INTRODUCTION
This report concerns the inspection we performed of the soil conditions in the footing areas
at the above referenced project. The results of a preliminary soil investigation conducted
at this site by Soil Exploration Company and reported to Dennis Ranstrom on July 13, 1973,
were available for our use during the inspectione The report indicated the original ground
surface sloped downward sharply from the south and central portions of the site toward
Rice Creek in the east, north and weste However, within the proposed house area, the
slope was gradually downward from the south to the north. The original report also
indlcated the generalized sgil profile consisted of coarse alluvial soils in a relatively
loose condition overlying glacial till at a considerable depthe
We understand the building will be a one-story residence with a walkout basemer�te The
structure will be supported on continuous strip perimeter footingse We have no �nformation
regarding the actual building loads, but assume the foundation design rvas based on an
allowable bearing capacity o�f up to 2000 psf, The footing elevat�orrs will vary from
ap�roximately 84' in the northeast corner of the residence to 89° in the south portiono

dense conditione Our observations indicated that in the portions of the footing areas
nearest the relatively steep downward slope to Rice Creek the footings had been subcut
2' to 3' into the natural soiis. In addition, some fi11 had been placed on the slopes
to reduce the slope angleo Approximate field evaluations of the slopes indicated a
maximum angle between 30 and 40 degrees from the horizontalo

CONCLUSIONS
Based on the results of the preliminary soil investigation and our on-site inspection, it
is our opinion the soi'[ network underlying the structure will provide adequate support
for the relatively Tight unit loadingse In addition, providing proper upkeep of the slopes
is maintained, such as fostering vegetation and inhibiting the formation of deep drainaye
channels down the slopes in the vicinity of the structure; we would not anticipate any
slope instability that would have a detrimental affect on the structureo We are

FROST PRECAUTIONS FOR COLD WEATHER CONSTRUCTION
During cold weather, frost poses a constant
problem for construction. As frozen soils
undergo a moisture volume expansion, we
strongly recom�nend that frozen soils never
be used as fill material. Similarly, we
recommend that fill soils not be placed
over frozen materials. Winter excavation
should be limited to the amQUnt of work that
can be accomplished during the day's time.
Consequently, footing trenches should be
inspected to verify that all frozen matertals
have been removed and concrete placed shortly
after. The newly placed footings should be
covered imnediately to both keep the cold out
and maintain the heat of the concrete mass.
The protective covering should be maintained
until an adequate set has been achieved within
the concrete, generally two days. Thereafter,
the footings can be stripped and construction
continued assuming a heated environment is
being supplied.
Backfilling operations, both interior and
exterior, should be completed before temporary
heating facilities are removed or during a
time in which ambient temperatures will permit
effective soil placement. In addition, interior
footings or footings designed without frost pro-
tection should be extended below frost depth
unless adequate precautions are taken to insure
against frost intrusion.
Upon enclosure of the structure, we recorr�nend
that all floor slab areas receive ample periods
of heat to allow thawing of the soil system.
The floor slab areas should be periodically
checked for remnant areas of frost and in-place
density prior to slab placement.

concerning other construction materials are
required, please contact us.

We are sure you are aware of the problems that have occurred in conjunction
with the construction of the home built at 6700 Arthur 5treet.
We have had constant concern over the stability of the soils underlying the
footings and embanlanent retainment around the structure.
We requested and you have cooperated in getting the tests and necessary
professional direction as to what the footing depths should be.
Our previous inspections were made and it is our belief that the engineers
recommendations were followed. However, sometime this spring, we noticed that :
the east and north walls of the garage masonry walls were forced out by overloading
the inside without proper support being placed on the outside.
We routinely checked the garage before the flaor was poured and appaxently '
you were then in the process of correcting the problem with the walls going out.
We red tagged the job at this point, stating you should not pour the floor
without getting our approval on the correction method you planned to use. Now
we find the floors poured, the red tag is still posted, and we still don't know
what you did to correct the wall failures.
We cannot final this buildinq in its present state without knowing what was
done or who is responsible for what on the outside retainment. Therefore, we are
proposing to set a meeting on the site for 1Q;30 A.M., July 2, 1974, between you,-

the City, and the homeawner.

