Request
The petitioner requests that a variance be granted to reduce
the rear yard setback from 33.7 feet to 26 feet to allow
construction of a porch addition at 6645 Arthur Street N.E.
Site
Located on the property is a single family dwelling unit with
an attached two-car garage.� The property is zoned R-1, Single
Family Dwelling, as are all surrounding properties.
Analysis
Section 205.07.03.D.(3).(a) of the Fridley Zoning Code
requires a rear yard setback of not less than 25� of the lot
depth with not less than 25 feet permitted or more than 40
feet required for the main building.
Public purpose served by this requirement is to provide rear
yard space to be used for green areas which enhance the
neighborhood.
The petitioner proposes to remove an existing 8 ft. by 18 ft.
porch from the rear of the dwelling unit. In its place, they
propose to construct a 16 ft. by 18 ft. porch addition with
a 2 ft. by 4 ft. alcove.
The dwelling unit is set back 55 feet from the property line
and is perpendicular to the front lot line, as opposed to
being parallel. There is 18 feet between the living space and
the side lot line and 11 feet between the attached garage and
the side lot line. If the dwelling unit was not set back an
additional 20 feet from the front property line as required
by code, a variance request would not be necessary. In
addition, the design and position of the dwelling unit also
decreases the rear yard setback. If the house was constructed
90 degrees from its current position, additional rear yard
would have been gained by the original property owner.
These circumstances are unique to this property and do not
occur on any of the adjacent properties. None of the adjacent
properties have received variances, and all meet the setback
requirements. If the variance is granted, there is still
adequate distance between structures from the subject parcel
to the parcel to the rear.

Ms. McPherson stated the property is located north of Mississippi
Street and south of Rice Creek on Arthur Street. The property is
zoned R-1, Single Family Dwelling as are all surrounding parcels.
The petitioner is proposing to remove an existing 8 ft. by 18 ft.
porch located at the rear of the dwelling unit. The petitioner

will then replace the porch with a 16 ft. by 18 ft. addition with
a 2 ft. by 4 ft. alcove.
Ms. McPherson stated the dwelling unit is actually set back 55 feet
as opposed to 35 feet from the front property line. If the
dwelling unit was placed at the 35 foot setback, there would be an
additional 20 feet in the rear yard, and a variance would not be
needed.
Ms. McPherson stated the dwelling unit is also set perpendicular
to the street as opposed to parallel to the street, which puts the
long dimension of the dwelling unit more toward the rear part of
the property. If the dwelling unit had been turned 90 degrees,
that would also have eliminated the need for a variance.
Ms. McPherson stated that none of the adjacent properties have been
constructed in a similar manner, and none of the adjacent
properties have received variances. If the variance is granted by
the Appeals Commission, there will be still adequate distance
between structures, specifically from the proposed addition to the
property to the rear.
Mr. James Pearson, 6645 Arthur Street, stated he was told by the
former Building Inspector, Darrel Clark, that he believed that the
house was built perpendicular to the street before any other houses
were built behind it. He stated the reason they are requesting 14
feet plus a 2 foot alcove for a total of 16 feet is because 2 feet
will be used for a closet to extend the back of the bedroom which
is currently only 11 ft. by 12 ft. The house has been through a
number of remodelings, and the rooms got smaller rather than bigger
which is unusual. The alcove will serve as a bookcase to add a
little more style to the room. He will be using the existing
foundation, so there will be no additional excavation.
Dr. Vos asked if there was any objection from the petitioner's
neighbors.
Mr. Pearson stated he had not heard any objections from his
neighbors. He stated the existing porch is in poor condition, and
he is sure the neighbors will appreciate the new addition.
Ms. McPherson stated she did receive a call from one of the
neighbors to the rear of the subject property. The neighbor agreed
that the old porch is in poor repair.

Dr. Vos stated that as mentioned by staff, he could see a two-fold
hardship:
1. The 55 foot front yard setback. If the house had been
set back at the normal 35 feet, the variance would not
be needed.
2. The side yard setbacks reinforce the idea of the house
sitting at a 90 degree angle, because there is a 11 foot
setback on one side and an 18 foot setback on the other.
Dr. Vos stated he would vote to approve the variance as requested.
Ms. Beaulieu agreed. She stated that the code says that a rear
yard setback cannot be less than 25� of the lot depth with not less
than 25 feet permitted. So, even if the lot was shorter, the 23
feet would be all right. She would also vote to approve the
variance.
Mr. Kuechle stated he also agreed. The lot coverage is quite low.
The spirit of the code is to prevent overbuildinq and a cluttered
appearance on the lot, and he did not see any negative impact to
the property if the variance is granted.

Dear Mr. Pearson:
On October 19, 1993, the Fridley Appeals Commission officially
approved your request for a variance, VAR #93-27, to reduce the
rear yard setback from 33.7 feet to 26 feet to allow the
construction of an addition on Lots 20 and 23, except the north 5
feet of Lot 23, and including the west 1/2 of the vacated alley,
Block 3, Oak Grove Addition, the same being 6645 Arthur Street N.E.
Please review and sign the Action Taken Letter below and submit one
copy to the Planning Department by October 29, 1993.
You have one year from the date of the Appeals Commission action
to initiate construction. If you cannot begin construction in
time, you must submit a.letter requesting an extension at least
three (3) weeks prior to the expiration date.
If you have any questions regarding the above action or the need
for an extension, please call the Planning Department at 571-3450.
