A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.D53, 4, C, requiring that a rear depth of not les�
than 25 per cent of the lot depth be permited, and/or more than
40 feet is required.
Public purpose served is to provide rear yard space to be used
for green areas which enhance the neighborhood.
B. STATED HARDSHIP:
Home to be built for a handicapped person in a wheel chair with all living
area on one level.
C. AD��1INISTRATIVE STAFF REVIEW:
Field measurements show that the proposed rear yard variance will be
on the north side of the lot, adjacent to an existing house and
detached garage. There is not sufficient survey information to
show how far the existing garage on the north would be from the
petitioner's proposed garage. There is a 13.5 boulevard on Arthur
Street. The petitioner intends to stay back 35 feet from Arthur
Street as well as the right of way on the south side of the lot.
The total lot coverage proposed is 18.2l, with a house and garage
totally 2,472 square feet.

Fridley will meet in the Council Chamber of the City Hall at 6431 University
Avenue Northeast at 7:30 P.M. on Tuesday, May 23, 1978 to consider the
following matter:
A request for a variance to the Fridley City
Code, Section 205.053,4,C, to reduce the
required rear yard setback from 34 feet (1/4
of the lot depth) to 21.6 feet, to allow the
construction of a house and garage on the South
135± feet of Lot 22, Block 2, Spring Lake Park
Lakeside, the same being 7577 Arthur Street
N.E., Fridleys Minnesota. (Request by Henry
J. Gunnick, 8015 Madison Street N.E., Minneapolis,
Minnesota 55432).

be heard at this meeting.

Section 205.053, 4B, requires a minimum side yard setback of 10 feet fox
living area.
Public purpose served by this requirement is to maintain a minimum of 20
feet between living areas in adjacent'structures and 15 feet between
garages and living areas in adjacent structures to reduce exposure to
open areas around residential structures.
�, STATED HARD$HIP:
"We were unable to build a home with a full basement durinq the original
construction. This has created a space shortage that has limited the
free movement of the wheelchair in the family room and kitchen area."
C. ADMINISTRATIVE STAFF REVIEW:
This same petitioner was granted a variance on rear yard setback in May
of 1978 (£rom 34 to 22 feet).. It should also be noted that they could
add 12' to the north of the family room or 6 feet to the east without
a variance. Also for some reason the north/south dimension of the lot
has been reduced by a little over 1 foot {1.15) therefore, note that
the setback off the south line is 33.4 instead of the required 35 feet.
�f the addition is made it will be overlooking the rear yard of the
vacant lot to the,east, that lies only 4.5 £eet away. Therefore, it
is staff recommendation that the request be denied, or if approved, no
windows be allowed along the east side to maintain some degree of
rear yard privacy for the lot to the east, also that the south setback
should be approved.

C. ADMINISTRATIVE STAFF REVIEW:
Field measurements show that the proposed raar yard variance will
on the north side of the lot, adjacent to an existing house and
detached garage. There is not sufficient survey information to
show how far the existing garage on the norS� would be from the
petitioner's proposed garage. There is a 13.5 foot boulevard on
Arthur Street. The petitioner intends to stay back 35 feet from
Arthur Street as well as the right of way on the south side of the
lot• The total lot coverage proposed is 18..2i, with a house and
garage totally 2,472 square feet.
Ms. Karla Blomberg was present at the meeting with Mr• & Mrs. Gunnick.
Ms. Blomberg explained on a drawing to the Appeals Commission how the
house would be situated on the lot. She also indicated that the house
would be an L-Shape Rambler that would be constructed to accommodate
a wheel chair• She said the halls would be larger/wider than usual
and would be entirely ramped. She said that the plans indicate the
only way that particular house could be located on the lot.
Ms. 8lomberg pointed out to the commission the �etbacks that wo�ld be
needed on the lot.
Chairperson Schnabel asked if the house would setback 35 feet
from the 25 foot street right-of-way.
Mr. Holden said that even if the street went through
{street right of way on the property}, the 6unnick's would have enough
setback. He said that the Gunnick's garage and the adjacent neighbor's
garage would be at least 24 feet apart- •
Mr• Plemel asked if the 35 foot setback would be maintained on
both the proposed street and Arthur Street.