Subject: Stream Bed and Bank Stabilization Program
Dear Mr. & Mrs. Burzynski:

At the City Council meeting of October 5, 1992, the Council reviewed your proposed
stream bed and bank stabilization project to be incorporated in the Rice Creek
Watershed District's project adjacent to your property. It is understood that the gabion
wall portion of the project on your property is estimated at $20,475. It is also understood
that the State will participate with 50% of the funding and the Rice Creek Watershed
Distriet would contribute one-third of the remainder.
Based upon the City's Storm Water Policy and their interest in reducing the sediment
and erosion that is occurring in Rice Creek, the Council agreed to support your project
and participate up to 50% of the remarning amount, not to exceed $3,415.
In accordance with the Rice Creek Watershed District's requirements, I would suggest
that you initiate the necessary agreements and obtain the permits. When this has been
accomplished, please notify the City of the construction scheduie. Total cost of the.
project and the various participation amounts need to be submitted to the City prior to
payment of the City's share.

OENERAL PROVISIONS
This permit is permissive only and shall not release the Permittee from any liability
or obligation imposed by Minnesota Statutes, Federal Law, or local ordinsnces relating
thereto and shall remain in force subject to all conditions and limitatione now or
hereafter impoaed by law.
No change ehall be made, without written permission previously obtained from the
Commissioner of Natural Resources, in the di.mensions, capacity, or Iocation of any
items of work authorized hereunder.
The Permittee shall grant accesa to the site at all reasonable times during and after
construction to authorized repreaentatives of the Commissioner of Natural Reaources for
inspection of the work authorized hereunder.
This Permit may be terminated by the Commissioner of Natural Resourcea at any time
he/she deems it necessary for the conservation of water resources of the state, or in
the interest of public health and welfare, or for violation of any of the provisiona
of this permit, unless otherwise provided in the Special Provisions.
Construction work authorized under this permit sha12 be completed on or before the date
specified above. Upon written request to the Commissioner by the Permittee, stating
the reason therefore, an extension of time may be obtained.
The excavation of soil authorized herein shall not be construed to include the removal
of orqanic matter (as indicated above) unless the area from which such organic matter
is removed, is impervious, or is sealed by the application of bentonite after
excavation.
In all cases where the doing by the Permittee of anything authorized by this permit
shall involve the taking, using, or damaging of any property righta or interests of any
other person or persons, or of any publicly owned lands or improvementa thereon or
interests therein, the Permittee, before proceeding therewith, shall obtain the written
consent of aZl persons, agencies, or authorities concerned, and shall acquire all
property, rights, and interests necessary therefore.
This permit is permissive only. No liability shall be imposed by the State of
Minnesota or any of its officers, agents, or employees, officially or personally, on
account of the granting hereof, or on account of any damage to any peraon or property
resulting from any act or omission of the Permittee or any of its agents, employees,
or contractors relating to any matter hereunder. This permit ahall not be construed
as estopping or limiting any legal claims or right of action of any person other than
the state against the Permittee, its agents, employees, or contractors, for any damage

or injury resultinq from any such act or omission, or as estopping or limiting any
legal claim or right of action of the state against the Permittee, its agents,

