Darrel and I scaled off the distances using the aerial photos and found the property
to be approximately 850 feet from the hydrant. �
As I have indicated in the attached letter, we�do carry sufficient hose to reach the•
dwelling.
I am reluctant to make any statements as to the adequacy of protection because of
the liability aspects of such statements and their effect on the City.

Status of Existing Homes at 6070 - 6074 Central
Avenue N.E.; Lorraine Nelson Property
As a result of the July 6, 1992 City Council meeting, several
questions were asked regarding the existing dwellings at 6070 - 74
Central Avenue N.E. I have also reviewed this issue with the City
Attorney. Our findings are as follows:
l. The existing buildings are nonconforming in terms of minimum
building size required by the R-1 district. A 1,020 square
foot minimum size is required. The house closest to Central
Avenue is approximately 870 square feet in size, and the house
to the rear which is rented by Gary Lenart is 585 square feet.
2. The property is nonconforming because there are two principal
buildings on one buildable R-1 lot.
3. I have reviewed the address files and building inspection
cards for these properties and have determined that there have
.been no recent building permits issued for these two homes
since the early 1970's. ,
4. By virtue of creating t�e plat, the nonconformity of two homes
on one lot would be eliminated. �
5. The City Attorney and I discussed whether or not the existing
part of the dwelling had to be brought up to code as a result
of a permit application for an expansion. The City Attorney
is still researching this issue.
6. If the addition proposed by Gary Lenart is completed, the home
at the rear of the property will comply with the minimum
building square footage (1,485 square feet).

7. Section 205.04.03.B states: '�Nothing in this chapter shall
prevent the upgrading of a nonconforming structure to a safe
conditi.on when said structure is declared unsafe by the City,
provided the necessary repairs shall not constitute more than
50% of the fair market value of such structure." First, the
City has not declared the rented structure to be unsafe.
Second, there is a question as to whether or not the addition
constitutes a"necessary repair". Third, by virtue of the
addition, nonconformities will be eliminated and a majority
of the building will be�brought up to code. Given these three
conditions, I believe the City would be hard-pressed to deny
the building permit based on this section or even force a
variance request.

as principal(s); that this proposal is made artd submitted without fraud or collusion with any

On August 8, 1994 E.H. R�enner & Sons exposed and sealed the private
wells located at 6070 and 6116 Central Avenue. House No. 6074 fed
off the same well as 6070.
August 11, 1994 Herbst & Sons Construction Company, Inc. demolished
and removed rubble from the 6116 Central Avenue property in the
morning. On the same day in the afternoon they demolished 6070 and
6074 Central Avenue and removed all but approximately two loads of
rubble. The contractor completed the rubble clean up at 6070 and
6074 Central Avenue on August 12 and also completed the necessary
hauling in of fill and rough grading of all three sites.
The restoration work, including four inch black dirt, mulching and
seeding will be performed in September as mandated in the job
specifications.
I will inform you when the restoration is complete.
