Dear City Official,
On behalf of Robert and Anna Melle, the homeowners at 1613 Briardale Road, Fine Design
Contracting, Inc., would like to request a variance to Section 205.07.A.
The homeowners above have retained Fine Design Contracting, Inc. to construct an
addition to their home for additional bedrooms. We would like to build the addition over
the existing garage to keep with the original Colonial design. The setback required for
habitable space is 10 feet from the side yard; the current garage has a setback of 5 feet, which
is code for non-habitable space. We would like to utilize the space over the garage for the
new habitable bedrooms.
This addition would uphold the characteristics of the neighborhood as detailed on the
attached photos of neighboring properties, and would thus meet the hardship law of
Minnesota due to "characterization of the neighborhood".

REQUEST
The petitioner, Kurt Templin of Fine Design Contracting, on behalf of the homeowners
at 1613 Briardale Road, is seeking a variance to reduce the side yard setback for living
space from 10 feet to 5 feet to allow an above the garage living-space addition.

The property is zoned R-1, Single Family as are all surrounding properties. The
property is located on Briardale Road, south of Rice Creek Road. The lot is rectangular
shaped and fronts on Briardale Road. The home and garage were constructed in 1975.

Existing Home
City Code requires a 10-foot side yard setback between living area and the side yard
property lines. City Code also requires a 5-foot side yard setback between an attached
accessory building and a side yard property line. The existing garage meets the 5-foot
side yard setback requirement. However, the petitioner plans to construct a living
addition directed above the existing garage, encroaching into the required 10-foot side
yard setback. As stated above, the petitioner is seeking to reduce the side yard setback
for living area from 10 feet to 5 feet.
The living space addition will consist of additional bedroom and laundry space.
City staff has received no comments from neighboring property owners.

UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
PUBLIC HEARING OPENED AT 7:35 PM.
Ms. Stromberg stated the petitioner is seeking a variance to reduce the side yard setback from
10 feet to 5 feet to allow an above the garage living space addition. The summary of hardship
submitted by the petitioner reads "The homeowners have retained Fine Design Contracting to
construct an addition to their home for additional bedrooms. We would like to build the addition
over the existing garage to keep with the original Colonial design." The petitioner's property,
located on Briardale Road south of Rice Creek Road, is zoned R1 as are all surrounding
properties. The lot is rectangular shaped and fronts on Briardale Road. The home and garage
were constructed in 1975.
Ms. Stromberg explained that city code requires a 10 foot side yard setback between living area
and the side yard property lines. City code also requires a 5 foot side yard setback befinreen an
attached accessory building and a side yard property line. The existing garage meets the 5 foot
side yard setback requirement. However, the petitioner plans to construct a living addition

directly above the existing garage, encroaching into the required 10 foot side yard setback. The
petitioner is seeking to reduce the side yard setback for living area from 10 to 5 feet.
Ms. Stromberg stated the living space addition will consist of additional bedroom and laundry
space. Staff has received no comments from neighboring property owners.
Ms. Stromberg then showed a sketch drawn by staff that would implement architectural
enhancement to the proposed addition, which would help to minimize the addition's mass and
enhance the overall appearance.
Ms. Stromberg further stated that staff has no recommendation as this variance is within
previously granted dimensions. Similar variances granted include:

tf the variance is granted, Ms. Stromberg stated staff recommends the following stipulations be
attached:
1. Petitioner shall obtain all necessary permits prior to construction.
2. Addition shall be architecturally compatible with the existing home and finished with
complementary siding and color scheme.
3. Petitioner shall implement architectural enhancements to minimize the addition's
mass and enhance the overall appearance, so that it will coincide with the mass and
design characteristics of its adjacent neighbors and surrounding neighborhood. Staff
has attached an illustrated option for accomplishing this objective. This option will be
attached to the final "Action Taken" lette� and labeled "�xhibit A." If not the elements
of staff's suggested design modification in Exhibit A, the petitioner shall work with
staff and have a suitable alternative plan approved by City staff prior to issuance of
the building permit for the addition.
Ms. Stromberg explained that staff believed it was important to add the third stipulation because
they did not address this issue in their staff report.
Commissioner Vos stated the third stipulation is something new in the variance process in that
the Commission is projecting to the petitioner that he have a different architectural design and
staff's proposal might have an impact on the square footage of the addition.
Chairperson Kuechle stated the dimensions are the same; staff is suggesting the roof extension
for aesthetics.
Ms. Stromberg explained that this stipulation is pretty standard when staff encounters an
addition that is going to be what they consider a massive wall, with little architectural detail. She
referred to a similar situation with the Miller Funeral Home a few years ago.
Kurt Templin of Fine Design Contracting stated they are concerned that the roof extension may
interfere with the windows proposed for the east side of the addition. Another issue, he
explained, is that there is a brick pattern on the lower portion of the garage and the garage is set

