The Regular Council Meeting of the Fridley City Council was convened at 7:30
F.M., September 25, 1972. The Meeting was called to order by Mayor Pro tem
Breider in Mayor Liebl's absence.

Mr. Sam Templin - Request for a Front Yarrl Variance for Lot 1, Block 1,_
� Edgewater Gardens Plat 2.�
Mr. Templin said that he has a front yard setback variance he would like
appraved. He said the reason he needs this variance is because of the
irx�egularly shaped lot and so the house will line up with the rest of the
houses in the block. .
Councilman Mittelstadt said that Mr. Templin called him last week and he told
Mr. Templin that he could appear before the Council tonight under the Visitors
seGtion. This variance seems logical so that the house would be more in
J.ine w�.th the rest of the buildings. Mayor Pro t�em Breider asked Mr. Templin
�� b��m� his certifiaate of survey forward to the Council table.

There followed a discussion at the rtable while looking at the survey. The
City Engineer said that he had informed Mr. Templin of the proper procedure
for applying �or a variance. In this case there is City park property to
the north of the lot. Mr. Templin added that there is some hurry as the
party buying the house would like to be in by Christmas.
MOTiON by Councilman Mittelstadt to approve the variance requested by Mr.
sam Templin for Lot 1, Block 1, Edgewater Gardens Plat 2, as shown the
Council this date and marked as "Exhi�it A". Seconded b�,.Councilman Utter.

MayQr Pro tem Breider said that this would be a hearing to consider the
amendment's that have been suggested to the CATV Franchise Ordinance #496.
At this hearing, the Ordinance amendments are to be the only order of
business.
MOTION by Councilman Mittelstadt to set the public hearing date for Octpber
17, 1972 at 7:30 P.M. (Tuesday), in the Council Chambers to consider the
CATV Ordinance amendments. Seconded by Councilman Utter. Upon a voice
vote, all ayes, Mayor Pro tem Breider declared the motion carried.
CONSIDERATIOAT OF APPROVAL OF.FINAL PLAT P.S. #72-03, TIMBER RIDGE BY ROBERT

�'he City Engineer said that the public heaxing was last Monday night and
there were no objections. The Planning Commission recommended approval of
their requests with some stipulations. The plat could be approved subject
tQ the drainage and utility plans being approved by the Engineering Depart-
ment, $500 to be placed in parks escrow and a dedication of park property
along the south property line.

Avenue Northeast at 7:30 p.m. on 7uesday, April 15 , 1986 in regard to the

fighting purposes.

pThe house is too amall for the family at this time. Due to the odd
lot shape, it ia difficult to acaomplish ar�ything without a variaace.

The petitoner�s houae is the last house on �shton before the street
eurves to the left onto RiQe Creek �Tay. The eurb eurves to the r�est,
the Right of iiay curves to the east aauaing the es3.sting house to be
eloser than the requir�d 35 feet from the Pront lot line (approximately
11 feet) the existing house is in liae with the house to the south
(variance granted September, 1972).
The petitioner now wants to add two feet onto the front house and to do
so he has requested a variance to go from the egisting 11 Peet to 9
feet for a front yard aetback.
If the Hoard approves this request, the staff has no atipul ations to

C. ADf1INISTRATIVE STAFF REYIEW:
The petitioner's house is the l�st house on Ashton before the steeet
curves to the left onto Rice Creek l�Jay. The curb curves to the west,
the Rigi�t-of-Way curves to the ea5t causing the existing house to be
closer than tf�e required 35 feet from the front lot line (approximately
ll feet). The existing house is in line with the fiouse to the south
(variance granted September 1972).
The petitioner no�•� ��rants to add two feet onto the front of the housP
and to do so he has requested a var3ance to go from the existinq ll feet
to 9 feet for a front yard variance.
If the Qoard approves this request, the staff has no stipulations to
recommend.
Mr. Clark showed the Cornmissioners an aerial photo shnwing how the right-
of-way went one way and thc curb went another. He stated that in the agenda
was a survey depicting the same configuration.
Mr. Clark stated that as pointed.out in the Administrative Staff Report,
there was a previous variance request to build onto the house so the house
wo.uld.line up with the rest of the houses on the block. That variance was
granted. �
�'r. Clark stated also in the agenda was a letter from the neighbar to the
south, James & Karin Callanan, stating they had no objection to the variance
request.

house in order to make their living room and dininq room a little bigger
and more livable.

Mr. Kelley stated they needed the e.xtra room in the living room and dining
room area. They have a very nice deck in back, an�i they have thought about
expanding and putting a master bedroom in back soa�e day.

request, and he did not see �vhere the addition of 2 ft. would improve the
livabilit�+ of the house that greatly.
Mr. Sherek stated he did have a little d�fficulty in seeing the hardsfiip;
however, he could not see that adding 2 ft. to the front of the house would
harm the aesthetics in any way.
�4r. Betzold stated he, too, had a difficulty with the hardshi�. Ne stated
a variance was granted in 1972 to make the house in line with the houses to
the south� which was fine, but now the petitioner wants to qo 2 ft. beyond
that for convenience rather than a real need. He stated the City has been
almost.too generous in qranting variances, but the iciea is they should not
set a policy of granting a variance just because someone wants to do so►�ething
the city code doesn't allor�. He stated if the Comm�ssion recommends not to
approve this variance, then the City Council will.consider the request and
wi11 have'the final authority.
F1s. Gerou stated the kitchen was the central part of the house, and if some-
one has to move to get around a table, the►� she felt tfiat was a hardship.
The far�ily spends a lot of time in the kitchen and dining area, and if the
addition of 2 ft. helps alleviate the problem, then she would be in favor
of granting the variance. She stated that in the past, they granted a variance
on Rice Creek Road for a 22 ft. addition to a dining roam and living room for
entertaini'ng purposes.
�1r. Barna stated that, as P1r. Sherel: had pointed out, this'2 ft. addition
would not harm the aesthetics of the house, and the irtent of the law �vould
still be fulfilled; however, he still had a har� time findinq where this was
a unique s�ituation causing<a hardship.

REGARDING:.Front yard setback varience for 67I5 Ashton Ave. NE
On September 85, I972, City Council approved a front yard setback
variance for a single-family residence to be constructed on Lot I,
Block I, Edgewater Gardens Plat 2(the same being 67I5 Ashton
Ave. NE). The variance was needed because the irregularly-shaped
lot caused by a R.O.W. curve eastward across the front yard
reduced the front yard setback to eleven feet at the corner of
the house closest to the R.O.W, curve. If the R.O.W. were to be
extended on a straight line along the front of the property, a
variance would not be needed because the entire front yard setback
would be the required 35 feet.(see Location end Site Maps). The
variance was requested by the property owner, Mr. Sam Templin, so
that the house to be constructed on this site would line up with
the rest of the houses on the block. City Council avproved the
variance and a building permit was issued.
On April I5, I986, the current owner of 67I5 Ashton Ave. NE, Mr.
Gregory Kelley, petitioned the Appeals Couunission for a variance
to edd two feet to the front of the house which would further
reduce the front yard setback to nine feet. If the R.O.W. was
extended on a straight line along the front of the proverty, the
variance would actually be from 35 feet to 33 feet. Mr. Kelley
requested the varience due to the odd lot shaDe caused by the
R.O.W. curve and due to the fact that the house is too small for
his family at present. The Appeals Commission motion to approve
the variance request failed due to a tie vote (2-2).
