l acknowledge receipt of your memo dated 5-I4 �n which you ask
for lega) guidance concerning problems of cleaning up certain
undesirable situations in the city. In reply to the specific
questions, it is my opinion that:
k. Section 463•25 of the Minnesota Statutes, referred to as __
Hazardous Building Hct relates to hazardous excsvations. This
section reeds as follows:
"lf in any city, village or.borough, an excavation
for building purposes is left open for more than six �
months without proceeding witfi the erection of a
building thereon, whether or not completed, or if any
excavation or basement is not filled to grade or other-
wise protected after a building is destroyed, demolished .�
or removed, the gover�ing body may order such ex-
cavation to be filled or protected or in the alternative
that erecti9n of a building begin forthwith if the
excavetion is for building purposes. The order shall
be served upon the owner or his agent in the manner
provided by section 463.17. If the owner of the land
fails to comply with the order within fifteen days
after the order is served upon him, the governing body
shall cause the excavation to be filled to grade or
protected and the cost shall be charged against the real
estate as provided in section �63.21•"

June 15, 1968: Letter to Meadowmoor Inc. from Building Official stating the basement
foundations and footings at 7620, 7630 and 7650 Bacon constitute a hazard and to either
fill the excavations or erect a fence around them or commence with construction.
August 5, 1968: Letter to Ed Chies from Building Official asking that building permits
be taken out for 7620, 7630 and 7650 Bacon Drive as the footings and foundations are
already in, or a formal complaint will be filed and court action started.
February 7, 1969: Building permit for 7620 Bacon taken out.
February 19, 1969: Building permit for 7650 Bacon taken out.
September 2, 1970: Letter to Ed Chies from Building Official requesting owner to
clean up and maintain the property at 7630 Baeon Drive and to fill the excavation or
commence construction.
' November 19, 1970: Ed Chies calZed and said this property now belongs to another person
and this person would be building on the property shortly. However, he did not give the
name of the new owner.
December 10, 1970: Called Anoka County Auditor's Office to determine legal owner of
property. Talked to Mr. Meyer who stated that as of Aug. 25, 1964, the property belonged
to Meadowmoor Inc. Before that (from May 29, 1964) Ed Chies name appeared in connection
with a Julkowski. Assessor's records show Ed Chies as President of Meadowmoor Inc.
May 5, 1971: Letter to Ed Chies requesting him to fi11 in the basement hole.
July 19, 1971: Building Permit taken out for dwelling and garage on this lot.
October 19� 1971: Building Permit Void for nonuse. Ca11ed G& M Construction and they

we had discussed prR,iously, the testing capabi];iti,�; and procedures used

ampare it against a Stabe tase to evaluate t�e results obtained.
On a few occasions, we have foimd certain volatile organic ehenicals (VOC)
wi�in samgles taken fran two of our weils (Weils #8 and #9), gese wells
are located within our major well field in Cq�pns park, In yarch of last
y�r, the s�aples did not shaa any evidence of VOC'& �is Fast May, they
again tested positive but were well within the acceptable levels
estahtished L� the State Department of 8ealth. Rhe City and the State of
1'�innesota Department of Health oontinues to monitor all of our water
sources.
�e City operates a total at thirteen �deryro�md wells fran �ree primary
aquifers. Rhe wells are rw on an aiterr�atinq 6asis 6ased upon demand and
5��� �eage' Ail °f the water P�nPea 1s oombined into one system and
then distributed throughout the City. 7his procedure allows dillution of
�' �etrimental aftects s� as haz�hess, iron, and manganese and insures
the maintenanoe af a qu3lity and safe potahle produc�.
The Federal Environmental Protection Aqency has not regulate8
trichlorcethylene (T�}, Acaordinglp, t�ere is no maxim� contamznation
level for this chenicai. �e State of i�tinnesota Department of Heaith has
estahiished a safe peri�ter regarding TCE at 31.2 part� per billion. �is
level is o�nsiderablp above a�, det�i� q�ntities we have identftied fn
Wells #8 or #9.
As indicated in the Water R�st Report, � was iaentiYied at the minimian
�7etect1°n levei °E �e 1�r$�Y e4uipnent. Assuaing the procedure is
vazified, this result is also well belaw any esta4lished limit le✓eis.

SUBJECT: Yolatite Orvanic Chemical Analyses, Hells Nos. 8 and 9, Fridley
Based upon the results of the volatile organic chemical (YOC) analyses per-
formed on Mells Nos. 8 and 9 which indicated that none of the YOCs were de-
tected, we would recomnend that the City discontinue sampling of the wells.
This Department will continue to test Me11s Nos. 8 and 9 for VOCs as part
of our annual sanitary survey of your water system.

SIISJECT: Letter from James J. Bauer
I have prepared a response to Mr. Bauer regarding the water
quality, copy attached.
when the water sample was taken, representatives from our Water
Department as well as Minnesota Valley Testing went to Mr. Bauer's
neighbor at 7639 Bacon Drive because they were not able to obtain
an access to Mr. Bauer's residence. While the sample was taken,
there was conversation between the resident, our employee and the
Minnesota Valley Testing technician. I'm not sure, nor does our
employee, recollect exactly what was stated during that time.
Mr. Bauer came to the Council and specifically indicated that he
was concerned about TCE in the water as he was recovering from
cancer as well as one of his neiqhbors spoke indicating that he was
also recovering from cancer and as one of his associates spoke that
she was concerned with cancer for her children. Therefore, I
cannot decipher exactly what Mr. Bauer is stating in his letter
regarding �'blaming the City water for my personal cancer". It is
my understanding that there were no particular statements made
directed at Mr. Bauer other than the fact that samples were being
taken to determine if there was discrepancy in the water quality
in his location in relationship to that which is distributed
throughout the City.
As you may recall, this test was suggested by our Councilperson as
a means of having the information in our files.

Dear Mr. Bauer:

As a result of your presentation to the City Council regarding the
water quality within the City of Fridley, we attempted to evaluate
the water sample in the vicinity of your residence as a means of
identifying any differences between the water produced by the water
filtration plant and that provided the user.
During the last test that the City took of its water product on
December 6, 1989, we attempted to take a sample from your residence
but were unable to and, therefore, obtained a sample from your
neighbor at 7639 Bacon Drive. A copy of the results are attached.
You may note that the effluent from the water plant and the product
at your neighbor's did not identify any elements in the water
except for Bromodichloromethane at your neighbor's faucet.
In your letter of Decenber 29, 1989, you indicated that you are
continuing to have a study of our water system, I would be
interested in receiving a copy of your information as a means of
naintaining docunentation of our water product.
If I can provide you any additional information, please feel free
to contact me.
