DESCRIPTION OF REQUEST:
The petitioner requests that a variance be ganted to reduce the rear yazd setback from 32' to 23'.
Approval of the request would allow conshuction of a three season porch addition. The petitioner's stated
hardship:
". ..The irregularly shaped lot is located on a cul-de-sac with an unusual lot configuration. The north
side lot line is a great deal deeper than the south side lot line. When applying the rear setback
ordinance formula to this home, there is not an opportunity to add on to the rear of the home on the
end to the south. The only reasonable location to add a porch addition is off the kitchen and dining
room which aze located on the south end ( the rem�ning rear facing rooms are bedroom and
bathroom). There are no other locations on the home that would work for a porch addition ..."
SiTMMARY OF ISSiTES:
An open deck is located in the location of the proposed porch. There aze a number of alternatives the
petitioner could pursue including: leaving it as a deck, relocating it to a side yazd, or constructing it at
the front of the dwelling.

Section 205.07.03.D.(3).(a) of the City Code requires a rear yard setback equaling 25% of the lot depth with a
minimum of 25 feet required and a maximum of 40 feet required.
Public Purpose served by this requirement is to provide rear yard space to be used for green areas which enhance the
neighborhood.

The petitioner requests that a variancc,T% reduce the rear yard setback from 32' t�3' be granted to allow constniction
of a 12' x 18' screened porch and deck addition. Located on the property is a single family dwelling unit with an
attached two car gazage. The dwelling is setback at 35' from the front properiy line as required. An open deck is
located in the azea of the proposed addition. Open decks are pernutted by code to encroach into the required front
and rear yard setbacks by 10 feet.
The petitioner has several alternatives to the variance request:
1. Reconstruct the existing deck as a deck.
2. Relocate the addition to the south side of the dwelling (a narrower addition would be required, 9' x 18',
or 12' x 12').
Construct a porch in the front of the dwelling.
The lot is unique in shape, as the subject parcel is located on a cul-de-sac. The right of way and the cul-de-sac is
not centered, but is offset to the west. The distance between the proposed addition and the dwelling to the west
would be approximately 68 feet.

Ms. McPherson stated the subject parcel is located at 6150
Briardale Court which is generally located west of Stinson and
south of Rice Creek Road. Located on the subject parcel is a
single family dwelling with an attached two car garage. The
property is zoned R-1, Single Family, as are all the surrounding
parcels.
Ms. McPherson stated the petitioner is requesting a variance to
reduce the rear yard setback from 32 feet to 23 feet to construct
a 12 foot x 18 foot screened porch with an 8 foot x 12 foot deck
addition on the rear of the dwelling. Located in the position of

the proposed porch is an existing open deck which would be removed
and the porch and new deck constructed in that location.
Ms. McPherson stated staff in analyzing this request determined
that there are three possible alternatives to the request which
would meet the code requirements, as follows:
1. Reconstruct the existing deck as a deck.
2. Relocate the addition to the south side of the dwelling (a
narrower addition would be required, 9 feet x 18 feet or 12
feet by 12 feet).
3. Construct a porch in the front of the dwelling.
Ms. McPherson stated the lot is uniquely shaped. The parcel is
located adjacent to a cul de sac which is not typical in shape.
This cul de sac has more of a curve on one side than the other.
This results in a uniquely shaped lot with the north boundary line
being substantially longer than the south boundary line. That does
impact the point from which the setback is measured. If the cul de
sac were more straight, the house could have been moved closer to
the curb and not setback to the distance that it currently is. The
dwelling unit does meet the front and rear yard setback
requirements as constructed. There is approximately 68 feet
between this structure and the structure to the west.
Ms. McPherson stated this request is within previously granted
variances; therefore, staff has no recommendation regarding this
request.
Mr. Kuechle asked what the typical lot depth would be in the City.
Ms. McPherson stated the average is approximately 125 feet.
Mr. Kuechle asked if there is typically 50 feet between the back of
the house and the end of the lot.
Ms. McPherson stated this can vary from approximately 25 to 27 feet
up to 50 feet or more.
Mr. Kuechle asked how staff came up with a reduction of 32 feet
down to 23 feet.
Ms. McPherson stated the lot depth is calculated as an average
between the two property lines.
Ms. Betzold stated, regarding staff's alternative for a deck on the
side, they already have a deck and want to replace it. The side is
not desirable because the neighbor's garage is right there and they
would look at a garage. The existing deck comes out 16 feet.

The addition would come out 12 feet or 4 feet less than the current
deck.
Ms. Beaulieu asked if there had been any comments from the
neighbors.
Ms. Betzold stated the neighbors had said they would enjoy the
addition very much. ,The neighbors to the west, north and south
have screened porches�and like theirs.
Mr. Sather stated the Commission might have concern about the rear
yard setback and the houses being too close. The house to the
immediate west, which is the closest neighbor affected, already has
a screened porch so there is no potential for the houses becoming
too close. This is a right that has been granted to others. He
recognizes staff's efforts to locate the porch in the front of the
house, but this is not a desirable location.
MOTION by Ms. Smith, seconded by Ms. Beaulieu, to close the public
hearing.

Ms. Smith stated she would be inclined to vote for approval. The
public purpose is being served by putting the addition on the back
side. There are several circumstances including the unusual lot
size and shape. Putting the addition on the side would be more of
a closing in of the green space rather than putting it in the back.
Ms. Beaulieu agreed. The hardship is the shape of the lot. If the
cul de sac were more rounded, the structure would be farther
forward. She saw no adverse impact.
Mr. Kuechle concurred. He looked at the site. It is not that far
off the 25 feet, which is the minimum requirement. It looks like
this is the best of the choices.