Mr. Holden said that it would be done because of the way the house
would be situated on the lot.
_ Ms. Blomberg pointed out that an adjacent property owner had been
approached re�ardzng selling some of their lot to enable the Gunnick's
lot to have more rear yard space. However, she said that the house was
set back quite far from the street and the land purchase was never persued.
Chairperson Schnabel asked how soon they planned construction�
Ms. Blomberg said they wanted to start construction some time i�

Chairperson Schnabel eicplained that it had been req sted that they hear
the request that evening.even though Public Notic had not been sent
out and the request had n t been published. She said that the petitioner,
received from City Hall a ist of the people t t would be the effected

them to sign a notice of publ'c hearings. e read the petition wording
into Public Record, "We the un ersigned wa' e our rights to the traditional
ten day notice of public hearin for var' nce request on a property
located near the corner of Jeffe on an Madison Streets NE, the address
being 676� Madison Street NE. Le 11 described as follows: Lot 3,
Block 5, Rice Creek Terrace Plat 6• he variance request is to Code
Section 205.�53,4,C, to reduce the quired rear yard setback from

Mr• Bethel said at it was due to a misunder anding on his part.
Ne said he wasn't aw re that a variance had to be ob ained. He said that
he had already con acted with a person to dig the ba ment, however, the
equipment broke d n and the work hadn't been ccmplete He said that he
didn't want to h ve to wait until the midd7.e of June bec use the person
had the equipme t repaired and would be able to start work around the first
part of June. He pointed out that the Appeals Commission's next meeting
wasn't until une 13, 1978.

Mr. Bethel indicated that he planned to sub-contract the work on
the addition. He said that the process of sub-contracting was usually
time consuming. He wanted to be able to have enough time t� have the
addition completed by winter. He said that he didn't want to start
any type of scheduling of the contractors until he had final approval.
Mrs. Bethel said that she had taken the petition around to the
neighbors. She said that she explained exactly what the petition was
saying as well as asked each person to read the petition 6efore signinq.
She said that she brought the plans along with her and showed it to
the people. She said that the only person that had showed concern was
a neighbor who was to the back of their roperty. She said that he was
relieved when he saw the plans. She sai that presently when anyone
used the rear door, they looked directl on the neighbors deck= She
said that in the-new plans, that rear d or would be moved and the entire
wall would be sblid with a fireplace• he said that the neighbor liked
the plans. She said that she indicated to each person that they
should appear at £�e Public Hearing if hey had any questions or concerns
Mr. Kemper said that he had a prob em with the manner the request
was being put through the process. He id not feel that the Appeals
Commission should have final approval o this type of hurry-up request.
He said that he realized that the Appea s Commission did have authority
to act on R-1 requests; however, he sai that the approval was giver�
to the Commission by City Council with he intent that there would be
due process and an appropriate length o time for publication and
notification.

If the addition�is made it will be overlooking the rear yard of the
vacant lot to the east, that lies only 4.5 feet away. Thezef.ore, it
is staff recommendati.on that the request be denied, or if appreve3, no -----
windows be allowed along Che e4st side to maintain some deg�ee of
rear yard privacy for the lot to the east, also that the solith setback
shoutd be approved.
t}r. Clark said that he had talked to Karla Blomberg, who is the developer of the �
property on the South side of this house, and she said she had no objection to the
variance being granted. i
Mrs. Gunnick said that the present 12' by 24' living area was not large enough for
her wheel chair to move around in, and if there were other people in the room, it
became too congested. '
Mrs. Kurtznolan, owner of the property to the east side of the house, said that she
did not object to the addition to this house. lier house sits north of this house,
and her lot is over 300 feet long. Even if Mrs. Kurznolan were to split off the
south half of her property, the lot was over 100 feet wide and it was felt. that
any new house could be placed so as not to be bothered by this addition. (The new
lot would be approximately 150` x 100').
Mrs. Karla Blomberg spoke in favor of the addition and showed the Commission members
the house plans.
Mrs. Schnabel asked if the proposed addition would be appoxi.mately the same size
of the existing deck? Mrs. G�nnick said it would be as wide (12') bur would be
about 2 feet shorter:
Mrsr Schnabel asked if the trees growing behind the deck, and serving as a screen
from the property to the east, were on the lot line. Mrs. Gunnick said yes, they
were on the property line.
Pirs. Scluiabel asked Mr. Clark if, in view of the comments of the neighboring
property owners, the staff would withdraw their objections?
Mr. Clark replied that yes, the objection would be withdrawn, especially in
light of the large lot size of the property to the east.
