For the purpose of computing fees ior building permits, the cubical contents of any
build9.ng or addition, is determined by multiplying the ground area covered from a
point six (6) inches below the floor line of the basement or th� cellar to the
average heights of the upper surface or to the average height of the roof suri-ace
af the main gable of a pitched roof.
For repairs or alterations to an existi.ng.stxucture, the fee shall be at the rate
of $3.00 per each five hundred dollars-($500.00) or fraction thereof in the cost
, of all proposed work.
Tn•no case shall the fee charged for any permit as set forth in Section 2 be less
than $7.50 pZus $.50 state surcharge. � �

NOTE: P�rmits for construction will be issued a minimLUn of 24 hours from the time
of application to allovr for proper review of the proposed structure and of the
construction site.
A Certificate of Survey of the lot, sliowing the location of the foundation once it

SUBJECT: Easemen� Encroachment Request by
Brickn�r Construction Company
Attached is a drainage easement encroachment approval request by
Brickner Construction Company for the residence at 6249 Ben More
Drive.
As yau can see on the attached Certificates of Surveys, Comstack
and Davis indicated a five (5} foot easement on the preliminary
survey, and a six (6) foot (actua�) on the verificatiorr survey.
The Engineering Division has checked out this �request and can see
no problem in appraving the encroachmenta There remains adequate
space in the remaining easement to provide proper drainage.
The uti�ity campanies need nat be notified, as the easement in
questian is not for utility purposes.
I request that the City Counci� consider this request at the regu-
lar meeting of October 1, 1979, and recor�m�nd approval.

Mayor Nee stated the petitioner has made a request that this item be tabled
to the Council meeting on October 22, 1979.
MOTION by Councilman Barnette io table this item to the meeting of October 22,
1979. Seconded by Councilman Fitzpatrick. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.
NEW BUSINESS:
ORDINANCE N0. 702 ADOPTING THE BUDGET FOR THE FISCAL YEAR 1980:
MOTION by Councilman Fitzpatrick to waive the second reading of Ordinance No. 702
and adopt it on the second reading and publish. Seconded by Councilman Schneider.
Upon a voice vote, all voting aye, Mayor Nee declared the motion carried unani-
mously. �
CONSIDERATION OF A REQUEST TO BUILD A STEEL BUILDING GARAGE FOR AN EXISTING
HOUSE AT 7748 ELM STREET IN A NON-CONFORMING INDUSTRIAL AREA:
Mr. Qureshi, City Manager, stated this is a request to build a garage at 7748
Elm Street and the property is a non-conforming use and expansion of a non-
conforming use is prohibited.
Mr. Anderson, the applicant, appeared befare the Council regarding his requesi.
He stated he is in need of a garage which would be 30 x 32 feet and of steel
construction so it could be taken down. He stated he has been waiting 25
years for someone to buy him out, but it hasn't happened and that he needs
this garage for greasing his vehicles.
�' Mr. Herrick, City Attorney, stated the property is zoned industrial and if a
new structure or enlargement is to be placed for residential purposes that is
� expanding a non,conforming use as, he understands, the property is not sufficient
in size to qualify for an industrial lwilding.

Mr. Anderson stated he had the property zoned industrial, but didn't be1ieve
he couldn't put up a garage.
Councilwoman Moses pointed out in other industrial areas, fencing is required
for items that are stored and in Mr. Anderson's case, all his trucks are out
in the open.
Councilman Barnette stated Mr. Ar�derson has the situation where there is a
home site in an industrial area and is requesting approval to put up a structure
in order to do some work on his trucks. He questioned why this couldn't be done.
Mr. Herrick, City Attorney, stated the property is not properly zoned to expand
for residential purposes and is not large enough for industrial purposes. He
felt the only possibility Council could consider was if they treated the garage
as an industrial building and then variances would have to be granted. Mr.
Herrick suggested this item be tabled to the next meeting in order to review
the matter further.
MOTION by Councilwoman Moses to table this item to the next meeting on October
15, 1979. Seconded by Councilman Barnette. Upon a voice vote, all voting aye,
Mayor Nee declared the motion carried unanimously.

OCTOBER 1, 1979 �
The Regular Meeting of the Fridley City Council was called to or�der at
7:3Q p.m. by Mayor Nee.
PLEDGE OF ALLEGIANCE:
Mayor Nee led the Council and audience in the Pledge of Allegiance to
the Flag.
ROLL CALL:
MEMBERS PRESENT: Councilman Barnette, Councilman Schneider, Mayor
Nee, Councilwoman Moses and Councilman Fitzpatrick

APPROVAL OF MINUTES:
PUBLIC HEARING MEETING, SEPTEMBER 17 1979
MOTION by Councilwoman Moses to approve the minutes as presented. Seconded
by Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor Nee
declared the motion carried unanimously.
REGULAR MEETING, SEPTEMBER 24, 1979
MOTION by Councilman Schneider to table this item until the next meeting
in order that the Council may have the opportunity to review these minutes.

OPEN FORUM, VISITORS:
Ms. Lee Ann Sporre appeared before the Council regarding a meeting on the
subject of the airport and Highway 10 on Wednesday, October 17, 1979, at
the Northtown Center Community Room at 7 p.m. She urged the Council mem-
bers to pass the word around about this meeting, as she felt it was vital
to the public interest. Ms. Sporre distributed a copy of an article which
appeared in the Minneapolis Tribune on t�1erch 5, 1968, entitled "Anoka
County Airport Urged as Major Facility". She requested the Council to re-
ceive this into the record as the article contained a map which showed the
existing site of the Anoka County Airport and the proposed expansion area.
Councilman Schneider asked if there have been any more official meetings
regarding the airport.
Mr. Qureshi, City Manager, stated if staff receives any such information,
it would be passed on to the Council.
OLD BUSINESS:
ORDINANCE N0. 701 AMENDING CHAPTER 405 ENTITLED CABLE TELEVISION FRANCHISE.
MOTION by Councilman Fitzpatrick to waive the second reading of Ordinance
No. 701 and adopt it on the second reading and publish. Seconded by
Councilman Schneider.
Councilman Schneider noted that this ordinance does not contain the two
additional amendments proposed by the cable television company. Mayor Nee
stated that he felt these two proposals should be processed through the
Cable Television Commission.
UPO N A VOICE VOTE TAKEN ON THE ABOVE MOTION, all voted aye, and Mayor Nee
declared the motion carried unanimously.
