There is a sewer service 73 feet east of the manhole at Camelot and
Arthur. The water service is approximately ten (10) feet east of
the sewer service. The recommended minimum finished floor
elevation is 828.7. The contractor should locate the sewer service
to verify that this elevation will provide sufficient drop based
an the style of construction.
In the past, i have received comments from property owners in this
area regardinq the development of this lot and the effect it will
have on drainage. I�request that the owner provide a sketch
showing proposed elevations and drainage patterns.

Dear Sir:
This letter is on behalf of Mark Nyberg, 1501 Rice Creek Road who is applying for a
building permit to erect a garage on lus property as re%renced above. We were retained
to determine the existing elevations at the centerline and gutterline of Camelot Iake NE
and top of block of the foundation of the garage. The elevations were taken opposite the
center of the garage being constructed. We determined the centerline to be at 890.4T, the
gutterline at 890.03' and the top of block 891.05'. All elevations are referenced to an
elevation of 894.27' being the top nut of a hydrant located at the southwest quadrant of
Camelot Lane NE and Arthur Street. The elevation was supplied by the city engineeri.ng
department.

We received a call from a citizen who was concerned about the gate
openings in your pool fence.
Please recalT that we discussed the fence last November during our
final inspection of your home. During an inspection on Friday,
March 15, 1991, it was noted that there are two gate openings that
are open to the pool area.
We noted in a letter dated November 30, 1990 that a new 6 foot
fence would have to be installed on or before June 15, 1991,
however before the ice in the pool melts this spring, we reguest
that you at least temporarily close-up the two gate openings to
prevent the entrance of small children to the pool area.

pool permits. It was built behind the ho�e located at 1.5Q1 Rice
Creek Road. When the lot was split, the pool ended up in the rear
yard of �he new home built at 1510 Ca�e2ot I.ax�e.
The owner of the new house has added a two foot l�ttice type fenae
to the top of the oid 4 foot ba�ket �eave fe�ce.

This memorandum is in response to your memo dated June 17, 1991
regarding the above subject. You indicate that there was a
private swimming pool constructed at the above address prior to
the time the City required pool permits. It is my understanding
that the subject lot was split and the pool is now on the portion
of the lot which contains a new home. You have also furnished me
with a copy of a letter from the City of Fridley over your
signature dated November 30, 1990. This letter is directed to
Reliable Builders and indicates that one of the conditions for
approval of occupancy is the installation of a six-foot fence
around the swimming pool by June 15, 1991. You ask the question
whether the City can require the owner to build a six-foot fence,
of a design that meets today's policy standards.
This ordinance was adopted pursuant to the police powers of the
City of Fridley. The puxpose of the ordinance is to prevent
children from entering upon the property and falling into the
pool. This ordinance is adopted pursuant to the City's authority
to protect the health, safety, and welfare of the citizens.
McQuilliri on Municipal Corporations, Vol. 7A, a well-recognized
municipal authority, states as follows:
§24.517.05 - Swimming Pools - ''Municipal corporations have
power to regulate swimming pools on private property under
their inherent police power to promote the safety, health and
general welfare of the community, and may prohibit them, at
least where a permit has not been secured. They may regulate
these structures with respect to installation, operation,
maintenance and inspection. Thus, an ordinance requiring the
enclosure of swimming pools with a fence of specified height
and locking gate, including exi:sting pools, to protect
children from being hurt by going into the pools is valid."

While the authority quoted by McQuillin is not from the State of
Minnesota, I believe that it correctly states the authority vested
in the City. I am of the opinion that the City can require
owners of pools, even those constructed before the adoption of
the ordinance, to conform to the requirements of the ordinance.
I would suggest that Chapter 115 be amended to explicity state
that the fencing requirements apply to all pools, both new and
existing.

Dear Mr. Nyberg:
We have just received a memorandum from our City Attorney on his
opinion on how City Code 115 must be enforced as it pertains to
pool fencing. He states that since the fence is to protect the
health, safety and welfare of the citizens, �he City must enforce
the current Code on all existing and/or new pools.
The fence specifications for poals reads, "Fencing or other
effective means including, but not limited to, walls or buildings,
acceptable to the City, shall be provided to positively control
access to public and private residential swimming pools. Fencing
shall meet the following criteria:
A. The fencing shall prevent the entrance of children and be
without hand or foot holds that would enable a person to climb
over it.
B. The fencinq shall be at least six (6) feet high and entrances
shall be equipped with self-closing and self-latching gates
capable of being locked.
C. SeTf-closing and self-latching devices shall be placed at the
top of the gate or otherwise inaccessible to small children.
D The opening between the bottom of the fence and the ground or
other surface shall be not more than four (4) inches.°
Our interpretation of the Cade is that a basket weave fence design
does not meet the intent of the pool fencing specifications since
it does afford hand and foot holds. Therefore you must alter your
existing fence, or remove it and replace it with fencing that meets
the intent of the Code.

You can also resolve this violation by draining the pool completely
and making sure it remains empty. If this is your decision, then
you must maintain a fence (guard rail� of any desiqn that has
openings of no more than six inches, and that ie at ieast 42 inches
hiqh.
I would reco�nmend that you submit to us your proposed fence desiqn
before you commenae the �onstruction of it.
Thi.s work must be comp2eted hy Ju1y 15, 2991 or we will refer this
matter to our Gity Prosecutor for his legal consideration.
