He said Mayor Liebl had visited the area the previous SaCurday in his absence and he thanked him. He said there are many problems in the area and the main concern is the drainage. He added, the Railroad had promised to take care of the dra.inage problems, but had done nothzn�. He said he had also talked to the Engineering Department and they had promised to do something about the water standing in the area. He said at this time, they plan to do nothing. He said the area ha.� been seeded, but it had grown uver with weeds. Mr. Zimmer said he had hoped this matter could be placed on the agenda for Council consider, ation, Mr. Zimmer said he had talked to a few of his neighbors about the prob- lem and they were in agreement with him that somethiag had to be done, but they did not attend the present meeting. '� Mayor Liebl read the letter as submitted by Mr: Zimmer with the four listed areas i of concern. ! Mayor liebl referred to the first area of concern, liability for the damage to the �� ,,: 2immer property caused by blasting. He asked Mr. Zimmer if he had submitted any claims, or had his neighbors submitted any claims.. Mr. Zimmer said he had no-� . isubmitted a claim, but there were cracks in the plaster and stucco. He said he had ; -� `�' talked to a representative of the railroad who had indicated the damage had been : � � done by settling of the house. ; The City Attorney advised the resident that he should initially talk to the railroad � 4. jand submit this claim. He further advised him that after this, the matter should � � be referred to the railroad's insurance company. He said if there is no action after this, the individual could file-a claim n conciliaL�on court or municipal : � � court. ; . � i � i � Mr. Zimmer indicated that this may be from �500 to $600. The City Attorney said � if the amount were $500 or under, this could be sett1ed in conciliation court, � � and if more, this would have to be taken care of in municipal court. The City • j Attorney advised Mr. Zimmer to check with the Clerk of Municipal Court during the � �' warking hours. He further explained that each side would present their evidence ; � � and the judge would make a decision. - ' ` { g � Mayor Liebl questioned the Attorney's fees in such a case for a$500 claim. ' i Mr. Pikus said when it is dark and no lights are on, he is able to walk around his � house beeause it is lighted by the railroad lights. _ Mayor liebl asked if the berm had been instalTed and Mr. Zimmer said it had, but the � � lights are higher than this and shine over it. Mayor Liebl asked if the fencing i had been instalied. Mr. Zimmer said yes, but they would like.to have the strips � instalied in the fence. The City Manager said.the railroad.had.talked.about:some.fencing and.strips.for the ` ` - fence and also some planting for this area.-_He.mentianed.that the landscape plan � had not been approved by the railroad at the present time, but would be done in'the . � near future. He said they would be working on this plan in the spring. 4 The Representative of the railroad assured the area residents that the landscaping would be carried through this area. He also mentioned that the flood lights are still in the construction stage and perhaps are not focused and directed proper�.y � at the present time. � Mayor Liebl asked Mr. 0'Leary if it would be possible to have a meeting with Mr. � Zimmer to enable them to reach a satisfactory conclusion to the lighting problems. �� Mr. 0'Leary said he would do this. Mayor Liebl said he hoped the landscaping plan would call for the planting of trees ; on the berm to reduce the amount of ]ight and noise. Mr. 0'Leary said the land- � scaping plan would be brought to the City for approval before the work is done. f� ? Mayor Liebl asked if Mr. 0'Leary would furnish a copy of the plan to the area j j property owners for their approval. Mr. 0'Leary said this could be done. + ! Mayor Liebl questioned the Assess on this type of action and whether or not it would conform to policy. - The Assessor answered he would recommend tha he special assessments not be reduced or the residents of the whole City woul able to bring up the same request. _ . A representative of Tri-Co Builders said the letter of re st had stated that the • Company would pay all of the special assessments, but in the ter they had asked that the back taxes and penalties be waived. The representative said the property would be a buildable site without e additional 30 feet which is being referred to at the present time. „ The Assessar said this would have to be done at the County level with approval b he State. The City Attorney said there is no guarantee that this could be done by the County. He suggested the Assessor work with the County for this type of action. Dear Mr. 0'Leary, On March 3, 1975, Mr. Henry Zimmer submitted a copy of his report of damage and relating correspondence to the Glty of Fridley, Ne indicated that he has been in contact with the blasting contractor and Burlington Northern regarding his alleged damages as a result of the blasting operations. He further indicated that he has not received any response from either party regarding his claim. At the City of Fridley Council meeting of November 4, 1974, you stated that the insurance company for the blasting contractor �ould handle such claims. However, you did caution us that it had been some time sinee the completion of the blasting wor[c and this insurance may not be in effect. You assured us that if this is the situation the railroad insurance would take care of it. The claim was submitted to our General Claim Department and reviewed by them. �Je are advised by the Claim Department it is apparent the insurance company handling the claim has made a thorough investigation and declined payment because of lack of positive evidence damage was caused by the contractor's operation. The insurance company's report of March 24, 1972 to the State of Minnesota, Insurance Division, indicates the studies made in determining damage due to blasting. It is apparent there is still no positive evidence cracks in Mr. Zimmer's house was caused by the contractor's operation, therefore, we must consider this matter closed. The City of Columbia Heigh�s passed a resolution on January 4, 1982, reinstating a previous water rate charge for non-residents at 125% of the residential rate. Currently, the residential rate is $0.80/100 cu. ft. ($7.07/1,000 gal.). The non-residential rate is $1.00/100 cu. ft. ($1.34/1,000 gal.). There are thirteen Fridley residents being serviced with Columbia Heights water and sewer along Main Street between 43rd and 40th Avenues. The Columbia Heights water and sewer 7ines were assessed only to the Columbia Heights residents. These assessments are used to pay the general obligation bonds which paid for the improvements. The water and sewer use charges defray the cost of operation and maintenance of the system. (The sewer rates are not being raised or modified for non- residents at this time.) The average water bi]1 for the thirteen residents using Columbia Heights water projected for 1982 will be approximately $123. The average Fridley water bi71 during the same period should be $69 or a difference of $54. An average sewer and water assessment in Fridley would be about $2,700 for a period of 15 years at 9q interest. This amounts to an equal annua7 principle payment of $180. If the residents invested the total assess- ment at 9%, the annual interest received would be $243. In either case it is more economically beneficial for the residents to continue purchasing their water from Columbia Heights. The cost of continuing to purchase water from Columbia Heights is significantly cheaper for you than tr� have the City of Fridley construct a water and sewer line to service your residence.
