Consideration of a variance request, VAR #87-09, by Brian
Westover, pursuant to Chapter 205.07.1, B, 3, of the Fridley
City Code, to increase the maximtun allowable height of a
garage fran 14 feet to 20 feet on Lot 3, Block 1, Heather
Hills Addition, the same being 6274 Ben More Drive N. E. ,
Fridley. Minnesota, 55432.

Construction of a garage on the property is complicated by the severe slope of
the lot and the adjacent roadway (Kerry Lane). The garage must provide level
access from the street to allow for access during the winter months. The
garage must also provide for convenient accesa from the house. We propose a
garage plan which meets both these requirements, however, it requires a garage
which is 18-ZO feet high. The maximum height of a detached garage in Fridley
is 14' and thus we require a variance.
S treet level access to the garage for autos is necessary to provide for access
during the winter months. If the garage ia not built into the hillside on our
property, accesa to it could be severely limited during the winter. The impact
of improper placement of a garage was demonstrated at a new co�atruction site
several houses away from ours. Af ter one �inter in their newly constructed
house, the owners razed their elevated, attached garage and excavated a new
tuck under garage closer to the atreet level. We have learned from this
example and will build near the street level.
By excavating and buildiag the garage into the hill we can provide street
level access to the garage. If we also limit the height of the garage to the
14 feet specified in the code we would be unable to provfde a aervice entrance
to the garage (for foot traffic) on either of the two walls closest to the
house. In this situation, after parking in the garage the driver would have
to walk, carrying groceries, packages, babies and other items approximately
60-75 feet and up an exposed flight of stairs to the house. This is certainly
a hardship in M�.nnesota winters and will reduce the resale value of the house.
If the height of the garage is limited to 14' the roof of the garage would be
one or two feet above the ground level on the uphill side of the garage. This
would allow access to the roof top from the ground and would be an extremely
unsafe condition.
To remedy the situation we propose to slightly raise the garage roof in order
to provide a ground level entrance on the vall closest to the house. Ia this
design, rather than a trek of 75 feet, up hill, from the garage to the house,
we have a walk, over level terrain, of 25 feet from the garage to the house.
Furthermore, the roof would be a safe distance above the ground, preventing
access to the roof by small children in the neighborhood.
The resulting structure would be 18-20 feet high. The proposed design is
shown in the accompanying figures. The placement of the garage, relative to
the house and the property line is shown in Figure 1. A perspective view of
the house and garage is shown in Figure 2. The shaded areas represent the
ground level. Note how the ground is only about 1' below the top of the first
floor of the garage. A roof placed directly on top of this structure would be
almost at ground level. Also note that a service entrance would have to be
placed on the wall which is not below grade, the wall directly apposite the
house. Our proposed design is shown in Figure 3. One side of the garage has
been raised to provide access to the house and eliminate the unsafe roof line.
We have contacted several neighbors, including our next door neighbor and
discussed the plans with them. All have approved our proposed projec �

purchased before the code change, and it did not pear there would be any
probler� as far as any obstruction�for fire-fig ing purposes.

econonic hardship on the part of the o er of the property, and that was his
reason for splitting the property. ere was adequate room for fire-fighting
purposes, and he would have no o ection to the variance.

'°Construction of a garage on the property is cor�plicated by the severe
slope of the lot and the adjacent roadway (Kerry Lane). The garage
r�ust provide level access from ti�e street to allo�r for access durinc� the
winter months. The garage must also provide for convenient access from
the house. tJe propose a garage plan which meets both these requirements,
I�owever, it requires a garage which is 13-20 feet high. The r�axinum
height of a detached garage in Fridley is 14 ft. and thus we require a
vari aroce.
Street level access to the garage for autos is necessary to provide for
access during the winter nonths. If the garage is not built into the
� hillside on our property, access to it could be severely limited durinq
'� the winter. The impact of inproper placement was der�onstrated at a new
construction site several houses away from ours. After one r�inter in
th�ir ne►•�ly constructed house, the ovrners razed their e7evated, attached
garage and excavated a new tuck-under garage closer to the street level.
We have learned fror� this exar.�ple and ►�i11 build near tl�e street level.
By excavating and building the garage into the hill we can provide street
level access to the garage. If we also linit the height of the garage
to the 14 feet specified in the code, we ��ould be unable to provide a
service entrance to the garage (for foot traffic) on either of the two
wa1Ts closest to the house. In this situation, after parkinc� in the
garage, the driver would have to walk, carrying groceries, packages,
babi es, and other i terr� approxir�ately 60-75 feet and up an exposed fl i ght
of stairs to the house. 'This is certainly a hardship in tlinnesota and
will reduce the resale value of the house.
If the heigl�t of the garage is limited to 14 ft. the roof of the garage
ti�rould be one or tti�o feet above the ground level on the uphill side of the
garage. This would allow access to the roof top from the ground and would
be-an extremely unsafe condition.
To remedy the situation, we propose to slightly raise the garage roof in
�order to provide a ground level entrance on the wall closest to the house.
In this design, rather than a trek of 75 feet, up hill, from the garage
to the house,r�e have a walk, over level terrain, of 25 feet_�fror� the
�arage to the house. Furtherr�ore, the roof would be a safe distance above
the ground, preventing access to the roof by small children in the
neighborhood.

