The garage on the neighbors lot to the north has been removed. The
existing garage is a single car garage and is located about 4 feet from
the north line, it would be very difficult to increase its size.
The owner would like to attain a variance to have living space 4 feet
from the north line which would enable him to convert his existing
gacage to living. Then he would like to build a 130H square foot
garage,-one large enough to house all his cars and other personal
it�s. The code allows 1090 square feet.
The staf£ has reco�edned that he build one garage at 1900 square feet
and has ' him that he then could build a separate utility
structur of 250 re feet giving him a total of 1250 square feet of
accesso es.
If the Board approves the reduction of the aide yard froan 10 feet to 4
feet for living we recaimend that the Board stipulates that the north
wall be a firewall with no openings.

f•tr. Clark showed the Coronissioners a picture of the residence and an aerial
photo that shows there are no structures that are close on the neiqhbor's lot
to where the garage now exists.
The petitioner stated thav have a single car garage and the square footage
does not handle all the cars and personal iteris ±hey need to store inside,
especially during the winter nanths.
Mr. Betzold stated that as far as building the garage, the code allrn•rs a
1000 sq. ft. garage without a variance, ar�1 then, as pointed out by Staff in
the Adninistrative Staff Report, the petitioner could build a 250 sq. ft.
accessory building giving theri a total square footage of 1250 sq: ft. for
storage. Ne stated that in order for the Commission to vary the code, the

h1r. Betzold stated the hardship stated in the Administrative Staff Re�ort
actually addressed the reason why the petitioner needed a larger garage; it
did not say anythinq about the first variance request for a side yarci sethack
to build additional living space.
The petitioner stated they need to have at least a two-car qarage, and since
they need more living space, the most logical thing was to convert the
existing garaqe to living area.
Mr. Betzold stated that withou+. b�ilding a nerr garage, there was the possi-
bility of a lot sptit; but, with tfie building of the garage in the proposed
lor;ation, there was no way the lot could ever be split. He just �•�anted to
make the petitioner aware of this.
Thr petitioner stated that was fine with him. He had no plans of ever
wai�ting a 1ot split.

for the garage to exceed 1000 sq, ft., so they were looking at the conversinn
of the existing attached garage into livinq space. The exis*_ing garage rias
a stucco structure tied into the existing house and it would not r�ake any
sense to tear it down. He would see their living space hardship as the only
�vay to make the existing garage a usable space without going fnr a special
use permit, The petitioner had said they would rather have living space than
another garage.
I1r. Sherek stated that in soite of the fact that he would lil:e to have heard
the petitfoner ex�ress a little bit more about why they needed additional
living-space as opposed to why they needed a gdrage, he could not see anv
problem taith changing the presenti garaqe intQ living space. �
Mr. Betzold agreed that the hardship was a little thin on this variance request.
He could see what the petitioner was try�ng to do. They do want to increase
their c�arage space as they do f�ave a fairly se�all existing garage. Ry
increasing tfie garagP space, it did make the existing garage someYrhat su�er-
fluous. It did exist and was already closer to the property line than it

from the north line which would enable him te convert his existing
garage to living, Then he Wnuld like to build a 13Q0 sq, ft, garage,
one large enough to house all his cars and o±her personal items. The
code allows 1000 sq. ft.
The Staff has recommended tha± he buitd one garage at 1�00 sq. ft. an�i
has informed him that he then could build a seoarate utili*v structure
of 250 sq, ft, giving hin a total of 1250 sq, ft, of accessory structure.
If the Qoard approves the reduction of the side yard fror� 10 ft. tn n ft,
for living, we recommend that the Roard stipulate that the north wa71 be
a fire wall with no openinqs.

phoio that shows there are no structures that are close on the neiqhhor's lot

The petitioner stated tbey have a singTe car garage and the square footage

actually addressed the reason why the petitioner needed a larger garage; it
did not say anythinq about the first varience request for a side yard sethack
to build additional living space.
