Failure to obtain the tentative approval of the Planning Commission (Fridley City Code Section 211.04.02.6.(1). 2. Failure to meet the requirements for correctly specifying existing boundaries, including existing streets and rights-of-way, pursuant to Fridley City Code Section 211.04.C.(1).(a) and (c). 3. Failure to meet the requirements for correctly specifying lot widths pursuant to Fridley City Code Section 211.07.19. 4. On February 25, 1981, the Planning Commission for defendant City of Fridley considered a proposed preliminary plat (P.S. No. 81-02) submitted by Thomas E. Brickner for the subdivision Heather Hills West to replat real properly located at 6175 Central Avenue N.E., Fridley, Nlinnesota, legally described as follows: Lot 1, Block 3, Moore Lake I�'ills Additioq Anoka County, 11Tnnesota. - - -- _ -- -- - - -- _ - - -- - ---- -- - --_-_ - 6. The Planning Commission of defendant City of Fridley unanimously voted to recommend to the City Council approval of the proposed preliminary plat at this meeting. 7. On Apri120, 1981, the City Council for defendant City of Fridley voted unanimously to approve the final plat ofHea.ther I�ills West (P.S. 81-02), subject to the following stipulations: a. The street names be removed from the plat, and the cul-de-sacs renamed in accordance with any requirements of the Police Fire Departments and Post Office. b. The east west access coming off Central specifically not be named Ben Moore Drive, Ben Moore Circle or Ben Moore Court or any reference to Ben Moore. c: Agreement already signed that park fee be collected at time of build.ing permit application. 8. Attached hereto as Extubit A and incorporated herein by reference is a true and coaect representation of the layout and dimensions of said approved plat. 9. The approved plat, attached as Exhibit A, reflects that the street, known as Heather Place, is 50 feet in width, and adjoins aad abuts the real property of plaintiff. 2 10. Pursuant to the instrument of dedication contained vvithin the approved plat, the place and circle known as Heather Place and Heather Circle were donated and dedicated to the public use forever. 11. On May 3, 1982, a plat of Heather I�ills West was filed in the Office of Registraz of Titles in Anoka County, Nfinnesota, as Document No. 120798. 12. Attached hereto as Fxhibit B and incorporated herein by reference is a true and correct representation of the layout and dimensions of the plat currendy on file in the Office of the Registrar of Titles. 13. Attached hereto as Extubit C and incorporated herein by refe,rence aze true and coaect copies of the inskrumern of dedication, aclrnowledgments and certifications contained oa the filed plat. 14. The tra�ct of land 416.82 feet long by 4.00 fe�t wide identified as Outlot B on the filed plat was not created or identified on the final plat approved on Apri120, 1981. 15. On 7anuary 26, 1983, Trustees of the Peoples Church of Columbia Heights, a corporation under the laws of the State of 1Vfinnesota, conveyed by Warranty Deed to Thomas E. Brickner, Trustee of Brickner Builders', Inc., Profit Sharing Trust, filed on February 4, 1983, as Document No. 125187, legally described as follows: Outlots A and B, Heather I�ills West, Anoka County, Minnesota according to the plat thereof on file and of record in the Office of the Registraz of Titles of said Anoka County. Subject to easements, restrictions and reservations of record, if any. 16. That on August 13, 1981, the City Council of defendant City of Fridley passed and adopted by Resolution No. 88-1981, a resolution ordering improvemeats consisting of water mains and services, sanitary sewer laterals and services, and storm sewer and related appurtenances to be 3 � located in Heather Place and Heather Circle in Heather i�lls West pursuant to Water Sazutary Sewer and Storm Sewer Project No. 134. 17. In accordance with the plans and specifications of said Project No. 134, a total of five sanitary sewer and water stubs were placed from the main lines, on and across the pazcel identified as Outlot B and up to the southern boundary line of plaintiff's properiy for the use and benefit of plaintiff. 18. Plaintiff Wortha Jane Skinner, as abutting landowner to Heather Place under the _. . approved plat of April 20, 1981, acquired as appurtenant to her properry all rights, interests, easements, and advantages of an abutting landowner, including, but not limited to, the right of access to Heather Place and the right to conne.ct to sanitary sewer and water. 