sent the ground level. tJote ho�v the ground is only about 1 ft, below the
top of the first floor of the garage. A roof placed directly on top of
this structure ���ould be almost at ground level. Also note that a service
entrance would have to be placed on the a�all which is not below grade,
the wall directly opposite�the house. Our proposed design is sho►•m in
Fi�ur� 3. One side r,f the garage has been raised to provide access to the
house and eliminate the unsafe roof line.
tJe have contacted se�eral neighbors, including our next door neighbor,
and discussed tiie plans ti•�ith them. All have approved our proposed project."
C. ADPII�JISTRATIVE STAFF REVIEW:
This praposed garage is to be constructed on a very steep slope. Tf�ere-
fore, tl�e front and nortti ►�a11 are allowed to be 20 ft. from the floor
to the roof ridge.
This location appears to be the only logical location on the lot. He
presently has no off-street parking.
If ti-ie Appeals Comr.�ission approves the request, the staff has no stipu-
lations to suggest.
Mr. Clark showed an overall map shor�ing the location of the petitioner's
�r�aerty. Ne stated this is one of tlie few lots in Fridley that does not have
a drive►tiay or a garage. He stated the location of the garage as proposed by'
the petitioner was tlie most logical location for a g3rage on this lot.
h1r. Clark stated the petitioner needed the variance because unless the
petitione.r builds an underground garage, a garage will not fit on the lot.
He stated this was a unique lot dnd a unique situation.
Mr. Clark stated the petitioner had done a very nice job in preparing the
hardship statement. It gave the Cor�r�issioners a good picture of what he v�as
proposing.
Mr. Brian lJestover stated the house was bui�lt in 1941. The builder of the
house �vanted to put a garage on the lot next to the house, but over the years
pi ec�s of property ►�ere sol d off, and they ►vere left ��i th the present l ot.
He again described the location of the proposed garage and the design of the
garag�. •
�1s. Carol Dwyer, 6282 Kerry Lane, stated she was the neighbor to.the north. �
Ner hor�e was built within the last year. She stated �4r. Westover had presented �
the plans to her sor�etime ago. She basically had no problem with the garage as
zt was proposed. She stated the Westovers have a high lz story dorr�ered roof ��
an�i belo� ther� she had a very high peaked roof. Actually, putting the second

story onto the south half of the garage would probably conform better to the
two.houses than if he built a one-story garage r�ith a very flat roof.
Aesthetically, what 14r.Westover intended to do looked better.

Mr. Barna commended the petitioners on a very tvell stated hardsliip. The
petitioner would definitely be bringing the house, even with the variance,
closer to code compliance than it has been since the new code a�as established.
Ms. Savage stated she agreed. In looking at the property, she noted the
public purpose was to maintain aesthetically pleasing comr�unity, anci it seened
to her that this garage as planned would certainly do that. She would be in
favor of granting the variance.
Mr. Sherek stated he agreed with Ms. Savage. The garage v�as definitely well
designed. He, too, wanted to campliment the petitioner on the preparation he
<� did in preparing the stated hardship description. Most hardship descriptions
��==� . are very sketchy, and many times the Corrmissioners are not even sure a
petitioner has a hardship.
Dr, Vos stated this vras a very creative solution. He had driven by the
property many tir�es and never realized there was no garage. The way the
garage was designed and the location into the hill would really look nice.
