Councilmembers that Mr. Larry Chevalier had indicated an interest in any Comnission.
He stated Mr. Chevalier called him and has been very interested in becoming more
active in City govermnent. He felt the Council should be aware of Mr. Chevalier's

Mr. Sobiech �tated this request is to allow, on a temporary basis, a house trailer
at the �rtfieast corner of Cheri Lane and 7th Street. He stated the Metropolitan
� Council is currently conducting a contest where builders compete to come up with
Q�. � sane form of ��► �DSt housing.

Mr. Beckler �ha� i�rtdicated he would like to participate in this competition by
displaying onQ of his mobile homes on this site. Mr. Sobiech stated this mobile
home could b� ��7�roaed on a temporary basis, with Council approval.
Councilman �c�h�izl�r questioned for what period of time Mr. Beckler would like
the iicense iss��d. �
Mr. Beckler stated he would like at least 90 days, as he felt if they do well in
the compet�t�an, i�e would like to have the mobile home on the premises for a
short period af time. He explained the mobile home is 26' x 48' with masonite
on the e�cteri�� and the interior is vinyl clad sheetrock with wood windows. He
felt, howev�r, be-Fore he went to the expense of temporarily putting the mobile home
on the sitQ, ��+rould check further into the costs involved and determine if it
would be wor�rhi7e.

this reque5t,

MINNESOTA DEPARTMENT OF PUBLIC SAFETY: ACCEPTING SELECTIVE TRAFFIC ENFORCEMENT
PROGRAM:
Atr. Qureshi stated, in March of this year, a letter was sent to the Deparlment of
Pubiic Safety for the State of Minnesota for the possible funding of a special
traffic enforcement project. He stated the communication from Mr. Novak, dated
Jaly 19, 1977, indicates the State has looked at this proposal favorably a�d are
requesting, if the City wishes to proceed, to make a formal application.
I�r. Qureshi made reference to Mr. Hill's memo dated July 21, 1977 where certain
itens af the proposal are outlined. He stated Mr. Hill makes reference to the
request for five additional police officers, however, the proposed budget does not
ir�lude funding for these positions.
Mr. Qureshi indicated he did not know what resources would be available to the City
firom the State. He requested direction from the Council if they wished to proceed
with the formal application and on what basis; that is, using only existing personnel
and resources or expand on the basis of hiring additional police officers. He

SUBJECT: Temporary House Trailer Permit Application for the
Northeast Corner of Cheri Lane and 7th Street NE
, Attached please find an application for a house trailer license for
the referenced location. It should be noted that the application Is
. made at this time to allow installation of a mobile home at this
� site, on a temporary basis only.
The Metropolitan Council is in the process of having a low cost housing
competition in an attempt to interest builders and potential buyers
in the construction of low and moderate cost housing. It is th
intent of the applicant to display the mobile home on a temporar
basis in order to show that a mobile home is a viable low cost esi-
dence. The City Code does permit mobile homes in all areas of t e
City on a temporary basis only, if a license is approved. Witho t
the license,or on a permanent basis, a mobile home can only be ocated
in an established trailer park.
The only concern the staff would have to the approval of the li ense,
�ould be to properly notify the residents of the area of the te po-
rary permit. This could be handled through written corresponde ce to the
residents in the area stating that the City (or the applicant) ishes to
inform them of what the applicant intends to do and why.
The applicant indicated that installation must be done by August 15th
in order to enter the competition, therefore time is a factor i this
consideration.
It is requested that the Council consider this application at th
�; meeting of July 25th. The applicant will be requested to appeax
the Council to discuss the item.

The City Co�cil of the City of Fridley at the meeting of
July 25, 1977, approved. a t��razy mobile home license for Rsed
Beckler. The trailer is to be located. in the northeast corner
of Cheri Lane and 7th Str�t.
The Metropolitan Council is in the process of corid.ucting a
]�v cost housirig c�npetition in an atte�t to intQxest fauilders
and potential buyers in the construction of low and moderate cost
housing. It is the intent of Mr. Beckler to display a 26' x 48'
mobile h� on a t,emporazy basis,, in order to shaa tha.t a mDbile
home is a viable low cost residence.
The temnorazy license runs until Novemb�r l, 1977, at which
time the Metropolitan Council amp�tition wi.11 be over and the
trailer home must be rc�noved.

