STIPULATIONS
READ BEFORE SIGNING APPLICATION
A surety bond or certified check in the amount of $ � (5% of value of work to be completed) must
be submitted after approval of application and prior to any work commencing. This bond or check is to ensure
satisfactory performance and compliance with the below stated stipulations. The surety bond or check shall
be kept active until the completion of work andior expiration of permit and can only be released by written
notification of the City after a satisfactory final inspection has been performed by the City.
All access and street frontage of the land alteration site must be controlled by a fence, a minimum of four (4)
feet in height. All entrances must have gates that aze capable of being locked.
Only rock, sand, gravel, dirt, or similar natural earth fill is permitted. No concrete, asphalt, or demolirion
wastes will be pernutted as fill unless a demolition landfill permit is first obtained from Anoka County.
Operations shall be limited to daylight hours and shall not interfere with the health and safety of surrounding
residents and the premises shall be maintained at all times so as not to create a nuisance.

5. Any explosives used must be done so in accordance with Chapter 212, subsections 212.07.SA, .SB, .SC, .SD,
and .SF. of the Fridley City Code and any other applicable standards, e.g. Federal, Sta.te, Industrial, etc.
6. At the end of each season's operations and no later than the last day of December each year; the site is to be
left in a neat and orderly condition, with maximum slopes of 2:1 with no overhang or vertical banks and with
a level bottom.
7. On the Friday of each work week, or when required by the City, material from this operation that is found to
exist on City streets shall be cleaned to the City's satisfaction by the applicant.
8. Upon completion of land alteration operations, th� land must be left according to the plans and contours
submitted with this application and planted with suitable vegetation to prevent erosion.

Upon completion of land alteration operations or expiration of tlus permit, an inspection will be made by the
City of the premises and adjoining streets. Any damage found to have been caused by these operations will
be corrected by the auplicant unon notification by the City.

1. 'I'i� praject shall be in accordance with the plans most recently submitted �and ap�pmved by the
Disuict as part of the record of this project. �
2. Prosicm. coatrol measures shall be ade�uately desig.ped for the site characteristics. ?hey may include
staked haybales, div�rsion channels, sediment poads, or sediment fences. They shall be installed ia
accordaace with "Protectin� Water Ouality in Urban Areas--Best Manap�ement Pt�ctices for
Minnesota." MPCA, Octoher 1989, prior to commeT►cement and �shall be maintained throughout the
project. All exposed soil shall bc stabilize�i as soon as gossible and no later than 14 days after the
completion of the grading. ?he District Iaspector may raquire Permittec to provide additional
erosion control measures beyond those inaluded in the approved plan at his dis�reetion whea site
conditions wan�nt.
3. The soils erosion and sediment controls for the rou�h grading phase of the groject must be installed
prior to aay grading opeiations. The District Lnspe,ctor must be notified when the initial eros�on
controls are installed and prior to any gradi.ng operatyons (763-398-3074).

7. In all cases wh�re the Permittee, by perForming the work authorized by this permit, shall inwlve the
taking, using, or damaging of any properiy rights or interests of any other person or persons, or of
any publi�cly owned lands or improvemeats tberean or interests therein, the Permittee, before
proceeding, shall obtain the written conse�nt of all per�ons, agencies, or authorities conc�rned, aad
shall acquir� all property, rights and intes�ests needed for the work.
8. 'I�us permit is permissive anly. No liability sball be imposed on the RCWD or any of its officers,
ageats, or employees, officially or personally, on account of the gr�mting heseof or on account of any
damage to any person or p�roperty resulting from aay act or omission of the Permittee or any of its
agents, employees, or contractors. ?his permit shall not be construed as estopping or limiting any
legal claims or right of action of aay persoa against the Permittee, its agtnts, employees or
contractors, for any damage or injury resulting &om any such act or omissioa, or as estopputg or
lim.iting any legal claim or right of action of the RCWD against the Permitte.e, its agents, employe�es,
or contractots for violation of or failure to comply with the permit or applicable provisions of law.
9. Any stormwater management facilities approved as part of this permit shall be pmperly maintaincd in
perpetuifiy to assure that they continue to function as originally desig�ned.
10. Within 10 days of project completion, you will notify the District Iaspector at 763-398-3074. Oace
the Inspector vtrifies that site conditions comply with all permit r�quirements, your cash surety will
be returned to the remitter.
