While �here, I was able to veri.fy that there is a trailer on the premises and it is attached to the house. The parking of a trailer for living purposes in a residential axea is a violation of City Code, unless a permit has been granted by our City Council. Therefore, you must either discontinue using the trailer for living purposes and disconnect it from the house, or make application for a permit to cpntinue occupying the trailer. This must be done by November 12, 1974. Also, it is possible you are maintaining more dogs on your premises than licenses have been applied for. Section 302.01, subdivision #10, of the Citlr Code, defines a kennel as, "The keeping of three or more dogs on the same premi.se." Furthermore, a kennel is not a permitted use in a residential area. Fridley, MN 55432 SUBJECT: Hard Surface Driveways Dear Ms. Berger: PW91-135 Enclosed is a copy of Ordinance No. 441 adopted in 1969 and a copy of the current zoning code referring to hard surface driveways. The courts have ruled that paragraph 4 of Ordinance 441 is unenforceable and therefore the City can not require that buildings occupied before adoption of the ordinance have hard surfaced driveways. Should the owner of the building apply for a special use permit, variance request, etc. or in some cases a building permit for alteration or additions, the requirement for a hard surface driveway is made a stipulation for obtaining such a permit. The City from time to time, will bid with the annual Street Construction Project an item for driveway paving. The price is usually less than an individual would�be able to obtain. The City will then inform those residents that do not have hard surfaced driveways of the opportunity to get their driveways paved at a reasonable price. I have also reviewed this issue with the City Attorney. our findings are as follows: 1. The existing buildings are nonconforming in terms of minimum building size required by the R-1 district. A 1,020 square foot minimum size is required. The house closest to Central Avenue is approximately 870 square feet in size, and the house to the rear which is rented by Gary Lenart is 585 square feet. 2. The property is nonconforming because there are two principal buildings on one buildable R-1 lot. 3. I have reviewed the address files and building inspection cards for these properties and have determined that there have been no recent building permits issued for these two homes since the early 1970's. 4. By virtue of creating t�e plat; the nonconformity of two homes on one lot wauld be eliminated. 5. The City Attorney and I discussed whether or not the existing part of the dwelling had to be brought up to code as a result of a permit application for an expansion. The City Attorney is still researching this issue.� 6. If the addition proposed by Gary Lenart is com�leted, th�e home at the rear. of the property will comply with the minimum building square footage (1,485 square feet). 6070 - 6074 Central Avenue N.E. Section 205.04.03.B states: "Nothing in this chapter shall prevent the upgrading of a nonconforming structure to a safe _ condition when said structure is declared unsafe by the City, provided the necessa.ry repairs shall not constitute more than 500 of the fair market value of such structure." First, the City has not declared the rented structure to be unsafe. Second, there is a question as to whether or not the addition constitutes a"necessary repair". Third, by virtue of the addition, nonconformities will be eliminated and a majority of the building will be brought up to code. Given these three conditions, I believe the City would be hard-pressed to deny the building permit based on this section or even force a variance xequest. Renner &�ons exposed and sealed the priva�e wells located at 6070 and 611� Central Avenue. House No. 6074 fed off the same well as 6070. August 11, 1994 Herbst & Sons Construction Company, Inc. demolished and removed rubble from the 6116 Central Avenue property in the morning. On the same day in the afternoon they demolished 6070 and 6074 Central Avenue and removed all but approximately two loads of rubble. The contractor completed the rubble clean up at 6070 and 6074 Central Avenue on August 12 and also completed the necessary hauling in of fill and rough grading of all three sites. The restoration work, including four inch black dirt, mulching and seeding will be performed in September as mandated in the job specifieations. I will inform you when the restoration is complete.
