NOTIGE IS HEREBY GIVEN tha.t the Appeals Commission of the City of Fridley
will meet in the Counci.l Chautber of the City Hall at 7:30 P.M. on Tuesday, May 11,
1976 to consider the following matter:
A request for vaxiances of the Fridley City Code
as follows; Section 205.053, 1B, to reduce the
Iot area, for a lot platted before December 29,
1955, from 7500 square feet to 6600 square feet,
and, Section 205.053, 4C, to reduce the rear gard
setback from the required 27� feet to 21 feet, to
a11ow the construction of a dwelling and garage
to be located on Lots 1 and 2, Block U, Riverview
Heights, the same being 8080 Broad Street N.E.,

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
1. Section 205.053, 3B, lot area requirement of 7500 square
feet.
Public purpose served by this section is to avoid the condition
of over crowding of the residential neighborhood; also to avoid
excess burden on the existing sewer and water services.
2. Section 205.053, 4C, a minimum rear yard setback o� 250 of the
lot depth not less than 25 feet is required.
Public purpose served is to provide desired rear yard space to be
used for greet�areas which add to the attractability of the neigh-
borhood. It also provides needed spaces for the mental well�>being
of the family.
B. 5TATED HARDSHIP: Lot unbuildable as platted and variance to rear
yard setback required in order to build house as planned.
C. ADMINISTRATIVE STAFF REVIEW: 8080 Broad Street N.E. is bordered
by houses immediately to the North, and across the street to the
South on Broad Street. The house to the North,��90 Broad 5treet,
_�is setback 36 feet from the street. This house is built on 2
30 foot lots and one 25 foot lot, totaling 85 feet. To the South
600 Ely Street is built on 2 30 foot lots, and 2 25efoot lots.
This house is setback 30 feet from Broad Street.
West of this property are 2 25 foot lots not owned by the petitioner.
Th�se two,'a5 foot lots ar� s�rvc�d with sewer and water, as the two
lots at 8080 Broad Street N.�. Ideally, all four lots should be
developed as one, but separate ownership is involved. The rear yard
variance request may be of some inconvenience to the neighbor to the
West when and if he builds.
Several other lots of similar size have been developed in this area.

Mr. Holden sug�ested that they might be getting into a sticky area making this
contin�ent on this particular request because of the policy that had been set in
the past allowing structures with no garages.
Mr,'Kemper said that in this particular case the Adrninistrative Staff Report did
not address itself to this particular item, and the plans didn't appear to be
available. He added that he was concerned that the subject of garages on sub-
standard•lats be clarified in the code.

Mr. ZJilliams stated that a lot in Riverview Heights zaas nc�t tisorth $10�a�0, and
each fifty foot lot was valued around $5,500 in that area. He stated that this
lot needed a lot of fill on the North end of the lot and up ag�.inst Br�ad Street.
Chairwoman Wahlber� said that if this passed� they were creating another fifty
foot lot which would be squeezed in, as the house t�rould be ten feet from the lot
line. She also noted that it V�as close to the fZoodplain,area, but not in it.

Mrs. Gabel stated she hated to be in this position if they didn't have to be� but
sometimes it apneared they had no choice. She said she didn't see any particulax
problem t•rith this lot, and the house plan would be pleasing to the area.
