The history of events folloi�rs. In the S�ring of 1977, �: reguested
th�.t -the city plumbin�; and heatin�; inspecto�� IQIr. �ill Sandine, mal�e
u.n inspection of the Franklin fireplace in our home (the Franklin
had been installe�. by the �revious a�vner). I had beco�e concerned
abnut the �ranYlin �.fter I had c�lecke� �vit�l the city and le�.rned no
permit had been taken out for the installation. .Our i�a�ediate concern
was the vent pi�e that �oes intQ-an enclosed wall cabinet and then
into the cnimney. This vent pipe tivas wrapped with fiberglass in�ul�,tion.
f�ir. Sandine s�.id this ��as oka�. Ho�°�e�rer, }ze said the ,��dlls and ti•aaocen
beams and c��ooden tri�n on the ri�ht of the fireplace a�ere r�ot o'�ay
ar�d constituted a potenti�.I fire �zazard. Part of the �vall behind
the Fr�.n'_�.lin ���.s asbestos ce�nent baard covered �vitN z-bric�. I�r. Sandine
saici it v�ould be akay to rersove tL1e c�roor�. r.ear �he sidPs anci back of
ille Fran'�lin �,nd to p�otect tl�e rest of the �valls �vit� asbestos
cenent �o�;.rd and z-brick. So tnat was done in the Fall and P,'r. Sari.dine
and b:r. Ron Iiolden, a buildin� inU�ectar, oka3red the desi�;n.
Also in the Fall of 1g77, ��e took aut a home ir�provenent � lo�,n.
Three af the im�ravements �re had dane rrere to bring natural gas in�o
our hor.�e, to have a ne�ar Gas boiler installed tq replaee the old �uel
oil boiler, �.nd to �iave basebo�rd radiation installed to replace the
first floor radiators. So Prs. Sandine ��as a�ain brou�;ht in�o the

picture. ��e said it vYas ol��,y to vent the r�ranklin, . g�.s boi.ler and
+ �as v��ter he�t�r into the same existin�; clay tile chiYnney aroeided
tne gas vent was placed ei�h�een inc�es above t�.e Frankli.n vent.
s�hen asked why tne need for eighteen inches, he �;ave t�o reasons:
so that the ash frqm the �ranklin couldn't same day build up and
block off the gas vent; and so that if there ��ere ever a gas leak,
the gas v�ould be above any hat embers that might �et inta the chimney
and ignite the �;as. He furtlzer expl.ai�ed that the eighteen inch
difference �aould insure that any e�bers entering the chimney would
go out before reachin� the gas vent. So �ve signed a contract vuith
the plurnbing and heating cantractor to have tY�e job done.
After the boiler.had been installed and all of the re-piping
dflne, one of the plumbing and heatin� contractors men didn't think
they'd be able to �et the �as vent the required eighteen i.nches. above
the woad vent without putting the vent to close to the wooden floor
joices (there ���as and is su�posed to be six inches of air space
Uettr�een a gas vent and a.ny combustibles} . :io I called �ir. Sandine to
see.what he'd su„�est. Ittivas then that he said notiv it wouldn't he
per�issible to run both �ooa and �;as vents into the sa.ne chimney. He
said tiiere' d been a c'e�.ange in tn.e city buildin; code. r�hen question�d
as to �rhy, he said it vaas safer. 3ut he couldn't tell us how much
safer or �yhy it was saier or v�hat �otential �rotle:us coul.d result.
A rileeting was arran�e�. at out horae bet�een i;"s. Sandine, Darryl �
Clark (a city of Fridley buildin�; inspector a.�� '.Ys. �andine's
superyisor), and the contractor. (Lnfortunately, I could not attend
c�ue to rvorking) . The ins�ectors arrived al�eaci of the contractor,
as�:ed P�irs. T:a�esse some questions about the wal.ls, a.nd went to .work
�easurin� inside and outside �].Ze house «+ith the a�narant intentian
of havin� a seperate chimney, run on the sout:.1 end of the house (which
would have �eant movinb the ne�r, already insta�led boiler and re-
routin� the pipin� again). Forty-five minutes after the contractor
arrived, that was all changed. It �aas no� oka.y to vent both �as and
v:ood into the same chimney, which the contractor had told me he
thou�;ht �yould happen. Permissior_ t;�as also �iven ta .use asbestos
cement l�o�.r�. to protect the wooden joices and sub-�'loorin� from the
��.s flue, and to put the flue up ne�t to t��en.
Tnat winter �ve had trouble �vit:�. our Fr�nlclin smoking, d�hereas
before �ve'd had an excellent draft and no smokin� �roblems. Th.is
��as r�uch to ou.r cha�;rin since we use the �'ranklin as our main neat
source for the first floor. Then, in the Sprin�, ��e had a small
chimne�r fire. The fire departnent car�e out in iu11 force, cilecked
out the Frankl.in and said all �aas okay. They did recommend having
the chimney swept at the en3 of t�e h,eatin�; seasan which is so�►ething
we'd already planned to do. After more smo!��i�d aroble�s, we decided
to play it safe and not use the Frariklin again until it �ras s�ept.

