Enclosed herewith is a copy of a letter from Harv°y McPhee,
Health Officer, dated September 3, 1970, with reference to the
condition of the swimming pool at 179-101 Charles Street.
Section 3�.04�3�of the City Code provides that the City Council
ma,y at any time, and with or without a report from the Inspection
Depart�nt, after a hearing held on 10 days notice� and for good
cause.shown and as provided herein, deny a license, suspend a
license, or revoke a license.
If the condition of the swimming pool is as stated in the
letter from Harvey McPhee dated September 3, 1970, I would think
the Council would have sufficient grounds to hold a hearing for
the purpose of suspending or revoking a multiple dwelling license.
I therefore �uggest you write a letter to Nathan Schwartz, owner
of the apartment dwelling, setting forth the fact that complaints
have been received on the swimming pool at the above noted address
and give the owner �t the property sufficient time to remedy the
nu3s�ance, and if it is not remedied within a reasonable time, to
set up a public hearing before the City Council to show cause why
the license should not be suspended or revoked.

The sanftarian has received two complaints on this unused pool this
year from the teaants at 101 Charles.
The pool is about 1/3 full of waCer and was not used this year.
The partially filled pool had an algae bloom a11 summer. The tenants
also complained of the odor. I was not able to definitely establish the
validity of the odor complaint. Last year, Y also had a complaint on
the poor maintenance of this pool.

I received no response fram him.
We have no requirement that a gool must be provided. However, if
it is provided, it shoul.d be maintained to avoid a nuisance. Mr. 5chwart�

It was confirmed by a routine or�site i.nspection on September 9, 1980 that
the abave listed rental property was being maintained in violation o�
Chapter 220, Residential Maintenance Code, of the Fridley City Code.
Although the general coridition of the property was good, the inspection
on the above date found the following list of deficiencies which must be
corrected. Any repairs or i.mprovements must be completed in a worl¢nanship
like manner. It is the City's hope that similar or other deficiencies in
apartznents tha.t were not inspected will be corrected as needed.

l. Provide and maintain striping for the parking lo to designate

On November 3, 1986 it was confirmed by an on-site inspection that the
property at 101 arxi 179 Charles Street does not meet the minim�an standards
necessary to maintain a pleasant an�d prosperous suburban envirorment. While
major o�de requirenents are satisfied, the following item aoes not comply
with the performance star�dards of the City Code:
1. '�e pool in between 101 and 179 Charles Street does not have a fence
around it that is at least 6 feet in heigh�
Zhe pool should be drained or a fence should be pravided that is at least
6 feet in height. �e pool should also be maintained in such a manner
that it does not a�nstitute a health hazarci.
I understand that there may have been sane extenuating circtianstances for this
to have occurred, hawever, your quick action to oorrect this situation would
be a great improvenent for your property and the entire oc�munity as well.
An inspection wi11 be oonducted on or about November 14, 1986 to determine
caapliance.

As per your request, an inspection was conducted August 12, 1994 of
the pool located at 101 Charles Street NE. This inspection was in
response to your question in regard to the pool as to what had to
be done to fill in the pool as it had not been used for several
years. The pool can be filled in after completing the following:
1. Call Gopher State One at 454-0002.
2. Removal of all electrical and water/gas lines.
3. Removal of all concrete structure related to pool (sidewalk).
4. Fill in pool area with clean fill.
5. Compaction of clean fill. �
5. Restore pool area with sod.
6. Restore any damaged boulevard area.
