This is an extension of an existing condition in that the existing structure is loc�ted ten (10) feet frcm the south side yard property line and since the proposeci addition wiil be an extension of the existing structure, a variance needs to be requested to extend that ten (10) foot side yard setback along the distanae of the proposed addition; and (2) reduction of the setb�ack required between industrial districts and residential districts fran fifty (50) feet to forty-eight (48) feet. PUBLIC PURPOSE SERVED BY REQUIREMENT: Section 205.17.3, D, 4(d) requires that whenever any industrial district is adjacent to or adjoins any other district, permitted buildinc►s and uses, shall not be closer to the boundary line of a residential district than fifty (50) feet. Public purpose served by this requirement is to provide for adequate open space around commercial structures for aesthetic and development reasons. 6. STATED HARDSNIP: "Additional building space is necessary to accorsmodate the `machine layout within the building'.° C. ADP1IP�ISTRATIVF STAFF REVIEW: The petitioner is requesting variances for: (1) reduction of �he side yard setback from fifieen (lb) feet to ten (10) feet. This is an extension of an existing condition in that the existing structure is located ten (10) feet from the south side yard property line and since the proposed addition will be an extension of the existing structure, a variance needs to be requested to extend that ten (10) foot side yard setback along the distan�e of the pr�posed addition; and (2) reduction of the setbaGk req��red betwee� industrial distrac�s and residential d�s�ricts f'r�m tifty (5�� feet ta forty-eight �48� feei. While a two (2� foe�t �rariar�ce in this instance is by �o me��s extreme, "buffer zones'° such as this one were designed to prom�te the health, safety, and welfare of the public. APPEALS COt1MISSION MEETIPJG, JULY 15, 1986 PAGE 8 Mr. Clark stated the petitioner has been working with the City on reland- scaping and upgrading the parking lot. Mr. Samuelson showed pictures of the existing facility which showed the landscaping Mr. & Mrs. Lynch (owners of the property) preferred to reiain and re7ocate. Mr. Samue7son stated the building was built about 20 years ago, and the owner was in dire need of additional f]oor space. Because of the sheer tightness of laying out the equipment inside the building, it was necessary to request the setback reduction from 50 ft. to 48 ft. Mr. Samueison stated that once the addition was completed, the owner planned to substantially upgrade the existing building. In compliance with all the other codes, the parking lot would be completely redone along with concrete curbs and gutters. They do meet all the parking requirements. They are providing a berm as required by the City, and the rear yard would be cleaned up. Mr. Samue7son stated he fe7t the City now had the opportunity to give the Lynches the opportunity to stay within Fridley with their manufacturinq business and to enhance the property with the improvements. Mr. Sarna asked Mr. Lynch to explain his hardship. Mr. Lynch stated the machines they will be installing are quite long. The raw material is a 12 ft, long bar, so the length of the building was very important. They do not want a cramped space. He stated that for safety reasons and for ease of loading and unloading the raw material and finished �arts and semi-finished parts to the next machine, it was necessary to main- ain a straight line and therefore it was �necessary to have the two foot variance for additional building space. Mr. Lynsh stated they are trying to upgrade the existing building and move the larger machines to the back side so they will have a better acoustical level. This will help them with their noise level as they are now at a 86 decibel 7eve1. They will also be bringing all the outside waste barrels inside so they need room for storage. Mr. Barna stated he wanted to mention for the record that the .existing struc- ture to the south presently encroached quite a bit more into the 50 ft. distance than the 48 ft. being requested by the petitioner. Mr. Sherek stated he would concur wiih the sideyard setback. Ne did not see any proof presented by the petitioner of why the two foot extra was goinq to make that big a difference. He would like the petitioner to present a little more proof to the City Council. He did have to trust that since the Petitioner had gone to a lot of work to lay the building out the way he had and that he had done it in the most efficient and safest way, there must be a good reason for the two extra feet. He stated he would be in favor of granting the variance requests. Mr. Barna stated that from almost 30 years of experience in machine shops, he could understand the need for a building Tay-out tfiat accomnodated machines in the safest and most efficient way, He had no objection to the side yard setback which was an extension of the existing variance or the two foot rear yard reduction as the building would not encroach into the residential buffer zone.
