Also, to provide space for a workshop for home repairs and maintenance. This space will make raam in the existing two car garage for two cars again. The hardship is that the lot line on the north side of the prQperty runs at an angle such that is greatly reduces the size of the space needed. Mr. Bolin stated the petitioner is seeking to decrease the rear yard setback from 27.69 feet to 22.69 feet to allow for an addition with a workshop and storage area on the attached garage. The code requires a rear yard setback of 25% of the lot depth or, in this case, 27.69 feet. Mr. Bolin stated the lot was platted in 1984 and does have an irregular shape. The home was built in 1985. 1 APPEALS COMMISStON �TtNG, AtJGUST 25, 9999 • PAGE 2 .. Mr. Bolin stated the petitioner is seeking to add approximately 13 feet to the back side of the attached garage. This would extend about 7 feet from the back of the home and would extend approximately 5 feet past the rear yard setback line. The existing tree house in the back yard will be removed. The addition will be screened from the neighbors by a fence and does meet the side yard setback requirements. Mr. Bolin stated the petitioner's hardship statement indicates the lot line at the north side of the property runs at an angle such that it reduces the size of the space needed. By having a deeper setback at the rear lot line, it would allow enough space and access to that space. Mr. Bolin stated the request is within previously granted variances. Therefore, staff has no recommendation. If the Appeals Commission chooses to approved the variance, staff recommends the following stipulations: 1. Property owner shall obtain building permits prior to construction. 2. The addition shall architecturally match the existing garage and home. Mr. Jones asked if staff had received any comments from the neighbors. Mr. Bolin stated he had received one call, and that person was wondering what the variance was for. There were no comments. Mr. Kuechle asked how close the neighboring homes were to the properiy. Mr. Bolin stated the nearest home is to the north and appears to be approximately 25 feet from the rear lot line. Another home would be approximatefy 32 feet from the rear lot line. Mr. Kuechle asked how many square feet wil! be outside the setback line. Mr. Bolin stated he did not have that information. Dr. Vos stated it looked like the existing setback from the side is 12.9 feet. It could have been up to 5 feet. Already the garage is set back nearly 8 feet over the normal distance from the neighbor's yard. Can the petitioner build in the easement? Mr. Bolin state that with the current site plan, the petitioner would not be building in the easement. If they did, the petitioner would be asked to sign a hold harmless agreement should the City need to do work in that drainage and utility easement. Mr. Laconic stated he was thinking of adding 15 to 16 feet onto the existing garage. When he asked about it, he was told he could go 13 feet off the back of the garage without a variance. He measured from the rear lot line to 22.69, which was about what he wanted. D , ! • � ' APPEALS COMMISSION MEETING, AUGUST 25, 1999 PAGE 3 Mr. Laconic stated the plan is not to make it obtrusive. The pine trees to the northwest are very large. A 6-foot privacy fence already exists. The addition would not be seen by the neighbors that easily. He does not want the addition to an eyesore. The rest of his property is well taken care of and nicely landscaped. He wanted the additional space so he could keep both cars in the garage along with the bicycles, lawn mowers, etc. and a workshop. If he did not make it that size, it would not be a usable space and would not justify the cost. Dr. Vos asked if there was a reason why he foliowed the easement rather than make the addition rectangular. Mr. Laconic stated he thought he had to do that. He was not aware that he could build across the easement. He would be concerned about the drainage if he went too close to the lot 1ine. Dr. Vos asked if the petitioner had received any comments from the neighbors. Mr. Laconic stated the only person who came was just curious. The neighbor to the south is a carpenter and wanted to help. The pfan is acceptable to him. The other neighbors have not said anything. MOTION by Dr. Vos, seconded by Ms. Mau, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:43 P.M. Dr. Vos stated the request seems reasonable. It is not intrusive into the back yard. With a pentagon shaped lot, you will have some tight corners. It looks as though the petitioner has one on the northwest side. He is comfortable with the 12.9 foot spread from the neighbors, so he would approve the variance with the stipulations. Ms. Beaulieu agreed. The request is not out of line with previously granted variances. Mr. Kuechle concurred. The totat square footage of the encroachment is really quite small. The other parts of the lot tend to balance out the spirit of the requirement that the lot not look overcrowded. Ms. Mau and Mr. Jones agreed with these comments.