RECEIVING PETITION N0. 15-1977--OPPOSING TEM!'ORARY MOBILE HOME LICENSE:
Ms. 14rlene Hartos, 533 Cheri Lane N.E., presented a petition to the Council opposing
the Council's decision on July 25, 1977 when they granted a temporary permit for a
mobile home in their area. She stated they reCeived a letter from the City a day
'` `.� after �he mobile home was on the lot.

Ms. Hartos stated she learned from the Metropolitan Council that this mobile home
will be visited for one day sometime between August 22 and 26 for the purposes of
judging and ihe open house would take place on September 17 and 18. She stated,
after September 17 and 18, a11 competition is finished and felt this license should
' be retracted.

MOTION by Councilman Schneider to receive Petition No. 15-1977 Opposing Temporary
Mobile Home Licens2. Seconded by Councilwoman Kukowski. Upon a voice vote, all voting

Councilwoman Kukowski questioned what percentage of property owners had signed the
petition. Ms. Hartos stated everyone they approached signed the petition; however, not

order at 7:30 p.m. by Mayor Nee.

Councilman Schneider stated, when he was in contact with Pts. Hartos, he had indicated
to her that there was no requirement of a public hearing for issuance of this temporary
license. He stated the information supplied to the Council indicated there was a time
factor involved and he was not aware of the actual date of the competition. He
stated he believed it was Mr. Beckler's intention to remove the structure at the
time the competition ended.
Councilman Schneider read the minutes from the July 25, 1977 meeting regarding this
item.
Ms. Hartos questioned the period of time allowed for the license, which is past the
competition date, and the fact that there will be an open house. Councilman Schneider
stated, if a home was built on the lot, there would also be an open house for the
public.
Ms. Hartos felt the open house for a home on this lot would only be for a short period
of time as homes in the area are not on the market for very long. Ms. Hartos questioned
if it was cortrnon practice to issue a license, even on a temporary basis, without
notifying the res?dents.
Mr. Sob9ech stated they haven't had ihat many temporary trailer licenses issued in
Fridley. The ones issued were mostly for construction or during time of strikes.
He stated, in this particular case, the staff review felt it was only on a temporary
basis and would be removed at an appropriate time.
Ms. Hartos stated, she understands, Mr. Beckler does have a lot in Fridley. Mr. Sobiech
stated Mr. Beckler wanted to show what his product would look like in a single family
residential setting and it could not be shown in this manner in his mobile home sales
lot.
Mayor Nee asked what the residents reaction wauld be to letting Mr. Beckler keep the
mobile home up through the competition and taking it down before the open house.
Mr. Nerrick, City Attorney, felt he would question this action since the permit has
been issued and Mr. Beckler has spent money on the preject. He felt action shouldn't
be taken by Council without having Mr. Beckler present.
Councilman Schneider asked if Ms. Hartos or the residents had contacted Mr. Beckler
directly. Ms. Har�i.os indicated they hadn't, because the license was issued by the
Council.
A gentleman in the audience siated he is concerned primarily with the traffic. He
felt if this temporary permit starts a precedent, it is something the residents
are very much against. He stated the lot has been an eyesore in the area and was glad
to hear Mr. Beckler is providing some improvement to the lot; however, he was concerned
that a precedent might be set for using the lot.
Ms. Hartos voiced concern with the problems�of parking while persons are visiting
the trailer. Ms. Hartos stated they also have the license until November l, 1977 and
it does give them the right to display.
Mr. Sobiech stated no restrictions were placed on the permit issued, only the final
date for removal of the trailer. He suggested a comnunication to Mr. Beckler indicating
the concerns of the residents.
Councilman Schneider questioned if it was possible to put restrictions_on the hours
of display.
Mr. Herrick felt Mr. Beckler should be contacted before any action is taken by the
Council since he has been issued the permit. He stated he would concur with Mr. Sobiech's
idea of having staff contact Mr. Beckler to iet him know the concerns of the neighborhood
and to see if he would agree to some schedule as far as hours.
Mr. Qureshi, City Manager, stated the sfiaff would work with Mr. Beck]er regarding this
problem to see if the impact on the neighborhood can be minimized. Mr. Qureshi also
pointed out that the lot is not a residential lot, but is zoned for multiple use; however,
the use may be limited on the iot because of the size.