back two feet so the addition will not result in a solid mass. He also did not think the roof
extension would look right since it would be on the east side of the house only.
Bob Melle, homeowner, stated he does not enjoy the appearance of the additional roof. The
house will not be large and boxy because the garage is set back finro feet from the front of the
house. He did hire an architect to develop these plans and he does not see the need,
architecturally, for the roof extension. He would ask that the Commission not require the
additional roofline.
Mr. Templin stated they're willing to work with the City staff to resolve this issue.
Mr. Melle stated he needs to move forward with this project as soon as possible. His personal
preference would be not to put on the roof extension, but he's willing to work with the
Commission and staff.
After reviewing Stipulation 3 again, Mr. Templin stated the last sentence allows flexibility in this
requirement by having the petitioner work with staff, which he is happy to do.
Commissioner Vos asked if the neighbor to the east at 1623 Briardale has any objection to this
proposed addition and he asked if that house is set back the required ten feet.
Mr. Melle explained the house to the east has a vaulted ceiling roof line so there are no
windows on that side of the house, even on the first level. The bedrooms in his new addition
will look out over a roof.
Ms. Stromberg stated that they neighbors home is set back ten feet from the property line.
Ms. Stromberg reviewed pictures of other homes in the neighborhood that do have the roof
extension staff is proposing for the petitioner's addition.
MOTION by Commissioner Zinter, seconded by Commissioner Jones, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED UNANIMOUSLY AND THE PUBLIC HEARING CLOSED AT 7:55 PM.
Commissioner Vos stated he is still not totally happy with the third stipulation but he thinks the
petitioner advocates for getting approval so he'll vote for it.
Commissioner Sielaff stated he will vote for approval as there is enough flexibility in the
language of Stipulation 3 to allow the petitioner and staff to work together and come to some
consensus.
Commissioner Zinter stated he is in support of the request based on the combination of being
able to meet the needs of the staff recommendation and the individual user.
Commissioner Jones stated he is in favor of the request. The third stipulation is a little different
from what the Commission normally sees but the petitioner and homeowner have indicated a
willingness to work with eity staff and they all have the same goal in mind to have a nice looking
house.

Chairperson Kuechle stated he doesn't see any problem with the third stipulation because the
petitioner is asking the city for a variance and in recognition of that fact the city has the option of
asking for some give on the side of the petitioner. The petitioner has stated they are willing to
meet the city's request so he doesn't see any problem and would vote in favor of this appeal.
MOTION by Commissioner Sielaff, seconded by Commissioner Jones, to approve VAR #05-01
by Fine Design Contracting, to reduce the side yard setback for living space from 10 feet to 5
feet to allow an over the garage living addition, generally located at 1613 Briardale Road, with

the February 9th eeting has been cancelled.

the mass and design characteristics of its adjacent neighbors and surrounding
neighborhood. Staff has attached an illustrated option for accomplishing this
objective. This option will be attached to the final "Action Taken" letter and
labeled "Exhibit A". If not the elements of staff's suggested design modification in
Exhibit A, the petitioner shall work with staff and have a suitable alternative plan
approved, by City staff, prior to issuance of the building permit for this addition.
You have one year from the date of the Appeals Commission action to initiate construction. If
you cannot begin construction during this time, you must submit a letter requesting an extension
at least three weeks prior to the expiration date.
