ACTION I �NFO.
At the Planning Commission meeting of July 13, 1983, they approved the Ipt Split
at 6061 Cen tral Avenue N.E.
By approving the Lot Split, the portion r�naining is reconfigured in relation to
front and side yard definitions. The exis ting detached garage needs to be removed
to allow the I�ot Split asrd a new double garage provided to the existing dwelling.
This new garage will no�aflre Iocated in the rear yard instead of the side yard and
will therefore require a setback variance fro� 30 feet to 7 feet.
Recommend the City Council approve the rear yard setback variance in conjunction
with the Lot Split and stipulate that the existing detached garage be relnoved and
a new two-car garage be constructed within a designated period.
In addition to the Park Fee of $500 there are pending water and sewer lateral
assessments of $1,877.84 provided for this lot split.
Recoffiend the Park Fee and pend3ceg as�essn��t �e paid prior to filing of the
Certificate of Lat Split.

Seotion 205.073, �C, (1), requires a rear yard depth of not less than 25
pereent of the lot depth, with not less than 25 Peet permitt'ed nor more
than 40 feet required.
Public purpose served by this requirement is to provide rear yard spaee to
be used for green areas which enhanee the neighborhood.
B. STATSD HARDSHIP:
"To line up w3th existing home, the garage has to infringe in back qard.
This is result of a lot split and frontage on a different street."

This reques�t is to reduce the required rear yard setback from the required

REGARDING: Request for Reapproval of L.S. �83-�3, by Leslie Wilke
Attached is a letter requesting reapproval for a Lot Split� L.S. #83-03 that
was approved July 25, 1983.
The lot split Was never.recorded at Anoka County due to Leslie Wilke's
misunderstanding that lot splits must be recorded at Anoka County within 180
days of approval. After 180 days the lot split becomes null and void.
�ro of the three stipulations stated in the City Council Action Taken Notice
have not been initiated. Mr. Wilke has not paid the park fee and has not paid
the water and sewer lateral assessment. The amount of the park fee has
changed from $500 to $750 per lot. The amount of the water and seWer lateral
assessment has changed from $1,877.84 to $2,005.88. Both of these fees do
not have to be paid until a building permit is applied for.
We are asking tbat this request for reapproval of L.S. #83-03 be heard at the
April 7, 1986 City Council meeting.
It Would then be appropriate to address the changes of park f ees and seWer
lateral assessments.

Dear Sirs
First I would like to thank you for the opportunity to
explain my position on the lot split.
Eilclosed is a copy of the letter that the City of Fridley
sent me after it O.K•d the lot split� giving only the
date of September 4� 1984 as the date that I should have
removed my old garage. Which I indeed had done a year
earlier than that date.
The Fark fee had no date as to when it should be paid nor
did the sewer and water fee. I had asked b":r. J. Boardman.
then city planner� when it should be paid. His words given
to me over the counter in City Hall was. I would be crazy
to pay it until I or a builder was ready for a building
permit at which time the Park fee should then be paid.
The Sewer & water fee I was told by RZr. Boardman could
wait until the closing of the house to be built.
At no time thru' the weeks of visiting City Hall about
this lot split, was a�ime limit given to me.
P+ot in my wildest imaginations would I have thought that
a political process would be reversed if I did not act in
a specified period of time.

Ms. Gabel stated that this did co�e before the Planning Commission and the lot split
was granted and the narrow side of the lot is now the front yard so it technically
requires a variance. Mr. Wilke stated he wants to remove the existing qarage and
move it up about 26 ft. and attach it to the house. He said the house was built
before the code. Mr. Clark said it is the only place where the garage can logically
be built. Mr. James Reiland, 6068 Woody Lane N.E., a neighbor behind the new lot,
stated he had no objection. The Co�nission members agreed that there was a definite
hardship and the variance was a housekeeping matter.
