Councilman Schneider's Inquiry About 6803 Channel
Road N.E.
Councilman Schneider requested clarification regarding our
policies for repairing versus replacing existing windows.
Further, Councilman Schneider wanted to know if what the State
Building Code division told Isaacson was accurate, and was our
new building inspector interpreting the Code too literally.
John Palacio advised Mr. Isaacson that if a window pane was
broken or needed to be replaced, that constitutes a repair such
that a new window meeting the code egress requirements is not
needed. Replacing a window pane does not require a building
permit. Mr. Isaacson, however, is completely replacing the
existing windows and installing new windows. John Palacio, the
Chief Building Official, provided the contractor with copies of
the code requirements (see Mr. Palacio's memo to file). Mr.
Palacio also contacted the State Building Code division and spoke
to Fred Driver. Mr. Driver confirmed Mr. Palacio's
interpretation that new windows must meet the egress
requirements. The windows that the contractor proposed to
install for Mr. Isaacson did not meet the "clear, openable area
requirements." Further, the windows require "special knowledge"
to remove during emergencies. The code requires that egress
windows must not require "special knowledge'� to remove in an
emergency. The proposed windows ��tilt out" and would require
someone to be familiar with how to remove them.
Mr. Palacio has 15 years experience in municipal inspections.

REGARDING: Sash Replacement at b803 Channel Rd NE
Contractor: Biddle Reinodeling
Owner: Stewart Isaacson
An inspection was conducted on site on April 22, 1994. The homeowner was
made aware of window size requirements for rescue purposes. He informed me
that the contractor was going to remove the windows and replace them with
a new sash. It was explained to him that once a window in a bedroom was
removed, the new window would need to meet present day code. Contractor
arrived and I gave him interpretation of window size requirement and he
informed me that other cities are allowing him to install new windows
without meeting the rescue size requirement.
UBC Section 102: The main points and purpose of the code is to provide
minimum standards to safeguard iife or limb, health, property and public
welfare.
UBC Section 104: Application to Existing Building and Structures -
Additians, aiterations or repairs may be made to an existing building
provided it will not cause the existing building or structure to be in
violation of any of the provisians of the code or cause it to become unsafe
or create conditions dangerous to human life.
May 2, 1994: Contractor called and asked if we had reviewed info submitted
by the State. Discussion abaut windows continued and informed him of
Sections 102 and 104 and also to include UBC Section 105 - Alternate
Materials and Methods of Construction.
The provisions of the code are not intended to prevent any material or
method of construction not specifically prescribed by code, provided that
the proposed design is satisfactory and complies with the provisions of the
code, and methods of work offered are for the purpose intended and are at
least the equivalent of the prescribed in the code.
Suitability, effectiveness and safety must be maintained and sufficient
evidence or proof shall be submitted to substantiate any claims that may be
made regarding its use. Contractor at this time has nat submitted any
evidence that the new installation of window sash would meet or be
equivalent to minimum requirements of rescue size windows (5.7 square feet
of clear openable area).
Contractor has chosen not to pursue permit for windaw installation.

the building would be appropriately ciassified as an apartmeni
house as defined in Section 40Z and conform with tfie requi�ements

an interior courtyard that does not open directly to a street or alley,
would the intent of the code be satisfied? The following sketch
shows an example of a design thai has the required egress or rescue
windows opening onto a court that is not directly connected to a
public street, public alley, yard or exit court.

. Section 1204 be available so that rexue can be effected
from the exterior or, alternatively, by one may escape from that
window to the exterior of the building without having to travel
through the building itself. If ihese emergency windows open o�to
an interior court or an atrium which has no access to a public way,

■ We sometimes receive requests to consider special pur-
■ pose windows for compliance as emergency escape or
re�cue windows under Section 1204. Two types require removal of
the sash in order to obtain the required opening size and area. One
kind of windo�v you push to the side and remove the sash. The
other kind of window you pull forward and remove. I would like an
interpretation on both types of windo�vs.
■ The full opening after the windo�v has been removed
■ could be used for the windo�vs you describe, provided
the act of removing the window is no more difficult than would be
required to slide a double-hung or horizontal sliding sash or to
crank turn a casement-[ype window to the open position. The
difficulty involved in removing the sash you describe is not clear
from the information which you provided us. However, as long as
no tools are requ;red and the effort required to remove the sash is
no greater than just described, we are of the opinion that the fuN
opening �vhen the sash is removed could be used.

Stu is ha�iiiy a coititractor perform some maintenance on his home; a new roof,
window re�lacement, etc.
Th is af ternoon, our new bu i 1 c� i ny i nspector (? ) namec� Jo}m was ottt to Stu' s
}iome. Mr. Isacson is planniny on replaciny his older, double h�uiy windows in
his clownstairs bedr•oom with new, more mociern tilt-out windows. He indicates
that the replaceme�,t windoWS will be exactly the same size as the oriyinal
Windows. Apparantly our buildiny inspector told him he could not do this,
si�ice the window i� too small to meet current eyress code. t1r. Isacson
believes that }te was tolc� it wo�ild be OK to yet the old windows repaired �nd�
or modified, bi�t t}iat it was MOT UK to replace them with the newer windows.
Isacson says he talked to the state buildiny department and was told that
what he wants to da is within code. I don't know the city's side of the
story, but if it's as Stu said, our position doesn't m�ke any sense. I know
the sizes haue cha��yed for eyress--but does this me�n you can't chanye a win-
dow, but ynu can f ix it or mociify it? If that's true, that defeats or�e af
our ob ject i ues of improu iny a�id moclern iz iny �roperty .
Isacson was told b� the state (?) that the problem may be that our inspector
is too new--and is iuterpretiny the code to literally. Who is our new buildiny
inspector (or who's handliny it now that Gary leftl? Is he experienceci?