No material excavated by authority of this permit nor material from any other source,
except as specified herein, ahall be placed on any portion of the bed of said waters
which lies below (as indicated above).
Any extension of the surface of said waters resulting from work authorized by this
permit ehall become protected waters and left open and unobstructed for use by the
public.
This permit ahall become effective on the date it is recorded in your County in the
Office of the Recorder. The work affecting protected waters authorized herein shall
not be commenced until a Notice of Permit has been conspicuously posted at the
construction site and a copy of the recorded permit is posted on or near the premiaes
upon which such work is conducted. A Notice of Permit will be issued by the
Commissioner upon his receipt of a Certified copy of the recorded permit.
All general and special provisions of this permit shall bind the Permittee, his heirs
and assigns and shall run with the land.
After completion of the project authorized, Permittee ahall supply the Department of
Natural Resources with photoqraphs of the project area.
Permittee shall maintain the authorized project in a stable and safe condition. At any
time the Commissioner finds that the project is subject to instability, creates a
navigation hazard, has become a public nuisance, or has fallen into a state of
disrepair, he shall order the owner to repair the project within a specified time.
Any Commissioner's Order terminating this permit may also require the Permittee, at his
own expense, to remove within the time specified in said Order, any authorized project
constructed under this permit and, if applicable, any authorized project in violation
of this permit. Said Order shall also require the Permittee to restore, if necessary,
the protected watera or beds thereof to the condition existing before the unauthorized
activity.
This permit does not obviate any requirement for federal assent from the U.S. Army
Corps of Engineers, 1421 U.S. Post Office and Custom House, St. Paul, Minnesota 55101-
9808.
SPECIAL PROVISIONB
1. The permittee shall comply with all rules, regulations, requirements, or standards of
the Minnesota Pollution Control Agency and other applicable federal, state, or local
agencies.
2. Permittee shall ensure that the contractor has received and thorouqhly understands all
conditions of this permit.
3. Erosion control measures shall be adequately deaigned for the site characteristfcs.
They may include staked haybales, diversion channels, sediment ponds, or sediment
fences. They shall be installed in accordance with "Protectina Water Oualitv in Urban
Areas - Beat Manaaement Practices for Minnesota" MPCA, October 1989, prior to
commencement and maintained throughout the project. All exposed soil shall be
stabilized as soon as possible and no later than 72 hours after the completion of the
project. Topsoil should be used to re-dress disturbed soil areas and indigenous plant
species should be used to revegetate disturbed areas whenever possible.
4. Upon completion of the authorized work, the permittee ehall submit representative
photographs and any as-built surveys, as appropriate, of the project area to DNR Metro
Region Waters (1200 Warner Road, St. Paul, MN 55106).
5. Where the work authorized by this permit involves the draining, filling or burning of
wetlands not subject to D13R jurisdiction, the permittee shall not initiate any work
under this permit until the permittee has obtained official approval from the
responsible governmental unit as required by the Minnesota Wetlands Conservation Act
of 1991.

This letter is written to document our telephone conversations of the week of March 8, 19�3 in
which you expressed concern about the orientaaon of the recently completed gabion w�ll. Briet7y
stated, your concern was that the gabion wall did not appeaz to have been set as deeply as shown in
the typical cross section included in the plans set.
In response to your inquiry, I spoke with Mike Shuda who is the construction inspector for
Montgomery Watson on this project and was present during construcdon. Mike revisited the site
foilowing your telephone call and discussed his findings with me. Based on his follow-up
inspection and both of our inspections during construction of the wall we feel the wall is properly
constructed. The reasons for this conclusion are oudined below:
The typical cross section shown in the plans is used to provide the contractor with
general information relating to the construction of the praposed wall. The figure's
primary_ purpose is to show that the baskets are not placed on the existing channel
surface but ir�stead are ptaced ca an �excava�ed �tevel su.-face below the existing channel
elevation. Your gabion wall was installed in an excavated area thus , providing a more
stable foundation.
The gabions were installed by first having a back hoe dig down in the channel bottuni
and then lift/pull the bed material out towards the center of the creek. In order to place
the baskets securely on the excavated area it is necessary to excavate a portion of the
bed in front of the (eventual) face of the gabion wall. lfiis leads to more of the face
being "exposed" even though the baskets were set below the historic channel bottom.
• Additionally, more face of the wall became exposed as a result of moving the wall
' slightly nonh. We did this to accommodate your request to maximize the backslope co
the existing embankment. Minor conections were made in the field to accommodate

this request which results in the bottom tier having more of its face exposed. This,
combined with the minor channel excavation in the area resulted in che majority of the
wall face being above the "new" channel bottom. �
During construcdon of the gabion wall and excavation of the realigned channel a
continuous shelf of heavy clay soils was encountered• While clay soils were expected

