- Dear Mr. Ross:
On or about July 22, ig77, a formal building permit was processed wtth the
City of Frid}ey for construc�ion of a 26' x 26' garage, and a 26' x 26'
house addition. Inclnded on this permit was formal application for a 26'
drivewa�a depression (20' + two, 3' tapers). The cost for the depression
was $305.50 which you paid in futl.
On or about August 2, 1977, in a discussion with Thomas Colbert, Assistant
City Engineer, you indicated that since Central qvenue already has a driwe-
over curb in place, the curb need not be depressed to allow fior your driveway
opening. You requestied the escrowed money �Iready paid, be refunded to you.
ihe City of Fridley refunded the money as per your reqvest, with your assur-
ance that no curb would be removed.
On November 16, 1977, i nottced the curbing at the above mentioned residence
had been removed and replaced. As you know, the City of Fridley's policy
regarding this type of construction on City right-af-way is prohibitedo
Upon close inspection of the curbing invo�ved, it was determined that the
curb does not conform to City standards, for the reasons noted belaw:
1. Concrete curb was nat edged properly.
2. Improper 'finish.
3. Curb varies in hei.ght and width.
4. 3' tapers were not constructed:
Upon receipt of this letter you will have 5 days to comply with a�check for
$3�5•50 for removal and replacement of 26' of concrete curb and gutter. If,
in the time period allotted, the City of Fridley receives no response, are
must assume a negative intent to our request. A negative intent may pro�note
legal proceedings to be justified in order to assure the completion of this
project before December 31, 1g77, a� which time the pre.sent contract covering
this type of construction will elapse. Your prompt attenti.on to this matter
will be appreciated.

On November 16,�1977, I noticed the curbing at the abvve mentioned restdence .
had been remaved �nd replaced. As you know, the City of Eridiey`s polIcy
regarding this type of construction on Cit.y right-of-way is prohibited.
Upan close inspection of the curbing involved, it w,as determined that the ,�
eurb does not conform to City standards, for the reasons noted belcwe: `f�

requires that all residential building contractors, remodelers and roofers obtain a state
license unless they qualify for a specific exemption from the licensing requirements. As

am exempt from the state licensing requirement only if I am not building or improving
this property for purposes of resale. By signing this document, I attest to the fact that I
am improving this house for my own use and do not intend to sell it. I hereby claim to
be exemp# from the state licensing requirements because I am not in the business of
building or remodeling on speculation or for resale and that the house for which I am
applying for this permit, isl the ficst residential structure I have built or improved in the
past 24 months. I also acknowledge that because I do not have a state license, I forfeit
any mechanic's lien rights to which I may otherwise have been entitled under Minn.
Stat. 514.01.
Furthermore, I acknowledge that I may be hiring independent contractors to perform
certain aspects of the construction or improvement of this house and I understand that
some of these contractors may be required to be licensed by the State of Minnesota. I
understand that unlicensed residential contracting, remodeling, and/or roofing activity is
a misdemeanor under Minnesota law, and that I would forFeit my rights to
reimbursement from the Contractor's Recovery Fund in the event that any contra�tors I
hire are unlicensed. .
I have also been informed and acknowledge that by listing myself as the contractor for
this project, I alone will be responsible to the City of Fridley for compliance with all
applicable building codes and city ordinances in connection with the work being
performed on this property.