Mayor Nee indicated he wished the Council had consulted with the residents before the
temporary license was issued, however, he stated they will try to rectify the problem

i�DR. RICHARD TREZONA - REGARDING TREE REMOVAL:
' Dr. Richard Trezona, 177 Hartman Circle N.E., appeared before the Council regarding
I the billing he received for removal of a diseased tree. Dr. Trezona stated, while
� he was on vacation, a notice was received from the City's Forest Inspector that a
; tree must be removed within 14 days or the City would remove it. He stated, because
he would not be back within this period of time, his son told the City to remove the
tree; and consequently, he has ,received a billing for removal of the tree.
Dr. Trezona stated he doesn't believe he owns the property on which the tree was
; located. He stated �4r. Wyman Smith has mailed a letter to the City Attorney regarding
this matter. He stated, if it is determined that he owns the property, he will pay
the bill.
Mr. Herrick, City Attorney, stated he received a copy of this letter to which
Dr. Trezona is referring and has spent a considerable amount of time researching
the question.
' Mr. Herrick stated the Hartman's originally owned the property to the river. He stated
Mr. 4lyman Smith gave an opinion that he didn't think Dr. Trezona owned the land.
Mr. Herrick stated he has checked with several other attorneys and the attorney
for the County and, while it is a gray area, it is his opinion that Dr. Trezona
does own the land. He stated if a positive answer was desired, it would probably
be necessary to get a court interpretation. He stated the written description and the
drawing on the p]at are somewhat inconsistent; however, it is his opinion that
Dr. Trezona awns the property to the river.
Mayor Nee felt this question could be taken up at the assessment hearing on the
treatment and removal of diseased trees. Mayor Nee apologized for the manner in
which this v�as handled.
Dr. Trezona stated this is insignificant; however, he felt the matter of ownership
should be cleared up. He felt there would also be a lot of other persons along the
river in the same situation. He stated, at this point, he didn't feel the bill
was legitimate and would like the matter of the "gray area" cleared up as to whether
or not it is his property. He stated he a�as told his property went to the judicial
marker and not be,vond.
Mr. Herrick stated it is a fine line and opinions of the attorneys may not necessarily
coincide. He felt, if the Council wanted a definitive answer, the proper way would
be to get a judge and issue an order. He stated the decision comes down to what the
City and property owners want to do. Mr. Herrick felt it doesn't make any sense to
leave a strip of land along the river that was sold as river lots and leave a vacuum.
Dr. Trezona stated the abstract states this property was given to a log and boom
company for ingress and egress for logging. He stated, therefore, this property
was not always Hartman's property. H� stated it shows it belonged to, either by
r�ight of being given as a court order or some other legal manner, a log and boom
company.
Mr. Herrick stated he questioned if it wasn't the right for that company to use
the access.

