At the same time, she would have tried to find a way to split that property in half and m ke it a more viable property. There were so many comments by the neighbors reg rding the proposed use of this property. There will be a business in that location eventua �,y. She would be inclined to send the request to the City Council with a recommendation to�`deny. Mr. Jones agreed with all the points resented. There are too many variances. The main one is that the property is too small t begin with. The best thing would have been to sell it as one unit or split it into two lots. In reading through the comments from the neighbors, no one is in favor of the request. He w, uld recommend denial. PUBLIC HEARING• CONSIDERATION OF VARIANCE REQUEST VAR #98-39 BY JOHN HARWOOD: Per Section 205.04.06.A.(3) of the Fridley Zoning Code, to increase the allowable encroachment into the rear yard setback from 10 feet to 13 feet to allow the replacement of an existing deck on Lot 4, Block 1, Blomberg's Estates, generally located at 7661 Brigadoon Place. MOTION by Dr. Vos, seconded by Mr. Jones, to waive the reading of the public hearing notice and to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING OPEN AT 8:19 P.M. Mr. Bolin stated the petitioner is requesting a variance to reduce the rear yard setback from 10 feet to 13 feet in order to construct an open deck at 7661 Brigadoon Place. The property is located east of Arthur Street befinreen Osbome and 75th. The property is zoned R-1, Single Family, as are all the surrounding parcels. The code requires that open decks encroach no more than 10 feet into any rear yard setback. The property has no previous land use action history. The home was constructed in 1981. Mr. Bolin stated the petitioner s hardship states: Due to poor original construction ... � �� we F�ad to remove the deck from our house and reconstruct rotted studs and joists in the north wall of our residence. The variance is consistent with the neighboring deck �ocation.� Mr. Bolin stated he and Mr. Hickok visited the site and noticed that there are some possible altematives to allow the deck to be built without a variance. He showed some pictures of the site. One altemative may be to bring the deck out and wrap it around so it is at the side of the home. � � APPEALS COMMISSION MEETING, JANUARY 13, 1999 PAGE 8 Mr. Bolin stated similar requests have been granted in the past. Therefore, staff has no recommendation regarding this request. Mr. Jones asked if the original deck encroached. Mr. Bolin stated, no. Ms. Mau asked if the petitioner is proposing to expand the size of the deck. Mr. Bolin stated, yes. Ms. Mau asked if the altemative was discussed with the property owner. Mr. Bolin stated the altemative was discussed with Mr. Harwood over the telephone. Mr. Harwood believed the proposed location best met his needs. Mr. Kuechle asked if the encroachment was due to the size or the location of the deck. Mr. Bolin stated the deck is in the same location. The previous deck appeared to extend 10 feet from the home. Mr. Kuechle stated that on the site plan, it shows 14 feet. Mr. Bolin stated 14 feet is the measurement of the proposed deck. Dr. Vos asked what would happen if the petitioner ever wanted to snclose the deck. Mr. Bolin stated there are different conditions. An enclosed deck is not allowed to encroach. . Dr. Vos stated the petitioner could not enclose the deck without coming in for a variance. He asked what the requirements were for an enclosed deck. Mr. Bolin stated the petitioner would need a variance to enclose the deck. Mr. Hickok stated an enclosed deck would take on the same setbacks as the principal structure itself. Mr. Jones asked if staff had received any comments from the neighbors. Mr. Bolin stated they had not received any comments. Mr. Harwood stated the deck as it exists is a northeast facing deck. The original dec�C rotted off the house. There is a tree at the northeast comer of the lot that shades it. It gets no sun. There is no part of the deck that extends to the west of the building. It is almost always wet in that area. The original boards were not treated. They rotted on the house. Part of this was also because of poor flashing. He took the old deck off and replaced the header board on the north side of the building. He will have to anchor onto that 16-foot header board, and he would like to try to get part of that deck out into the sun. �, � APPEALS COMMISSION MEETING, JANUARY 13, 1999 PAGE 9 Mr. Harwood stated staff suggested going around the comer. He would do that if he could anchor it to the building. He could do it as a free standing deck, but structurally that is a problem. He is pretty much stuck with what they have which is a 16-foot header board along the northeast side of the building. He would like to make it longer by 4 feet to the west. The original deck also had a stairway coming up from the east side. It came off the garage and up to the deck. Again, it is the wrong side of the building. It is the north side, under the trees, and damp. He wants to enter. the deck from the west side and make it a usable deck. He has a condition where he really has no choice as to where to anchor it --16 feet along the building. He wants to replace what he has and make it usable. He wants to extend it four feet further to get some sun on it, run the steps up the west side, and make it accessible. These are conditions that are there. The variance is for three feet more than what is permitted. He did not think that was unreasonable. It is within the scope of the decks in that area. He is limited on access and location. Mr. Kuechle stated he understood there was another deck and asked where that deck was located. Mr. Harwood stated that deck was in the same place. It was hexagonal in shape and the steps came up along the east side of the building. It extended about 12 feet out from the building. The header board was the same length as the current header board and in the same location. The proposed deck is a different shape and different dimension. Mr. Kuechle asked staff how much overage there actually is. Mr. Bolin stated the setback line comes about three feet from the comer of the deck so that one comer of the deck encroaches. The steps might be able.to be reconfigured to eliminate the need for a variance. Ms. Mau stated the old deck was a hexagon which is probably why it did not encroach. Dr. Vos stated the petitioner had a fairly high fence to the rear of the property. Mr. Harwood stated they have a seven-foot board fence on the property line. Dr. Vos asked if the petitioner had talked to the neighbor to the rear. . Mr. Harwood stated they have not talked about this. The neighbor built their deck several years ago. Dr. Vos asked if the neighbor's �eck was encroaching. Mr. Bolin stated it appeared to be. � Mr. Harwood stated both houses are about 25 feet from the property line. He purchased the house 10 years ago. He wished he wor�ld have recognized the problem earlier. He would have saved a lot of work on that north wall. Ms. Mau stated it does not appear that the encroachment is so terrible. Three feet is not a big deal. They tried to make it a more usable deck which is positive. She would suppose there are ways to reconfigure to bring it in without a variance. The neighbor appears to be just as close. With the fence, she did not see where it should matter. Since the neighbors have not expressed any problems, she would vote to approve the request. Mr. Kuechle concurred. He thought it unfortunate that they have to have a variance for this. It seems they could make it work. On the other hand, the encroachment is just a comer and not a very dramatic issue. There is a fair amount of open space. He would concur to recommend approval. Mr. Jones stated he did not see it as a big deal. It appears to be consistent with other designs. He was not sure about the hardship, but he would vote in favor of the request. Dr. Vos stated he would vote in favor. The site is on a cul-de-sac. When they do that, most houses are set back a ways and you lose distance in the back and the boulevard in the front. If this was on a regular street, they would be a long way away from the back lot line. Secondly, he was impressed by the distance from the neighbor to the west. Going out four feet will not affe�t the neighbor to the west. The petitioner is requesting a variance to increase the allowable encroachment into the rear yard setback from 10' to 13', thus decreasing the rear yard open space to 12', allowing the construction of an open deck. Stair and deck altematives exist that would allow the proposed deck to be built without a variance.
