether our Fire
Department had thc equipmcnt wi.th wl�i.cli to handle a fire in any of the upper
stories of this building, and he felt this lettier answered those questions.
Mr. Novalc stated thi-s buil.din� wi11 have iire fighting equipment on each
floor so the Fire Departmene would fight any upper story fires from the
inside of the building.

Mr. Albert Hofimeyer, architect, stated this building is a�pe I building
whicti has the longest life span of any building as the structural framecaork
is constructed of steel or iron with masonry.
Mr. Novak showed the Board riao very preliminary dracaings; one of the typical
floor plan and one of the site plan. The building wi11 consist of 104 units
made up of SF two bedroom apartments, 40 ore bedroom apartments and 8 th-ee
bedroom apartments. The apartments will rent f.rom approximately $200 to $400,
the locaer rents being for the bottom apartments.
Mr. Drigans asked when construction would be�in i.f the building were approved.
Mr. Floffineyer anscaered in the spring of 1971 and ready for occupancy approximately
18 months later.
Mr. Novak added they don't think a high risc is conducive to a large number of
children so there should not be any problems with the schools.
Mr. Clifford Bakko, apartment owner, stated his main concern was the traffic
patterns as there is a problem in this area at the present time and he c�ants
to make sure something is going to be done to correct it.
Mr. Novak stated he had been discussing this with the City Engineer and was
infonned that the construction to correct thi.s pr.oUlem will hopefully be
completed by the middle of 1972.
Mr. 0'Rannon asked if there were any reports on how this type of building
would hold up during a tornado.
Mr. Hoffineyer related a situation that happened in one of the Souther.n states
wherc there had bcen a tornado and this type of. huilding was almost totally
undamaged and all. other buildinEs in the same area fell.

carried unanimously.

for the follocaing reasons: .
1. The fire protection is sound.
2. 11ie traffic situation wi11 be solved at the same time or sooner tiian
the building completion date.
3. When the ordinance governi.ng apartment heights was adopted, he didn't
think the City considered that anything higher than 6 stories would ever
be built in Fridl.ey.
