I am requesting that you investigate the subject contractor's building practices
in consideration of future granting of licenses and permits. The s�bject con-
tractor was under contract to build my house at 1514 Berne Road, Fridley. He
has, to date, failed to complete the house and has refused to repair extensive
damage caused by his failure to follow specifications and poor workmanship by his
subcontractors. Attached is the record of the Park Region Development Company's
performance.
Upon examining the extensive list of unfinished work and the overall poor per-
f ormance, I believe you gentlemen will concur that this contractor's business
practices are such that he should be required to complete his obligations on my
house prior to being granted the necessary licenses and permits to continue
building in the city. I have attempted to contact the contractor on many occasions.
He refuses to answer or return my calls.
Should you want any further data or should you wish to discuss the facts, please
contact me at my home or at my office. Should the final outcome of my business
dealings with this contractor result in a substantial loss to myself, so be it.
However, I sincerely believe this contractor should not be allowed to continue
doing business in this manner.
I would greatly appreciate an answer to this letter, should the situation be
such that your position does not allow you to take any action with this company.

RECORD OF PERFORMANCE BY PARK REGION DEVELOPMENT CORPORATION IN
CONSTRUCTION OF HOUSE AT 1514 BERNE ROAD, FRIDLEY, MINNESOTA.
I. Items not completed as of 28 February 1967 (102 months after start of
construction on 15 April 1967 and 5 3/4 months after moving in on
7 September 1966).
1. Family Room ceiling partially torn out after water leaks developed in
roof during September 1966 and continued until extensive damage was
incurred late in January 1967.
2. Warped wood paneling not repaired after above water leakage in family
room.
3. Loose tiles on family room floor not repaired after above water damage.
4. At the time the water leakage developed, the contractor and his subcon-
tractor, Milton Johnson Roofing, both stated that the problem was a failure
to construct the second floor deck at a lower level than the adjoining
second floor rooms. The specification called for the deck to be lower.
In January the contractor pulled down the family room ceiling. He left
with the plaster and water all over the floor. He hasn't returned since.
The Milton Johnson Roofing Company, came and tore away some of the siding
and placed a thick coating of tar along the deck where it joins the house.
He hasn't returned since. Neither of these companies will answer my calls.
Repair is necessary to raise door to deck so that water doesn't leak into
house every time it rains.
5. Three storm windows for the basement have not been delivered.
6. The air conditioning system has only been partially installed. The
electrical installation has not been done.
7. Colonial grills for all front windows have not been painted nor installed.
8. The screen for the back combination door has not been delivered.
9. The crawl space from the basement under the back hall is left as a
gaping hole.
10. Tile for the five second floor closets has not been delivered nor installed.
' 11. The living room floor was to be rewaxed after being severely damaged by
the repair of the fireplace. This has not been done. It should really
be refinished.
12. The back hall is separating from the family room such that the tiles are
pulling apart on the floors.
13. The corners of all the rooms have developed large cracks the entire
height of the walls.

" 14. Basement walls leak water such that water stands on basement floor. The
` basement walls are completely discolored from all the water leakage.
15. The ceramic tile in the front entry hall was improperly installed such
that individual tiles are coming loose on the floor.
16. The overhang on the front of the house has not been repaired nor painted
since it was torn down in October 1966. The overhang was torn down
to allow the plumber to twice move water pipes from the outside wall to
an inside wall after the pipes froze for the second time.
17. The lot has not been rough graded.
18. The driveway has not been repaired after the contractor dug it up to
install a sewer line through my front yard for the house next door.
19. Without my permission and while I was away at my work, the contractor
dug up and installed the sewer mentioned above. At the time I challenged
his doing this, he became incensed and threatened to not complete my
house. He refused to remove the sewer, he refused to obtain proper legal
rights to cross my property. He sold the house without informing the buyer
of the sewer situation. I contacted the buyer prior to his closing and
informed him of the situation.
This is my problem; however, the contractor's actions were in, my opinion,
poor business practice. Furthermore, I must now dispose of a most
distastfull matter with a new neighbor.
20. Cracks in grout around all bathroom floor and vanity tile.
II. Items not repairable
1. Large cracks throughout basement floor. (up to 1/8")
2. Large cracks in garage floor.
3. Floor drain in basement was not placed at time the concrete was poured.
The floor was torn up to install the drain with the resulting unsightly
patched floor. The drain is incorrectly placed as all the water runs
toward opposite end of the basement.
4. Slope of garage floor apron is such that water runs back into the garage
when it rains.
5. Improper installation of kitchen counter taps, contrary to specific
instructions given at the time.
III. Overall contractor performance and business practice
1. The sales agreement was signed on April 1, 1966 and construction was to
be started immediately. Payments were delivered to the contractor as
required by the sales agreement and requested by the contractor.
2. Possession was to be made on July 15, 1966. The house was only partially
completed on that date. On July 31, 1966, the contractor assured us that
the house would be ready for occupancy on September 1, 1966. We gave
such notice to the owner of the property from whom we were renting at
the time.

f } On September 1, 1966, the house was far from completed. I moved my family
into a motel for one week at my own expense.
3. On September 7, 1966 we moved into the house. There was not water,
electricity or gas service. The City of Fridley was of great assistance
in obtaining water and sewer service within a day after occupancy.
Electric service was obtained approximately October 1, 1966.
Gas service was not obtained until November. We obtained a propane gas
tank from the Gas Company. The contractor explained he wouldn't install
a tank because he would not bear the cost of adjusting flutter valves
far propane and again later for natural gas.
The contractor expressed his opinion that all of these problems were
ours and not his.
4. All during the months since moving in, we have had the inconvenience and
hardship of cleaning up after subcontractors coming and going to install,
tear out, repair and patch the errors made installing windows, fireplaces,
handrails, plumbing, insulation, floors, heating duct work, air conditioning,
painting, leaking roofs, leaking basement walls, and what have you.
At the time we moved in, all sawdust, plaster, dust and dirt was left as
is by the workman. The contractor had always assured us that the house
would be cleaned entirely when we moved in. Because we had no recourse
but to occupy the house at the time, the contractor declared he had no:
obligation to clean anything. There was a two inch layer of mud on the
basement floor.
5. I have not been demanding during this entire experience. When the contractor
could not fulfill his portion of the sales agreement for a mortgage, I
committed an additional $1,000 cash outlay to solve his problem. I haven't
complained about the state of the house at the time occupancy nor the
added expense of obtaining motel accomodations for my family.
I did complain about the sewer for the house next door running through my
front yard.
Al1 in all, my lack of complaint may have contributed to the situation.
However, I believe that businessmen should be required to fulfill their
contracted obligations or show cause for continuing to receive licenses
and permits for new work.

from Mr. Clifford Warre, owner of the dwelling at 1514 Berne Road, regarding
30 items not to his satisfaction in the construction of his home.
An inspection was made by the Electrical Inspector, the Building
Inspector, the owner and his wife on June 26, 1967. Your Secretary
was notified in advance of this meeting and informed us that we
would be notified if you were unable to attend. Since you were
not present this is a report of that inspection to your firm,
the owner, and our City Attorney, who will refer this matter b�ck
to the City Council if the need be.

or alternate blocking with nailing thru joist into blocking.

In conclusion the remaining items listed are not code violations
but matters of consideration between the owner and other parties.
