SECTION 2. The Inspector of Buildings shall, before issuing permits for the
erection of any building or structure, or for aay addition to any existing
building or atructure, or for any alteration or repairs to any existing
building or structure, upon application therefore, require the payment by the
applicant for such permit of fees to the amount herein below set forth and in
the manner herein pravided to-wit:
UNIFORM BUILDING CODE: Type 1, 2� 4-$2.15 for each one thousaad cubic
feet, or fxaction thereof, in such cubical conteats. �ipe 3� 5-$1.85 for
each one thousand cubic feet.
ADDITIONAL INFORMATION
For the purpose of computiag fees for building pesYnits, the cubical conCents
of any building or addition, is determined by multiplying the ground area
covered from a point six (6) inches below the floor line of the basement .
or the cellar to the average heights of the upper surface or to the avezage�
height of the roof surface of the main gable of a pitched roof.
For repairs or alterations to an existing atructure, the fee shall be at the
rate of $3.00 per each five hundred dollars ($500.00) or fraction thereof in
the coat of all proposed work.
In ao case ahall the fee charged for any permit as set forth in Section 2 be
lesa than $5.00.
V�RIFICATION OF FOUNDATION
NOTE: Pexmits for construction will be issued a miaimum of 24 hours from the
time of applicatioa, to a11ow for proper review of the pxoposed structuxe and
of the coastruction site.
A Certified Survey cf the lot,.etiow3.ng the location of the fouudation, once it
hae been coastructed, will be required before,proceediag with the framing.
CERTIFICATE,.OF OCCUPANCY
Application for a Certificate of Occupancy-shall be made tea (10) days priox
to the uae or occupancy qf eay etructure for which a building permit has beea
issued; and said structure shall not be used or occup�ed until a Certificate
of OccupanCy has been isaued. •

Please be advised that Mr. vanDan experienced a backup in December. At that time it
was determined that the problem was within the resident's sewer service line.
Comments made to Bab Barnette however indi�ated the resident felt that there was a
problem iaith the main in the street.
Please investigate and perhaps this service would need to be added to our
replacement schedule.

I have contacted Mr. Van aan and he has indicated that he had a sewer service
company out to clean his sewer line. He relayed the message of the company--.
they told him that the line is probably cracked in the street, or there is a
mis-alignment.
At th2 present. time, his sewer line is open. We have no records of any pro-
blems with this line for the past two years. Rusty recollects that possibly
three years ago, he was called out on a backup.
I informed Mr. Van dan to call us the next time he has a backup problem, and
we will come out to determine what the problem is. He does have a sump pump
• in his basement that pumps the sewage into the street. From the physical
appearance of his yard, with no tre�s such as elms, it would indicate there
are no root problems.
Until he has another sewer problem, we can do nothing.

I am petitioning the Council to assume the costs of filing fee
for a lot split as well as the costs of surveying the property ow�ed in
fee simple as a freehold in joint tenancy with my spouse.
The r.eason I am asking the City to assume these costs is, that
through negligent non-feasance on the part c�� the City our property
title now is inchoate, clouded, so-to-speak.
Our freehold is located at 6342 Baker Avenue, N.E., in the
Auditor's Third Addition to Moore Lake Highlands, and, when we acquired
it in early 1957, it consisted of a framehouse with an att�hed garage.
Our southerly abutting neighbor, at 6314 Baker Avenue, N.E., owned by
Gerald R. and Helen Machowicz, at that time comprised a similar frame
structure, but withQUt any garage whatsoever. Gerald Machowicz, sometime
between 1959 and 1965 built an attached garage, which a subsequ�nt survey
showed, at one point had its northeasterly eave overhanging our property
line in excess of one foot. The City tells us that there is �on file no
record• of a building permit or subsequent inspection,
It is, and has been incumbent on the City to enforce the issuance
and approval of building permits, and, specifically in such a c�se ensure
that such. oversights do not happen. But it did happen, and Nlr. Machowicz
did not act in bad faith, therefore I opined that the fairest resolution
would be a l�o�-split whereby no moneys or exorbitant pricing nor compens-
ation were to be involved; but as I was and am the absolute innocent byst-
ander in this Ease, and I am the one who suffered a beclouded property
title, having nei�her gained a garage, or committed non-feasance or any act
of negTige�ce, I cannot see c�hy I should spend good money to have a survey
performed,, o.r. pay a filing fee for the lot-split, to which the City other-
wise would be perfectly in its r�.ghts to be entitled.

liability. Ae stated the placing of a house on a lot is the responsiblity

a Froblen with the Q�Lmcil waiving the fee for the lot split, but shouldn't
�ay the aost for the survey. He felt if Mr. van Dan's neighbor made the
mistake, the a�st for the survey w�ould be very reasonable for rectifying the

