Dear Mr. Vagovich:
On July 6, 1993, the Fridley City Council officially denied your
request for a variance, VAR #93-12, to reduce the side yard setback
of a detached accessory structure from 5 feet to 3 feet, to allow
the construction of a detached accessory structure, located on Lot
6, Block 2, Brookview 2nd Addition, the same being 6600 Brookview
Drive N.E.
The City Council did, however, approve the special use permit
request, SP #93-09, to allow the construction of a second accessory
structure over 240 square feet, subject to moving the structure to
a conforming location on the property, and the accessory building
must be constructed in ar_cordance with the building, fire, and
zoning codes.
Should you wish to move the building elsewhere on the property,
please contact Michele McPherson at 572-3593 to verify appropriate
setbacks. Also, your site plan and building plans will need to be
amended to coniorm to applicabie zoning and building c�cies. Pl�ase

Recommendation
The location of the structure as proposed raises several issues of
concern. The Appeals Commission will take action on the variance
request to the setback requirements on June 22, 1993. Staff
recommended denial of the request to the Appeals Commission.
Because other opportunities exist to comply with the code, staff
recommends that the Planning Commission recommend denial of the
special use permit request as presented. If the petitioner revises
the site plan to meet the code requirements and to also allow
compliance with the building code regulations, the Planning
Commission could table�the request until another site plan is
submitted for review.

Dear Mr. Vagovich:
In 1997 the City began a systematic code administration process in an effort to raise the level of
understanding about City ordinances. The purpose of this letter is to both inform you about
certain city codes relating to property conditions throughout the City and to ask for your
assistance in resolving a code issue. You may be unaware of the City's code requirements
concerning commercial vehicles and accessory structures. On a recent inspection in your
neighborhood, the following was observed:
Your truck cab is parked too close to the street. Fridley City Code requires all
vehicles to be licensed, operational, and parked on an approved hard surface
driveway. Additional parking requirements for large commercial vehicles include:
(1) no more than one vehicle in excess of 12,000 pounds GVW per residential ��
property; (2) parked on a hard surFace driveway 10 feet from the front
property line; (3) owned and owner-operated by a resident at the location where
the vehicle is routinely parked; and (4) no excessive idling or engine noise (City
Code 506).
You have an accessory structure beside the garage that does not have a permit
and does not meet the building code. Fridley City Code requires all accessory
str`uc�Ur�s to �e locate� �� th� s�de �r rear y�rd svith ��rropr�ate setb?eks an�
appropriate permits if necessary. In addition, a second accessory building over
240 square feet requires a special use permit. Please contact the Building
Inspections Department at 572-3604 to verify all permit and setback regulations.

2. The throat is at least 12 inches (305 mm) above the lintel and is
at least t/Zp of the cross-sectional area of the fireplace opening.
3102.7.4 Hoods. Metal hoods used as part of a fireplace or bar-
becue shall not be less than 0.036-inch (0.92 mm) (No. 19 carbon
sheet steel gage) copper, galvanized steel or other equivalent
corrosion-resistant ferrous metal with all seams and connections
of smokeproof unsoldered constructions. The hoods shall be
sloped at an angle of 45 degrees or less from the vertical and shall
extend horizontally at least 6 inches (152 mm) beyond the limits of
the �rebox. Metal hoods shall be kept a minimum of 18 inches
(451 mm) from combustible materials unless approved for re-
duced clearances.
3102.7.� Metal heat circulators. Approved metal heat circula-
tors may be installed in fireplaces.
3102.7.6 Smoke chamber. Front and side walls shall not be less
than 8 inches (203 mm) in thickness. Smoke chamber back walls
shall not be less than 6 inches (152 mm) in thickness. A minimum
5/g-inch-thick (16 mm) clay flue lining, complying with Sections
3503, 3504 and ASTM C 315, shall be permitted to form the inside
surface of the 8-inch (203 mm) and 6-inch (152 mm) smoke cham-
ber walls.
3102.7.7 Chimneys. Chimneys for fireplaces shall be con-
structed as specified in Sections 3102.3, 3102.4 and 3102.5 for
residential-type appliances.
3102.7.8 Clearance to combustible material. Combustible
materials shall not be placed within 2 inches (51 mm) of fireplace,
smoke chamber or chimney walls. Combustible material shall not
be placed within 6 inches (152 mm) of the fireplace opening. No
such combustible material within 12 inches (305 mm) of the fire-
piace opening shall project more than 1/g inch (3.2 mm) for each
1-inch (25 mm) clearance from such opening.
No part of inetal hoods used as part of a fireplace or barbecue
shall be less than 18 inches (457 mm) from combustible material.
This clearance may be reduced to the minimum requirements
specified in the Mechanical Code.
3102.7.9 Areas of flues, throats and dampers. The throat shall
be at least 8 inches (203 mm) above the fireplace opening and shall
be at least 4 inches (102 mm) in depth. The net cross-sectional area
of the flue and of the throat between the firebox and the smoke

chamber of a fireplace shall not be less than that set forth in Figure �
31-1 or Table 31-A. Metal dampers equivalent to not less than
0.097-inch (2.46 mm) (No. 12 carbon sheet metal gage) steel shall
be installed. When fully opened, damper openings shall not be less
than 90 percent of the required flue area.
3102.7.10 Lintel. Masonry over the �replace opening shall be
supported by a noncombustible lintel unless the masonry is self-'
supporting.
3102.7.11 Hearth. Masonry �replaces shall be provided with a
brick, concrete, stone or other apQroved noncombustible hearth
slab. This slab shall not be less than 4 inches (i02 mm) thick and
shall be supported by noncombustible materials or reinforced to
carry its own weight and all imposed loads. Combustible forms
and centering shall be removed.
3102.7.12 Hearth exteasions. Hearths shall extead at least
16 inches (406 mm) from the front of, and at least 8 inches (203
mm) beyond each side of, the fireplace opening. Where the fire-
place opening is 6 square feet (0.56 m2) or larger, the hearth exten-
sion shall extend at least 20 inches (508 mm) in front of, and at
least 1? inches (305 mm) beyond each side of, the fireplace open-
ing.
Except for fireplaces that open to the exterior of the building,
the hearth slab shall be readily distinguishable from the sunound-
ing or adjacent floor.
3102.7.13 Fire blocking. Fire blocking between chimneys and
combustible construction shall meet the requirements specified in
Section 708.
SECTION 3103 —TEMPORARY BUILDINGS OR
STRUCTURES
Temporary buildings or structures such as reviewing stands and
other miscellaneous structures, sheds, canopies or fences used for
the protection of the public around and in conjunction with con-
struction work may be erected by special permit from the building
official for a limited period of time. Such buildings or structures
need not comply with the type of construction or fire-resistive
time periods required by this code. Temporary buildings or struc-
tures shall be completely removed upon the expiration of the time
limit stated in the permit.
