will meet in the Council Chamber of the City Hall at 7:30 P.M. on Wednesday, October

A request for a variance of Section 45.16,
paragraph 4, Fridley City Code, to reduce
the minimum footage requirement between

t 2. The Railroad work out the traffic pattern to East River Road with the County
and also with Columbia Heights and Minneapolis.
3. Coordina�e with the City and County on the lighting.
4. The Railroad should control any excess of dust (by wa.tering if necessary),
blasting and noise to minimize the adverse effect on the surrounding
neighborhood.
5. Sound deadening on the retarders be resolved before starting construction.
The Board also suggested that the Railroad and theix contractor evaluate the
structures in the area prior to construction so any charges of damage because
of blasting wi11 be easier to detect.
The Baailding Inspector suggested a seismograph be used at all times to check
vibrations from the blasting.
Seconded by 0'Banaon. Upon a voice vote, Ahonen voting nay, the motion passed.

Mr. Don Nelson, owner and Mr. John Polymeros, representing Sussel Company were
present to present the request.
Mr. Polymeros explained the existing house is facing Bacon Drive and the garage
will be 20 feet by 26 feet, attached onto the North side of the dwelling.
Mr. Nelson said there are other houses on the street with the same type of
garage. He explained he couldn't build a single garage and stay within the
code requirements, and to build the garage in the back yard would make the exit
on Osborne Road.
Mr. Nelson brought with him a letter signed by ten (10) families within 200
feet of his property. The letter stated that there were no objections to the
garage being setback 8 feet instead of 17 feet, 6 inches from the side street.
MOTION by 0'Bannon to close the public hearing.
Seconded by Harris. Upon a voice vote, there being no nays, the motion carried
unanimously.
MOTION by Ahonen to approve the request for the following reasons:
1. There were no objections from neighbors within 200 feet.
2. There is a hardship caused by the particular layout of the building on the
lot and the alternate plans would most necessarily mean exiting onto Osborne
Road which would create a tra£fic hazard.

He informed the Bo rd that he had applied for, a was granted, the same requests
in 1965. He did no realize that when this was granted in 1965 that it would
expire if he did not tart constructioa.
Chairman Mittelstadt we over the City Co cil Minutes of April 1965, that
concerned this property. e explained to r. Berry that the City Codes have
changed since 1965 and som of ehe stip ations the Council stated then were
no longer correct. This wou d concern he enclosed parking stalls and also off
street parking. Also, it wou be ne essary to dedicate more land at the
Northeast corner of the interse tion of Hickory Drive and East River Road.
Mr. Berry answered that this woul be worked out with the Engineering aad Inspectioa
Departments. He stated the lot 0 feet by 75 feet with 15,750 square feet
which is more than the minimum ot ar a requirement. There was no current survey
available to check these figur s.
Mr. Harris asked Mr. Berry i he could ge a plot plan of the corner, showing the
land to be dedicated for th corner, which 11 be decided by the Engineering
Department.
Mr. Berry said he would �et one dr�.wn up.
MOTION by Harris to ta�le the two requests until�the December 10, 1969 meeting,
and in the meantime, �t.�he applicant should: �
1. Get a plot plan/showing finished corner.
2. See the City�ttorney and get the papers drawn up i�{or the dedication of
land at the ntersection of Hickory and East River �oad.
3. Bring in a�1 elevation of the proposed dwelling so the �oard can see what

�he'City Engineer said that he wanted to bring this item to the attention of
:�the Council. This garage wouTd only be about 7� feet from the right of way
��tif Osborne Road and if there were sidewalks put in, the sidewalk would be
adjacent to the garage. The abutting property owners have agreed and the
Board felt that this was justified because the�alternative would be to enter
onto Osborne Road which would create a traffic hazard. Counci]man Sheridan
..felt that this would not be a good visual safety factor having the garage so
close to.the xoad. �

Meeting and ask the applicant to come before the Council to consider other