Over the past few days I have reoeived several tiele�orre calls fran Ntr. Francis van
Dan in regarc3 to a letter he red.eveol frc�n R3.chard Wierena related to a vehicle or
vehicles storeol on his �operty without �oper lioen�ee plates. N1r, van D�an wishes
to address the Coimcil on Marcfi 9 during the open forian peria�. He wishes to make
three points:
1. He feels that proaeclures usec] by our Inspection Degartment, totally
apart from any personalities invol�ed, involve a violation of
aonstitutional �ue procsess. I beli�ve what he is referring to is that in
order to verify a oomplaint about improper licensings it m3ght be
rea�s�ary for the inspector to aome on to private property without the
a�vner�s penmission. He alluc�eol to the case of a r�ighbor wl�se �lioensed
car was not riotioed because it was in a c7epressed area where it �uld not
be seen frcan the stree� I believe he feels that our inspector hac7 to
a�me on to his property to verify the c�mplaint about the �1 icensed
autanobil e.
2. Mr. van Dan feels that the ordimnoe is flawed. If the purpose of the
ordinanoe is to renave �msic�tly vehicles, thi s is not ac�mpl ishec7 by
forcing the owner to have a proper liscense plate. The vehicle is
�ually tmsightly with the proper lioense plate as without it, and the
aaner has to pay for a license plate for a vehicle which he has no
iritention of using at the p�es�erit time. Zhe result is that the awr�r has
grea�t�er expense and there is no imprwsnent of the total envirorane,nt.
3. l�e also wishes to diswss the nui�nve aspect of repeatecl wmplaints.
He feels that at times citizens use, or more properly, abuse the
orcli.nanae by making repeated complairits which involve the expenditure of
City monies. He feels that in the case of abuse of an ordinance, the
people making the nuisanoe charge shoulcl be charged a user fee for the
time and effort of 'the City employees who have to follaw up on the
�har�.

he felt that he might have to wait too long before

It is my understanding that as long as a private property owner has a
c�riv�aay and/or sidewalk leac:ing up to his rESidenoe, a person can come anto
the firoperty unless othen�i:� notifiec. by the property awner. Sinc:E there
was r,o vertal or written notification from r,r. var_ Dan to �tay off of his
property, the vehicle lioense of the Fiat was ob�ained fram the drivc�asy.

F�rst, Mr. van Dan would like to see the City Cotaicil acbpt an ordinanoe that
assesses a fee to those who oontact the City to make a oomplaint. I feel
that aside fram possi4le First Amenchnent violations, assessing a fee for
complaints would hinder the City's attempt to make this a better, more
gleasant aommunity. If assessed a fee, fewer citizens would report nuisanoes
and unhealthy, unsafe aonditions. At a time when the City is trying to
imprave its image, adoption of this reac�nsnerxiation could be detrimental to
that efforti
Seaondly, Mr. van Dan feels that the property awner should be contacted
before an inspection is oondueted. �en though I have been performing code
enforceme�t duties for only about a month mw. I belie+ve that there are not
enou� hours in one day to implenent this recommendation While there are
sbme instanoes where a�nversation with �e property owner is nevessary, it
is not neaessary in eveiy instarx�.
In su�uaary, both of Mr. van Dan's proposed changes in City policy would make
an al ready dif f icul t j ob even more dif f icul t. If the Ci ty is ser iously
aonsidering one or both of these changes, I would strongly reoamner�d that the
h�ing of jtuik cars be maved to the �blice Department's Community Service
Offioers, as reao�mnended by Ric Wiersna in a meno dated February 20, 1987.

On Monday, Navenber 23, 1987, I received a�hone call from Mr. Frank Van Dan
regarding a sanitary s�ewer c�ll he had made on Tuesday, Navenber 17, 1987.
Mr. Uan Dan indicated he had called the Public Works office indicating a
passible backup in the City line on Bacon Street. When his call was
re�aeived, the S�aer Forenan was in the offive and immediately radioed to our
Sewer N�n to check the streets main line. �e Sewer Man was just around the

7here is a tendency in using the sewer jett8r for it to cause a vaccuum in
the line whidz in some cases will cl�r mir�or obstructions in the laterals as
it �sses throuc�}i the line. �his may have occurred.
Mr. Van Dan has ralled Co�cilman Schneider and Bill H�t fran the City staff
indicating his concern about the rapid response t3�at he had reoeived plus the
followup action on the lirie. While it may appear exceptional, it illustrates
the Sewer De�xirtment's responsive.ness and voncern to inquiries made of our

BUILDING PERNIIT FEE SCHEDULE
The Chief Building Official shall, before issuing permits for the erection of any building or
structure, or for any addition to any existing building or structure, or for any alteration or repair
to any existing building or structure, upon application therefore, require the payment by the
applicant for such permit of fees to the amount herein below set forth and in the manner herein
provided to-wit:
VERIFICATION OF FOUNDATION
Permits for constcuction will be issued a minimum of 24 hours from the time of applica.tion to
allow for proper review of proposed structure and of the construction site.
