Ms.�McPherson stated that this property is located on Benjamin
Street, just south of 62nd Avenue. The property is zoned R-1,
Single Family Dwelling, as are all adjacent properties.

Ms. McPherson stated the petitioner is proposing to add,a second
story addition to a storage addition to the attached garage. This
storage addition currently has a flat roof, and the flat roof has
begun to leak. The petitioner would like to reconstruct the roof
of the addition and, at the same time, proposes to add a second
story to the storaga area.
Ms. McPherson stated the first variance request to reduce the side
yard setback from 10 feet to 5 feet would pertain only if the
proposed addition was to be used for living area. The petitioner
has stated that this addition will be used strictly for storage;
th�refore, the side yard setback variance is not necessary.
However, if the Commission approves the variance request, the
Commission should include a stipulation that if either the
petitioner or any future owner wishes to convert this storage area
into living area, he/she must apply for and receive a variance from
the City to reduce�the side yard setl�ack from 10 feet to 5 feet.

Ms.. McPherson stated the Commission only needs to address the •
second variance request to increase the height of an.accessory
structure from 14 feet to.l9 feet. She stated it is possible for
the petitioner to reconstruct the roof of the storage addition
without adding�additional height to the addition, or the petitioner
could construct a secorid accessory building for. the additional ��
storage space. �
Ms. McPherson stated�that if the Commission approves this variance
request, staff recommends that the following stipulation be a
condition of approval: .
1. The storage addition shall not be converted to living
area without . approval of .a variance by the City to reduce
the side yard setback from 10 feet to 5 feet. •
Ms. Savage asked Mr. Ramaker to explain his hardship.
Mr. Ramaker stated he has 7 and 9 year old children who are sharing
a bedroom on the upper level. They have two bedrooms on the upper
level and space for two bedrooms on the lower level. One room on
the lower level is used for storage, and he would like to convert
that room to a bedroom on the lower level to create two bedrooms.
He would then move all the storage to the addition over the garage.
He stated he really.does not have a hardship, but they do need room
for storage:
Ms. Savage asked about the alternatives for storage suggested by
staff.
Mr. Ramaker stated building an accessory structure in the rear yard
for storage is not a viable aiternative. Their yard is small.
They have space for a garden and a place�for the children to play. ���

He did not want to use any more of the yard space for a storage
building. He.also did not think it would look good aesthetically
to have an accessory structure in the rear yard.•
Mr. Ramaker.stated ihat he also believed the new roof�will be more
aesthetically pleasing than the ugly flat roof.
Ms. Savage asked if any of Mr. Ramaker's neighbors are objecting
to this variance. .
Mr. Ramaker stated he has talked to a couple of his neighbors who
do not object to the proposed addition. Other neighbors received
the public hearing notice, and he has heard nothing negative from
them.
Mr. Ramaker stated there are two houses in the neighborhood that
have similar type additions over the garage. He did not know if
they received permits from the City. He stated the peak of the
roof will be about the same height as the roof on th� house and
will be constructed so that it will look as much like the house as
if it was originaliy built that way.
Ms. McPherson stated that in looking at the site plan, it appears
that the new garage roof is about 18 inches higher than the house.
Mr. Ramaker stated that .if that is a problem, he can lower the
height of the xoof, but he wants to have enough room in the
addition to be able to walk around.
Ms. Savage stated that in order for the Commission to approve a
variance; they need to determine that there is a hardship.
Mr. Ramaker stated that his father-in-law lives with them three
months a year. During that time, his two children have to sleep
in the room that is used for storage. There is very.little storage
area in this house.� As the children grow older, he would like them
to have separate rooms. He stated his wife is a teacher, and she
has a lot of teaching materials, .books, etc., that need to be
stored, and.they need a larger storage area. He stated he realized
this i� probably not a true hardship. He stated the proposed
storage addition would only be accessed �y pull-down stairs�in the
garage.

Mr. Kuechle stated he would recommend approval of the variance for
a number of reasons. In looking at the alternatives that are
available, it is true that the petitioner could repair the leaking

flat roof, but it is not a very wise construction technique to have
a sloped roof coming out onto a flat roof. He has looked at the
house and neighboring houses, and they are all of similar
construction. Most of them have the kind of ga�ages that are the
straight A-frame type; however, most of the rooflines go up quite
a way. �If the petitioner�runs his roofline up, it is not going to
stick out noticeably in the neighborhood. Architecturally, it will
look better than it does now with the flat.roof. He also believed
that the neighborhood would be better served by this�type of roof
than with an accessory storage building, because accessory storage
buildings tend to increase the alutter and result in less space in
the rear yard.
Mr. Kuechle stated he is concerned about the roofline of the
addition being higher than the roofline of the house, and he would
like the roofline to be kept as close as possible to the roofline
af the house.
Ms. Smith stated she agreed with Mr. Kuechle. Her initial.concern
was that it would be very easy to convert this type of addition to
living space, but if the storage. space is going to be accessed only
through the garage, that alleviated her concern. �
Ms. Savage stated that she also agreed. She believed that the
overail purpose of the Code is not going to be violated in any way �
by this addition. It will fit into the neighborhood aesthetically.
The petitioner does have a need for more.storage space, and she
agreed with the petitioner�that an additional accessory structure
for storage is more of an eyesore, especially in a nice
neighborhood. She stated siie would also recommend approval of the
variance.

The petitioner is requesting two variances: (1) to reduce the
side yard setback from 10 feet to 5 feet, and (2j to increase
the maximum height of an accessory structure from 14 feet to
19 feet. The request is for Lot l7, Block 3, Briardale
Addition, the same being 6181 Benjamin Street N.E.
Site
Located on the property is a single family dwelling with an
attached two-car garage. The property is zoned R-1, Single
Family Dwelling, as are all adjacent properties.
Analysis
Section 205.07.03.D.(2).(a) requires a side yard setback of
10 feet between any living area and side property lines. �
Public purpose served by this requirement is to maintain a
minimum of 20 feet between living areas in adjacent structures
and 15 feet between garages and living areas in adjacent
structures to reduce the possibility of fire. It is also to
allow for aesthetically pleasing open areas around residential
structures.
Seation 205.07.01.8.(3) requires that all accessory buildings
shall not exceed 14 feet in height.
Public purpose served by this requirement is to maintain
accessory structures at a scale appropriate to residential
developments.
Some years ago, the petitioner constructed a flat roofed
additiori to the rear of the attached two-car garage. As a
result of this type of construction, the flat roof of the
addition has since begun to leak. The petitioner is proposing
to reconstruct the roof of the storage addition and, in doing
so, he is proposing to add a second story to the storage area.

The petitioner does not intend to use this addition as living
space; therefore, the first part of the variance to reduce the
side yard setback to 5 feet is not necessary.
It is possible for the petitioner to reconstruct the roof of
the storage addition without adding additional height to the
addition. If the petitioner desires additional storage area,
the petitioner has the alternative of constructing a detached
storage building on the property or adding additional depth
to the addition.
If the Commission approves the variance request, the following
stipulation should be a condition of approval:
1. The storage addition shall not �e converted to
� living area without approval of a variance by the
City to reduce the si.de yard setback from 10 feet
to 5 feet.