- .� fortuitaus deeision, for w'_nen the chimney sweep disconx�ected the
� stove pipe, we discovered the �ranklin vent pipe in the �vall cabinet
had been bur•ned throu�h in several places and had scorched the fiber-
�lass insulation. 6�e also diseovered tYiat the vent pipe was the
v�rong kind of pipe to use for suc�h an installation. One mo�e use of
the Franklin could h�ve caused a house fire. The s�eep ��rpressed
surprise that P�ir. San.dine had okayed -the safety of the installation
in the �vall. �Tde .now had more reasons to doubt P�Ir.; Sandine� s�o�rledge
of free standing fireplaces.
In the Fall of 1978 ��e,contacted several businesses that install
free standin�; fireplaces for information and estimates on properly
and safely connectin�; the Franklin to the chimne�r. yre �rere nowhere
near prepared for what we �ere to hear. The contractors �rere
unanimous in telling u.s ti�e' d been given the varong information on ho�v
and witn �vhat to protect our ��alls from the hea� of the Franl�lin.
They further said that what I.jr. S�ndine had advised and f.�r. Holden �
rein�'orced as being safe, left our �valls virtually unprotected, You
see, asbestos cement boar: tr�.nsfers heat from the fireplace to the
cor�bustible ��alls anci dries the� out, causin�; a hazardous situation.
The ��a11s shauld all }�e torn out and started'all over again: �stimated
cost is ��400 to H450, and t'�at's if v�re clo the finishing �ork ourselves.

wait - the coup de gr�ce �vas yet to be delivered. The cantractors
tivould not t ouch the Fran�l.in j ob if it �vas t o be vent eci int o the same
chimney as the �2,s• They thouoht it to be unsafe and ill advised to
clo so because of the inversion �roblem and vrere sl:sprised i-� had been
approved that way. The estimate� cos� of putting in a class B chimney
is �400 to �450. And it v�rould have to be installed by so�eone other
than the fireplace cantractors, so they �vould not gain �onetarily.
They ��ere just advising. They a.lso pointed out potential problems
from not havi.ng a chimney liner (somethin� ��e didn't need as lon� as
our evood s�ove was operatin�) as bein� moi�ture building up and
causing the r�orta.r to crack, a.nd a po�sible dr�ft inversion due ta
the clay tile flue not bein�; heated enou�h to keep the fu�es rising
to go out of the house, ra��.er than bac�: into it:

burnin�;. ThiU led us to Paul Ste�;meir, a reco�-nized authority in
the Pa;id—dJest and ot��.er parts of the country on �rood burnin� �id wood
burnin�; s�.fety. He told us the sa.rne things the contractors nad plus
more, a,nd sho�ved us some of the G�ays to pro�erly protect our wa11s.

remenbered that he and Bill (Sa,ndine) had wanted to have a class B
chimney run. '��7e asl�ed him then why wasn't i.t, especia.Ily since ��e' d
told l�r. Sandine when �e firs� contacted him �,e �;�anted to nake sure
the job �ras done correctly and safely. This concern vvas reiterated
when he first reversed himself on ventin� �two different fuels inta
the sane chimne�. Iair. C3ark had no re�ly to th�,t question, but
instead bec�.me defensive. He -talc� us ?�.ow he had been to a meeting in
Jarivary of 1978 where an inspector fron St. Paul had s�.id ne thought
it ��as okay to vent gas and wood in tne same flue. I told him that
was no excuse. Zater, in ane of my conversations s�yith a State of
Ib:innesota building arnd heating inspector he told me he had attended
the meetin� referred to by �,ir. Clark. And what i.,r. Claxk fa�led. to
men-�ion a�dfor remember �vas that the vast majority of the ather peo�le
that �,�ere there disagreed �ritYa runnin� both fuels in the same ilue.
�ue have z�ade va�ious inquirie.s to `the appropriate state and city
officials concerning the last five years of �;eneral �ov6�led�e, and
these facts e�er�e: 1. Fiberglass insulation should not be used
to in�ula.te �. fire�lace vent pi�e in G.n enelosure such as a��al.l or
cabinet; 2. Asbestos cemer�t board should not �e used to hea� proof
�. wall or ot'_^ler combustibles; 3. It is not a bood idea to vent any
different kinds.of fuels in the same flue. And t�elve to eibhteen
month: �rior ta the installation of our oas boiler and the ol�ay from
the city inspectors, the idea of no-t 000d was chan&ed to bad or unsafe.

