A. PUBLIC PURPO5E SERVED BY REOUIREMENT:
Section 205.053, 4B, requires a mi.nuniun side yard setback of 10 feet for
living area.
Public purpose served by this requirement is to mainta.in a minimum of
20 f eet between living areas in adjacent structures and 15 feet between
garages and living areas in adjacent structures to reduce exposure to
conflagration of fire. It is also to allow for aesthetically pleasing
open areas around residential structures.
B. STATED HARDSHIP:
"The existing house is located 5.8 feet from the side property line.
This addition would require no modification of existing roof line and
it is the least expensive and easiest way to incorporate new living
space and maintain a good floor plan."
C. ADMINISZ'RATIVE STAFF REVIEW:
The dimensions of this property are 110 feet by 110 feet and lvcated on
the corner of Broad Avenue and Janesville Street. The house faces
Broad Avenue so that is considered the front yard. The existirig house
is located 5.8 feet from the side lot line (north) and 15.5 feet from
the front lot line (east) .
The addition is proposed o£f the back of the dwelling (to the west) and
in line with the north side of the dwelling. The addition would not
create any problems for the adjoining property owners to the north as
the ir dwelling faces K,imball Street and there would be 52.6 feet between
dwellings. Some consideration should be given to limiting windows along
the north side of the addition to maintain. the privacy of the rear yard
of the neighbor to the north.

more garage ox living space. P4r, Soland said it would be for additional garage
space for storing of vehicles. He said the� would be usin e same driveway.

m�chanical caork in the garaye and Mr. Soland stated t t he fixes his own cars
and his woodworking tools would be stored in the g agc. Chairwoman Schnabel said
the existing garage i.� 540 sq, ft, and the addi 'on would be 440 sq. ft. (total
980 sq. ft) and that the house and breezeway iving space) is 904 sq, ft. She
said there will be more garage space than '�ing space. Mr. Soland stated that
the roof will go the opposite direction tt�e present roof. Mr. Merry stated
that he had no objection to the additi Mr. Kemper said he had a question about
the stated hardship on the Staff Rep t and that it really does not address the
matter. Mr, Soland stated that he id not want the addition to cover his breeze-
way or his kitchen. Chairwoman chnabel agreed that the stated hardship in the
'Staff Report does :�ot really a ress the question. She also noted that there may
be a problem in the future s ould the petitioner sell and the new owners turn the
addition into a repair sho or so�efihi.ng; the wrong business could be a problem in
the neighborhood.

the ptoperty owner to the north has a very small back yard and the Staf€ was
concerned about their privacy. Me. Berglund showed th.e Commission his plans for
the addition and he has no plans for windows--to the north. He stated �hat he has
some:experience in re�deling and carpentry �Znd the block work and rt�ugh-in will
be contracted. He further stated that the roof line will be carried all the
way back, they will be matched, and the addition was okay G�ith his neigr,bo�s to the
north. Mr. Barna stated tha.t there is a big tree that would break up �the visual
effect of crowding and that this addition would enhance the neighborhood.
Mr. M�ravetz stated that he had no calls from the neighbors. Mr. Kemper stated
that �the hardship in the Staff Repo�t did not address the real matter, that being
the home is too small and petitioners need mare living space. Chair.woman SchnabeZ
suggested that "human needs" should be addec� to the hardship par� of the form.
