A. PUBLIC PURPOSE SERVED BY REQUIREMENTS:
Section 205.053, 4, A, requiring a front yard setback of 35 feet.
Pu61ic purpose served is to allow for off-street parking without '�
encroaching on the public right-of-way. Also for aesthetic '
consideration to reduce the "6uilding line of sight" encroachment '
into the neighbros front yard.
6. STATED HARDSHIP:
Wants to save two extremely large trees which also keep a steep bank '
from washing down on the property. '
C. ADMINISTRATIVE STAFF REVIEW:
Remo�al of the trees might pose a potential hazardous situation
because of the steep slope behind them. The proposed garage would
be � feet from the front property line and the trees would be saved.

Chairperson Schnabel said that if the neighbors to the
North had had living area facing the proposed garage, there
could have been some problems. However� she said that since
there tivas no correspondence from the neighbors she could see
no problems.
MOTION by Mr. Kemper� seconded by Mr. Barna, that the
Appeals Commission approve the request for var3ance of
Section 205.053, 4, B(5,b) Fridley City Code, to reduce
the side yard setback on a corner lot from 2,5 feet to
distances from 15 feet to 22.5 ieet, to alloti�r the construetion
of an addition to a house located on Lot 1� Block 1,
Meadotirrlands 5econd Addition, the same being 6631 Jackson
Street N,E.� Fridley, P�Iinnesota. Upon a voice vote, all
voting aye, the motion carried unanimously.

Chairnerson Schnabel asked.�thy a garage door opener
had been suggested.
Mr. Holden said that since the garage t��oula be less
than the- 3� f�ot setback, it �xrould enable the petitioner
to;get into the garage faster and out of any line of sig�t
since the house ���.►as located on a corner lot. He pointed
out that it had just been a sug�estion.

Mr. Kemper said that from;a safety standpoint, he
could see no problem. He thaug�it that it tivas a very
imposing garage since it tivas almost as big as the house.

property line and the trees �rould be saved.
Mr. P�faloy said that he i��anted the variance in order to
protect the ttiro trees and also if the house �+�ould have
to be built further back on the lot, he tiTrould have to
go in�o extensive landscaping that �drould require terracing
almo�t the entire hillside.
Mr. Holden explai.ned that most of the houses on the
east szde of the hill had been pulled fortivard on the lots
because oi the gradin� of the lots.
Ch�i.rperson Schnabel asked if the house tiaas being
built on a speculation. �
Mr. P�Ialoy said th�t he ti�rould be builclin� the home
for himself. He said that it tivas not spe�cul-ation: '
He said that he presently lived in Coon Rapids, but iranted
to move because of their tax rates.
Mr. Holden said that the entire block had a lot of
trees and that it really.looked nice. He saici that�there
v�ould be no problems with traffic visibility,

Mr. Maloy commented on the statement. He said that
rath�r than diggin�, he ti�rould be using land fill. He felt
that, if the reQUest 1Jere granted, the construction would
be forl�razrd enou�h to avoid going near the trees.
Chairperson�Schnabel said that it r�ould be best not
to ta„mper r��ith the trees� at all.
Mr. rlaloy said that the main reason for requesting
the variance t�ras to enable him to save the trees, He said
that he <<�ou1d do a].I he could to avoid tamperin� v�rith the
trees,

Mr. Holden said that it tvould be possible to put some
' fill around the trees. He only reminded Mr. Maloy that he
had been made ati�rare of the problem.