As discussed with you on August 23rd, it has come to our attention that the
neighbors adjacent to the display home at the intersection of Cheri Lane and
7th Street are concerned with the issuance of a temporary permit for the
display.
A petition was received by the City Council at their August 15th meeting in-
dicating concerns with traffic congestion, signs, landscaping and the time
period that the display home would be located at the site.
You indicated that the traffic should not be a problem since the majority of
the tours of the display home will be on an appointment-only basis, therefore
during these shawings, there shouldn't be more than two or three cars adjacent
to the display home property. It is understood however, that during the two
display dates in September set by the Metropolitan Council as part of the low
cost housing competition, it is a possibility additional cars would be in the
area. Only one sign would be associated with the display. It would be
similar to a typical "For Sale" sign. There would be no banners, pennants etc.
It is anticipated the landscaping would be completed by the end of the week
of August 22nd.
As far as the time period for the display of the home, the permit originally
approved by the Council allows display until November 1, 1977. You indicated
that an attempt will be made to remove the home by October 15th, however, due
to the large investment made in showing the home (approximately $3000 for
moving the home on and off the property and landscaping), you feel that you
would wan� to display as long as there was interest in the home. In any case,
the home would be removed prior to November lst.
Please be advised I will pass on the above information to the Councilman of
the ward and any interested people in the neighborhood. If additional

SUBJECT: Temporary House Tra3ler Permit Application for the
Northeast Corner of Cheri Lane and 7th Street NE
Attached please find an application for a house trailer license for
the referenced location. It should be noted that the application is
made at this time to allow installation of a mobile home at�this
site, on a temporary basis only.
The Metropolitan Council is in the process of having a low cost housing
competition in an attempt to interest builders and potential buyers
in the construction of low and moderate cost housing. It is the
intent of the applicant to display the mobile home on a temporary
basis in order to show that a mobile home is a viable low cost resi-
dence. The City Code does permit mobile homes in all areas of the
City on a temporary basis only, if a license is approved. Without
the license,or on a permanent basis, a mobile home can only be located
in an established trailer park.
The only concern the staff would have to the approval of the license,
would be to properly notify the residents of the area of the tempo-
rary permit. This could be handled through written correspondence to the
residents in the ar�a. stating that the City (or the applicant) wishes to
inform them of what the applicant intends to do and why.
The applicant indicated that installation must be done-by August 15th
in order to enter the competition, therefore time is a factor in this
consideration.
It is requested that the Council consider this application at the
meeting of July 25th. The applicant wi11 be requested to appear before
the Council to discuss the item.

at 7:30 p.m. by Mayor Nee.

winner in this category.
Mr. Beckler stated he has plans to come before the Council to construct a single
iamily hnme on this lot.
� Councilman Schneider questioned his plans for the home and whether it was the same
design as the existing mobile home. Mr. Beckler stated tentative plans are for a three

CONSIDERATION OF FIRST READING OF AN ORDINANCE AMENDING THE FRIDLEY CITY CODE, CNAPTER
901 ENTITLED PENALTIES, SECTION 901.01 AND 901.05 FALSE STATEMENTS:

CONSIDERATION OF A REQUEST FOR A SPECIAL USE PERMIT, SP 77-12, BY NASEEM ANSARI, 7900
IN STREET N.E.:
Mr. Sobiech, Public Works Director, stated this is a request for a special use permit
to atlow a public auto repair center use in an industrial area. The Planning Cormnission
held a public hearing regarding this request and recorranended approval with two stipula-
tions. These stipulations were that all codes, ordinances and other applicable regula-
tions be met and that a space limitation of 15,000 square feet be part of this
reco►renendati o n.
Mr. Sobiech stated this car repair service would utiliae approximately 12,000 square
feet and 3 bays in the Bryant-Franklin building.
Councilman Hamernik questioned the 9,000 - 13,000 square feet as requested on the
application for the special use permit.
�1r. Ansari stated this was in error and should have been for 20,000 square feet.
He stated Mr. Brama has offered him three bays at the present time with a promise,
if the special use permit is approved, they could expand the operation into five
bays.
Councilman Hamernik stated the request on the application was for 9,000 - 13,000 square
feet and didn't understand why the Cort¢nission had put a limit of 15,000 square feet
on this special use permit.
Mr. Ansari explained the owner of the property, Mr. Brama, had to supply some of the
information on the application and he was away at the time and some mistakes were made
in the application form.
Councilman Hamernik questioned, if the special use permit was allowed for 20,000 square
feet as Mr. Ansari requested, if this would pose any traffic problems. Mr. Sobiech
did not feel the traffic would be a problen because of the hours of operation and ample
parking on the site. Mr. Sob9ech also explained that regulations would have to be met
to ensure proper ventilation, sprinkling protection, etc.
Councilman Schneider questioned if the City would require first aid or energency
rescue equipment because of the number of cars in the bays. Mr. SobieCh felt they
would want some of these items available and explained the Fire Department does have
a checklist of itens that would be required.
Counc9l•man Hamernik verified with Mr. Ansari that he would have persnrtnel to operate
any equipment he supplies.
Mr. Brunsell, City Clerk, questioned the disposing of oil. Mr. Ansari stated it would
be collected and sold to a refinery.
Mr. Qureshi, City Manager, questioned if there would be any dismantling of cars
outside the building. Mr. Ansari�stated they would not allow any outside repair work.
Mr. Aldrich, Fire Chief, indicated that flartonable waste traps would be required for
this operation.
� Councilwoman Kukowski questioned if regulations are set up for collecting the oil.
Mr. Aldrich stated something would be worked out in the best interests of the City and

