�n Wednesday, September 1, 2010, the Fridley Appeals Commission officially approved the
Variance, VAR #10-07, to reduce the front yard setback from 25 feet to 17.1 foot to recognize
an existing non-conforming setback. Recognition of the setback will allow the petitioner to
construct a garage and living space addition to the existing house, legally described as Lot 42

Appraval of this variance is contingent upon the following stipulations:
1. The petitioner shall obtain all necessary building permrts prior to construction of the

2. The proposed addition sha/l be archifecturally compatib/e with the existing house and

You have one year from the date of the City Council action to initiate construction. If you

Scott Hickok, Community Development Director, stated the recognition of this non-conforming setback
would allow the petitioner to construct a garage and living space addition to. the existing home.
Recognition of the non-conformity also is required before a building permit can be issued for the
proposed addition. `�
Mr. Hickok stated the following is the petitioner's hardship: "I'm requesting a variance for the property
at 8090 Broad Avenue. I believe the house was built in 1971-1972. At that time, the builder was to
submit an application for a variance and apparently it was never filed or applied for. This current
application for a variance is to allow for the existing house, already in place, which has a reduced front
yazd setback of 17.1 ft."

Mr. Hickok stated the properly is zoned R-1, Single Family Residential, as are the surrounding
properties. It is located west of East River Road and is at the corner of Broad Avenue and Fairmont
Street. The house is facing Broad Avenue, even though Fairmont Street is considered the "front" yard
because it is the shortest street frontage.
Mr. Hickok stated they may recall from past discussions that on a corner lot, if the front and side lot
dimensions are within ] 0 percent of one another, there is opportunity to decide at that time which is going
to be the front yard. They will probably also recall that on a corner in a single-family residential district,
the front yard setback is 25 feet and the second front yard or side yard on the second street only has to be
17.5 feet. Speculation is when this home was built the reviewer did not look at the fact that this not the
case where it is 10 percent different between Broad and Fairmont. Therefore, they do not have that, even
though it is a corner lot, they would not have that choice of deciding they are going to make Fairmont
their front yard. It is already ordained because the ordinance says that if it is not within 10 percent, then it
is the narrowest dimension that becomes the front yard. Looking back there are probably of couple of
things here, 17.1 feet tells liim they thought they were doing the 17.5 feet and they were trying to stay true
to the second yard setback. As they can see today they fell short, and that is really one of the main
reasons this variance is before them.
Mr. Hickok stated the existing house and garage were constructed in 1973. City Code requires a ZS-foot
front yard setback in R-1, Single Family zoning district. The petitioner is seeking to reduce the front yard
setback from 25 feet to 17.1 feet. Again, that is to recognize an existing condition of non-conformity.
Mr. Hickok the proposed addition is a 16 x 30 foot three-car garage. It will be added onto the existing
house, and they would then convert the existing tuck under garage to additional living space. It would
become a family room on the main floor. This will allow them to expand existing bedrooms above the
new garage and expand the existing lower level that was once a two-car garage. The proposed addition
will add approximately 1,000 feet to the home; and it will provide a third garage stall space for storage.
The new addition will rneet all setback requirements.
Mr. Hickok stated staff has received two letters from neighbors, both in favor of the proposed addition.
Very positive and supportive letters.
Mr. Hickok stated City staff has no recommendation as this variance is within previously granted
dimensions:
• VAR #06-05: 500 Dover Street. Variance approved to reduce the front yard setback form 25
feet to 5 feet to recognize an existing non-conforming setback.
• VAR #04-09: 1313 Hillcrest Drive. Variance approved to reduce the front yard setback from
25 feet to 16.6 feet to recognize an existing non-conforming setback.
Mr. Hickok stated staff recommends that if the variance is granted, the following stipulations be
attached:
1.. The petitioner shall obtain all necessary building permits prior to construction of the
addition.
2. The proposed addition shall be a.rchitecturally compatible with the existing house and
finished with complementary siding and color scheme.
CaChairperson Jones asked if this were a new construction, this would be different.
Mr. Hickok replied, absolutely. It is a feature of the house that is existing.

in Fridley, and does not want to have to move.

Mr. Scarcella replied, yes.

ANALYSIS
The property is zoned R-1 Single Family as are all
surrounding properties. The subject property is
located west of East River Road on the corner of
Broad Avenue and Fairmont Street. The lot is
square shaped, with the house facing Broad
Avenue, even though Fairmont Street is
considered the required "front" yard because
it's the shortest street frontage. The existing
house and garage were constructed in 1973.
City code requires a 25 ft. front yard setback in

petitioner is seeking to reduce the front yard
setback requirement from 25 ft. to 17.1 ft. to
recognize the existing non-conforming setback

The petitioner would like to add a 16 ft. by 30 ft.

Doing this will allow them to expand the existing bedrooms above the new garage and expand the

I support Stacy Scarcella's petition to reduce the front yard setback on her property.
You are to be commended for ensuring that residents (and the city) fulfill zoning requirements.
There has been a remarkable improvement in residential quality here in Riverview Heights. But, in Ms.
Scarcella's case, you should allot about 17 seconds to this hearing. The hearing for this variance should
be taken care of on the way to the grocery store. Any more attention is simply a waste of time and
money.
She strikes me as a very intelligent, well educated woman who has the integrity to do the job
right. Forget about her; be sure the design is approved in a timely manner, insist the contractor properly
pulls the permit, and is only awarded a strong pass on all inspections. Leave the rest to her project
leadership so you can get on to other headaches which you undoubtedly have in your job.

We will have no comments as long as the existing driveway entrance on to Broad Avenue is
maintained. If widened or relocated, a curb cut permit is required. If relocated, a land alteration
permit would be required if equipment is used to remove and/or deliver fill materials. It would be best

Appeals Commission Members,
This letter is a request for a variance for the property located at 8090 Broad Avenue NE Fridley, MN
55432. I believe the house to have been built in 1971-1972. At that time the buiider was t� submit an
application for variance and apparently it was never filed or applied for. This current application for
variance is to allow for the existing home, already in place, uvhich reduced the front yard setback to 17.1
feet.
This variance is needed so that we can add-on a three car garage 16x30 feet. This will allow us to
expand the existing bedrooms above the new garage and expand the existing lower level family room
into the current iwo car garage. This addition will add approximately 1000 sq. ft. of new living space as
well as a third garage space for storage. The new addition will be on the south side of the house and
will not require a variance on any of the other yard setbacks.

This letter is a request for a variance for the properiy located at 8090 Broad Avenue NE Fridley, MN
55432. I believe the house to have been buiit in 1971-1972. At that time the builder was t� submit an
application for variance and apparently it was never filed or applied for. This current appliaation for
variance is to allow for the existing home, already in place, which reduced the front yard setback to 17.1
feet.
This variance is needed so that we can add-on a three car garage 16x30 feet. This will allow us to
expand the existing bedrooms above the new garage and expand the existing lower level family room
into the current two car garage. This addition will add approximately 1000 sq. ft. of new living space as
well as a third garage space for storage. The new addition will be on the south side of the house and
will not require a variance on any of the other yard setbacks.

Dear Scarcella:
On Wednesday, September 1, 2010, the Fridley Appeals Commission officially approved the
Variance, VAR #10-07, to reduce the front yard setback from 25 feet to 17.1 foot to recognize
an existing non-conforming setback. Recognition of the setback will allow the petitioner to
construct a garage and living space addition to the existing house, legally described as Lot 42