near the channel bottom, the entire project site was finished off in the clay layer. This
was advantageous because the clay layer is very al�on for the cab onr ll ht elf.annel
bottom and also provides an extremely stable founda g
Lasdy, we have confidence in the integrity of the wall based upon the design which was
used. � standard gabion wall cross secdon is composed of 3 foot by 3 foot cubes
stacked �slighdy offset. For the Rice Creek Pro}ect, a 4.5 foot deep by 3 foot high
basket was used as a base. This extra deep base, combined with ti�e second tier being
offset to the rear of the wall, results in a stable cross section which greatly resists
"tipping" relative to the standard cross section. Because of uncertainties and variability
along stream channels we used this more massive design to ensure a sound project.
Your letter briefly mentioned the "warranty" on the wall. Standard specifications used on this
project do, in fact, have a one year correction period: Extensions to this period would not be
offered by the District and could not be offered by the contractor.
We appreciate your contacting us with this concern and also a number of issues during the course

Rice Creek Watershed District was notified on 1Vlarch 29�', 2006 of soil being placed on
the eastern upland portion and slope of your property, which is adjacent to Rice Creek.
Per my inspection on March 29th, 2006 and our telephone conversation Mazch 31 �, 2006,
you have agreed to submit a timeline and specifications for the erosion and sediment
control practices you will �se to stabilize the bare soil on your property and to control
sediment from entering the creek. We recommend the use of deep-rooted native
vegetation to stabilize soil and to install silt fence or other Best Management Pra.ctice
(BMP) to retain sediment witliin your property.
The implementation timeline and the stabilization practices to be used should be
submitted to RCWD by Friday, April7th, 2006.

STIPULATIONS
READ BEFORE SIGNING APPLICATION
1. A surety bond or certified check in the amount of $ (5% of value of work to be completed) must be
submitted after approval of application and prior to any work commencing. This bond or check is to ensure satisfactory
performance and compliance with the below stated stipulations. The surety bond or check shall be kept active until the
completion of work and/or expiration of permit and can only be released by written notification of the City after a
satisfactory final inspection has been performed by the City.
2. All access and street frontage of the land alteraiion site must be controlled by a fence, a minimum of four (4) feet in
height. All entrances must have gates that are capable of being locked.
3. Only rock, sand, gravel, dirt, or similar natural earth fill is permitted. No concrete, asphalt, or demolition wastes will be
permitted as fill unless a demolition landfill permit is first obtained from Anoka County.
4. Operations shall be limited to daylight hours and shall not interfere with the health and safety of surrounding residents
and the premises shall be maintained at all times so as not to create a nuisance.
5. Any explosives used must be done so in accordance with Chapter 212, subsections 212.07.SA, .SB, .SC, .SD, and .SF.
of the Fridley City Code and any other applicable standards, e.g. Federal, State, Industrial, etc.
6. At the end of each season's operations and no later than the last day of December each year, the site is to be left in a
neat and orderly condition, with maximum slopes of 2:l with no overhang or vertical banks and with a level bottom.
7. On the Friday of each work week, or when required by the City, material from this operation that is found to exist on
City streets shall be cleaned to the City's satisfaction by the applicant.
8. Upon comp[etion of (and a[teration operations, the Iand must be Ieft according to the plans and contours submitted witF�
this application and planted with suitable vegetation to prevent erosion.
9. Upon completion of land alteration operations or expiration of this permit, an inspection will be made by the City of the
premises and adjoining streets. Any damage found to have been caused by these operations will be corrected by the

Subject: Slope stabilization practices and timeline (RCWD # 06-021R)
Dear Mr. and Ms. Burzynski:
This letter is to confirm the approval of your soil stabilization plan, which was submitted
on Friday Apri17`h, for the slope and bank of your property. It would be fine with
RCWD that you add more soil to the bank, as long as you do not add a layer of soil
deeper than 6 inches and you keep sediment from going down slope and entering the
creek. The District Inspector will be visiting your site until it is completely stabilized.
Maintenance of silt fence and other erosion control feature will be needed until the site is
fully vegetated. Please remember that any future alteration of land needs a permit from
the RCWD before initiating activities.
