Effective September 12, 1986
At the request of our customer, L.W. Samuelson Construction, Inc., we
hereby authorize you to draw on us, on demand, from time to time, up to an
aggregate amount of FIVE THOUSAND AND NO/100's ($5,000.00) by your sight
drafts presented on us not later than September 12, 1987.
The purpose of this letter of credit is to assure completion of outside
improvements including landscaping, irrigation, curbing, blacktopping,
f encing and storm drainage system as set out in the approved site plan
regarding the building at 7345 Baker Street. All drafts under this letter
of credit must be endorsed hereon, and bear the clause "Drawn under
Norwest Bank Midland, National Association Letter of Credit Number LC-3613
dated September 12, 1986." Any portion of the Letter of Credit which has
not been released by the City of Fridley will be paid by us against a
certificate from said City under the signature of the City Manager stating
that the improvements have not been made and you have given L.W. Samuelson
Construction, Inc. written notice of demand for payment at least thirty
(30) days prior to the submission of the draft, and that the City is
entitled to the unreleased portion of this Letter of Credit to be used to
complete the above mentioned outside improvements.
This Letter of Credit is irrevocable and we hereby agree with you that
each such draft shall be duly honored by us in accordance with the pre-
vious paragraph upon presentation to us at our bank house. Norwest Bank
Midland, National Association, has no obligation or right to (1) inquire
into the correctness of any such herein described letter certification or
(2) see to the proper application or use by said City of any payments by
the bank to it under any such letter certification.
Notwithstanding any other provision of this Letter of Credit, we may at
our sole option pay you at any time the remaining principal balance
available for draw under this Letter of Credit without complying with the
requirements herein contained for a draw under this i.etter of credit, and
upon our payment to you of the remaining principal balance available for
draw under this Letter of Credit, this Letter of Credit shall terminate.