All, t�iree of these principles or �uidelines have been viol�.teci in
the advise and/or a�provals �;iven to us by i:ir. Sandine �,nd/or
Tr:r. Clark and/or l��r. ��olden. This has resulted in us �ein� faced
with a potenti�.i health h� zard; passible chimney darna�,e; loss of
the use of ou� fireplace tivhich. h�,s resultecl in higher heatin� bill.s,
not to mention its asthetie value; further inconvenience, upset and
r.:ess in our ho�e, a safety hazard fro� the �vay the �as vent pipe is
installed; a bill of ��300; to �a900 ta rectif�T the 'situ�,tian. In
aadition, there are the m�,�erials and labor cost of.a19�.88 for
originall.y re—aoin� the fireplace �ralls as the city inspectors told
us, btat �rhich turned out to be ��ron�. �'or t?Zese reasons, v�e are
submitting this claim for �51.1.13 against the city of r-ridley for
expenses resulting from the inspectors errors.

for the City of Fridley regarding this loss.
Mr. Laaesse feels that wrong information was given to him

The fallov�ing fall we had t�.e chimney s��pt. Th� s�e�p
gueetior�ed th� installation in regmrds to th� sto�re pipe not being
anchored -to the �va11 and the breaching being below th� c1a�r tile liner.
It was at that point that my �iife and T realized the i�.�tallatior�
h�.d not been inspected aft�r it was installed. The sweep also told
us we had devel:oped a bad gla�ed creosote build up in our ehimney
�vhich he couldn�t sweep awa,y• He advised u� that �vh ile dampering the
fir� do�en did get more ef.ficiency out o� the wood, it also caused the
gla�ing .problem - a probl.em �ve l�ad never had w�3th the Franklin stove•
I3e also ��,id the only ��.y '�o remoQ� �he cr�osate was to burn it out
and described how we eould try to do th�,t by modif�ing the way �re
usecl t�.e st ove .

time into this, he wou]>d send us a ch�ek to refund the installation
char�e the Lr�ergy Shed had ffiad�, a.nd we cauld have the liner pr�bl�m
solv�d to meet the buildiri� inspec�ors i�.eas. I told h.im this was no� an
accept�.ble solution to us. I also told him I didn't �xpeet him to
pay a1.1 the costs of solving the problem but to meet his obligation.�

Dear Mr. Lagesse:
Thank you for your letter dated March 11� 1983 wherein you outline
your recollection of the sequence of events involving your taood
stove.
First, We Were not involved in the decision to change your burning
practices to eliminate the glazed creosote problem.
The City can not become involved in certifying the Code com plianee
or safety of an existing chimney. Therefore, it is our
recommendation that you discontinue the use of the Wood stove until
you have had a qualified third party inspeetor certify that it is
safe to use. We recommend that you not use the xood stove until
this has been aceomplished.

On March 7, I met with your neighbor, Mr. Lagesse, regarding
standing water on his property. The area with standing water is
a low area that is collecting runoff from the east and south
portions of Mr. Lagesse's property and some runoff from the
backyard of your property. The problem of standing water is more
apparent this time of year due to the soil being frozen.
It appears that the creation of a shallow depression along your
back property line, directing the drainage to the existing swale
along your north propert� line, wou1FY help this alleviate the
condition on Mr. Lagesse's property.' This should be fairly easy
to do as you are preparing the rear yard for seeding or sodding
this spring/summer. I would be happy to meet with you to discuss
this matter. �

Dear Mr. & Mrs. Lagesse:
In 1997, the City Council adopted an ordinance declaring gravel driveways a public nuisance.
They were declared a public nuisance for a number of reasons, such as: they can cause
erosion, contaminate soil with oil and other vehicles fluids, and deposit soil and gravel in the
City's storm sewers and detention ponds. When gravel driveways were declared a public
nuisance, the City Council gave property owners five years to have their gravel driveways
paved. The five-year deadline is quickly approaching, which means all gravel driveways within
the City of FRdley must be paved with approved concrete or asphalt by December 31, 2002.
If on December 31, 2002, your driveway hasn't been paved a citation will be issued and filed at
the Anoka County Courthouse. A misdemeanor citation is a criminal offense and is punishable
by up to 90 days in jail and/or a$700 fine.

The Chief Building Official shall, before issuing permits for the erection of an3� building or structure, or for any
addition to any existing building or structure, or for any alteration or repair to any existing building ar structure,
upon application therefore, require the payment by the applicant for such permit of fees to the amount herein
below set forth and in the manner herein provided to-wit:

VERIFICATION OF FOUNDATION
Permits for construction will be issued a minimum of 24 hours from the time of application to allow for proper
review of the proposed structure and of the construction site.
A Certificate of Survey of the lot, showing the location of the foundation once it has it has been constructed will
