REPORT OF TELEPHONE CONVERSATION
JANUARY 27, 1967
MR. BELISLE: I am calling you with regards to the violation of our
zoning ordinance.
NIlt. MILLER: In what regards?
MR, BELISLE; The fact that you ha.ve 2 business at 6850 Brookview Drive
which is in R-3 Zoning. You are not permitted to hFVe a
business in that zoning without a Special Use Permit.
You are �onducting �. business of selling homes from this
model home and this is not legal if you do not have at least
30 homes in the ar�a �o sell.
MR. MILLER: I don't exactly understand that part of it but you are
permitting a home business.
MR. BELISLE: A home business is permissible, such as a beauty shop,
but the resident of the home has to occupy this house, with
a shop in the basement. The party can only h�ve a one foot
sign advertising this business, not illuminated, put up on
the front of the house. �ut i� you ar� conducting � regulRr
business of selling houses from this model house and are using
iC as an office, �.nd this is not permissible.
MR. MILLER: I checked with Cass before I moved over here and she said
that there wasn't anything in the regulations that would not
permit us to use this model home for this use,
MR. BELISLE: This is not permissible and this is in violation of the
eoning ordinances. The property owners have already retained
an attorney and they are going to get this sign removed.
MR. MILLER: Isn't it permissible that you could use a 12 sq. foot sign
on a project.
MR. BELISLE: Only on a house development project and only until 95%
of their property is sold.
MR. MILLER: Yes, but they are putting up large signs;
MR. BELISLE: If you had that much property or lots to se11, you could put
up a 600 sq. foot sign, like Clemron or Homedale. They are
T� allowed a lot of area where there is a project of over 30
lots. ��X���� Attorney tells me that you can t have a
sign and can�t have a business there, as this is in violation
of ordinance.

MR. MILLER: What attorney would that be?
MR, BELISLE: �r. Jim Gibbs of Weaver, Talle & Herrick.
MR. MILLER: Is he the City Attorney?
MR. BELISLE: N0. Virgil Herrick is the City Attorney.
Mr, Gibbs quoted all of these violations to me. In any
case, you shouldn't have put up a sign without a permit.
MR. MILLER: I would like to ke�p the sign
MR. BELISLE: No, it is not permissible. That is only for advertising
business on the premises. Yf you were just selling that
house, then apparently it wo�ld be permissible and then
not over 6 f�et high and no illumination. The big object-
ion is th� illumination. The ordinance states that an
z��i� illuminated sign cannot be permitted within 500'
of any residential property, or any bright lights permitted
on it. I am going to mail you a violation notice to day,
MR. MILLER: The situation is that we need a sign here.
MR. BELISLE: I can't verify it but you could ask the Council, Board of
Appeals and they could givc you a variance on it, but I
cant. You shouldn't have put up a sign without a permit.
MR. MILLER: The way I construed the Sign Ordinance, I wasn't in need
of a permit.
MR. BELISLE: The material and the design of your sign makes your whole
deal an advertising device. The whole front of the house
becomes an advertising �aari�a. device.
MR. MILLER: I se�.
MR. BELISLE: So I am sending you a violation notice today and you will
have to remove it 24 hours after you get the notice.
MR. MILLER: Okay, I will.have to do it.
I'm sorry this situation arose, but you always are the guy
that gets stuck with the bad news.
MR. BELISLE: Where the whole neighborhood retains an attorney, we have no
choice but to stick with the ordinance.
MR. MILLER: Do you know who is making the complaints?