NEW CONSTRUCTION: Single Family Homes and Garages: $4.00/1,000 cubic feet.
PLAN CHECK: 25 percent of building permi� fee.
DRIVEWAY DEPRESSION: (Concrete Curb S*xeets Only)
Alternate A: RemovaZ and replacement of concrete curb and
gutter only; Driveway width plus 6 feet x$14.50
Alternate B: Removal and replacement of concrete curb and
gutter and install a 3 foot wide approach with
6 inch depth; Driveway width plus 6 feet x$17.20

For the purpose of computing fees for building permits, the cubical cantents of any
building or addition, is determined by multiplying the ground area covered from a
point,six (6) inches below the floor line of the basement or the cellar to the
average heights of the upper surface or to the average height of the roof surEace
of the main gable of a pitched roof . �
For repairs or alterations to an existing structure, the fee shall be at the rate
of $3.00 �er each five hundred dollars ($500.00) or fraction thereof in �he cost
of all proposed work.
In�no case shall the fee charged for any permit as set forth in Section 2 be less
than $7.50 plus $.50 state surcharge.

NOTE: Permits for construction will be issued a minimiun of 24 hours from the time
of application to allow for proper review of the pro,posed structure and of the
construction site. �
A Certificate of Survey of the lot, showing the location of the foundation once it
has been constructed will be required before proceeding with the framing.

Dear Mr. Edson:
A recent inspection revealed that two large bushes at the southwest
corner of the above referenced property appear to be creating a
visual obstruction at the intersection of 7th Street and Cheri
Lane. This obstruction extends into what is called the "vision
safety zone" (see enclosed definition) restricting a clear sight
path for motorists at this intersection.
Please take the appropriate action to bring this property into
compliance with the enclosed ordinance. I will be reinspecting on
or shortly after April 17, 1995, at which time compliance is

SUBJECT: Legal Opinion of Residential Exterior Storage Regulations,
Code Section 205.07.06.0
At Councilmember Steve Billings' request, we are seeking a legal opinion regarding the
attached residential exterior storage regulations. The question has arisen specific to a
current code case at 501 Cheri Lane, a comer lot (see attached aerial). It has been
requested that you render an opinion regarding the storage of a large enclosed trailer
currently located in the driveway, accessible from Cheri Lane.
The Cheri lane frontage of 73.3 feet is the smaller of the finro street frontage
measurements and is considered by code to be the front yard. It is stafPs interpretation
that the current location of the trailer is in violation due to its location in the front yard.
Staff believes compliance would be achieved by moving/storing the trailer behind the
front plain of the garage. Councilmember Billings understands and supports staff s
interpretation; however, he has requested that you render a legal opinion specific to this
case. It has also been requested that a general opinion be given to aid in the
interpretation of future exterior storage violations on both standard and comer lots.
As this is a Council request, please have your office review these materials and submit
the r.equested written opinion prior to the February 5. 1998, Council packet deadline.