19. The certification signed by the Mayor and Clerk for defendant City of Fridley contained on the filed plat provides "that on the 18'� day of May, 1981, the City Council of Fridley, Nfinnesota approved this plat." 20. The plat which is on file with the Office of the Registrar was illegally altered after the plat was approved on May 18, 1981, by the City Council, so as to add the description of Outlot B. 21. Outlot B on the filed plat is assessed on the 1987 tax rolls of Anoka County at a market value of One Hundred and No/100's ($100.00) Dollars. 22. Plaintiff Wortha 7ane Skinner has entered into a Purchase Agreement with The Philip Stephen Companies, Inc. ("PSC") whereby PSC has agre.ed to purchase plaintiff's property, contingent upon obtaining certain approvals from the City for a subdivision of approximately seven residential lots to be located on the property. 4 23. PSC has submitted a plat application to the City of Fridley which in all respects complies with the ordinances of the City. 24. On December 8, 1997, the City Council of the City of Fridley wrongfully, arbitrarily, and capriciously denied the plat submitted by PSC. 25. The City's denial of the plat application submitted by PSC was based upon the City's wrongful, unlawful, and arbitrary actions involving the creation and alteration of Outlot B and the City's erroneous interpretation of the actual configuration of Outlot B. �-----_ --- � � � � � ' 11 � I �f! 26. This action is brought pursuant to the provisions of Chapter 555 of1Vlinnesota Statutes known as the Declazatory Judgnent Act for a determination by this court that the land identified as Outlot B, Heather i�ills West, was and is donated and dedicated to the public use forever as Heather Place on the approved plat of April 20,1981, that defendant Brickner relinquished all right, title, and interest in said Outlot B, and that defendants be compelled to execute and record any and all documents necessary to accomplish tlus purpose and correct the filed plat. � �_��� � _;_�l 28. In the altemative, and not by way of limitatioq in the unlikely event it is determined that the pazcel identified as Outlot B on the filed plat was not dedicated and donated to the public use, then plaintiffs seek mandamus to compel defeadant City ofFridley to start condemnation proceedings 5 to acquire Outlot B and/or for damages to the real properiy of plaintiff Wortha Jane Skinner because of the deprivation of plainti�s property rights. The City and/or its employees or agents wrongfully, arbitrarily, and illegally altered the plat of Heather H'ills West after the public heazing on the plat, after the plat was duly acknowledged by the Peoples Church of Columbia Heights and Brickner Builders', Inc., Profit Sharing Trust, and after the plat was approved by the City and acknowledged by the Mayor of the City of Fridley. 34. The alteration of the plat of Heather I�ills West by the City and/or its employees or agents to change the configuration of Outlot B was not duly notarized as required by law and was not made pursuant to a public hearing on the plat applica.tion as required by state law and the City's ordinances. 3 5. The actions of the City of Fridley and the City Council violate plaintiffs' procedural and substantive due process rights, and the alterations to the plat aze illegal and void. For an order of Declazatory Judgment that the parcel of land identified in Exhibit A as Outlot B, Heather I�'ills, West, Anoka County, Minnesota, and as reflected in the plat approved on Apri120, 1981, was duly approved by the City Council and was dedicated to the public use forever, and that defendants be compelled to execute and record any and all documents necessary to accomplish this purpose; - - - - _ - .. - -_ -_ - - 2. For money daznages in an amount in excess of $50,000 for violation of 42 U.S.C. § 1983 and other applicable laws; 3. For reasonable costs and expenses incurred herein, including reasonable attorney, appraisal, and engineering fees incurred herein; and 5. Further, the City of Fridley states that the plat evidencing Outlot B was duly accepted and filed by Anoka County. Further, these answering Defendants deny any characterizations in said paragraph and put Plaintiffs to their strictest proof therein. X. These answerinq Defendants state that Plaintiffs have failed to state a Complaint upon which relief can be granted. XI.
