Acting Chairman Minish asked Mr. Allen to came forward and present hie
request.
Mr. Steve Allen, of Ailen Construction Company, was present to present the
request. Mr. Allen explained that the addition would be an enlarging of the
present kitchen. The kitchen is now 8 feet by 10 feet, which includes the
setback for the cupboards, and with a table and chairs for a family of four
it is rather crowded. He stated further the proposed addition will increase
the size of the kitchen to 16 feet long by 8 feet wide. The sideyard
variance for this addition would only be an alignment with the preaent
structure.
Pictures of the present house and the two adjacent homes, taken by the
Building Inspector, were shown to the Board. Mr. Allen stated the two
adjacent h�es had completed similar remodeling, and the picturu verified
this statement.
A survey, dated February 10, 1970, showing the house location and the
location of the proposed addition, and also the location of the two adjacent
homes, was presented to the Board for their review. The two adjacent
property owners had signed this survey showing that they had no objections
to the proposed work. Mr. Mittelstadt arrived at 7:45 P.M.
The measurements on the survey verified the house is row setback 34.6 feet
and with the proposed addition the setback vou.ld be 27.6 feet. This would
mean the applicant would need only a 7 foot variance instead of the 8 feet
that he requeated. Mittelstadt pointed this out to the applicant and Mr.
Allen agreed. Mittelstadt also pointed out that since the adjacent neighbors
have already campleted similar remodeling, the proposed addition would be
only 2.6 feet ahead of 4709 Main Street and 2.8 feet ahead of 4701 Main Street.
MOTION by Ahonen to close the public hearing.

Mr. Robert Kullstrom, representing Twin City Apartment Developers, Inc., was
preaent to present the request. He presented plans of the duplex, and a
survey of the lot, showing the proposed dwelling on it,to the Board for their
review. He explained the duplex will face 7th Street with the driveway on
Cheri Laae. They had tried facing the duplex toward Cheri Lane but then the
cars would be backiag out onto 7th Street.
Mr. Roger Axmarkt 532 Highway �100, presented to the Board a petition that
read, "We the Uadessigned Request that this variance be not granted", which
was signed by 12 property owners.
MOTION by Minish to receive the petition.
Seconded by Ahonen. Upon a voice vote, there being no nays, the motian pasaed
uaanimously.
Mr. 6 Mrs. Axmark, Mrs. Agnes Burhite, Mrs. William Remarke, Mrs. Walter Olson .
aad Mrs. Wallace Schwab were in the audience to speak against the proposed
duplex. Their main reasons against it were as followa:
1. The lot is too small for a duplex as it doesn't allow enough yard space
for the children to play i�.
2. Rental people would not keep up the property Like the people in the
neighborhood who own their homes.

Chairman Mittelstadt ncplained the lot was larga eaough to acca�dats a
duplex before part of ttie lot was taken for tha highway.
Miniab asked Ms. Rullstrom if his compan�r had thought of building a aingle
fmnily dwelliag on th� lot.
Mr. Kullatram answered Ehat they felt they would rua iato thn sam� type of
vasiaacea with a single family dwelling.
itYs. Remsrke atated the people who had aigaed the petition against the duplex
'" had said they would not be oppoaed to a single family dwelliag.
There was some discusaioa on the publiahing of the public hearing aotices
in the paper. Chairmaa Mittelstadt explained to tha audieace that since
the naw Zoning Ordiaance was adopted, it was no longer neceasary to publieh
the noticee in the paper. Chai:man Mittelstadt and Harris agr�ed that they
would still like to see the notices published in the paper.

then went over a few of the complaints that the sunouading neighbora had
talked about, aad also.,.tha•.psaibility of building a single family dwelliag
on the land.
MDTION by Minieh to recoa�o�end to the City �Council denial of the requeated
variance8 for the follawing reasoas:
1. There was no hardship showa as a single family dwelling could be�built
on the land which would forstall the objectians of the surrouading
property awners.
2. There were adjacent property awners aud surrouading property awners
that had complaiats and objections to the duplex.
3. The building and detached garagea would be taking up too much of the
lot attd not leaving enough open space for :.he children to play.
Seconded by Ahoaen.
Harris stated he felt the duplex would not fit into the averall neighborhood
aa the neighbors all.have single family dwellings. He also felt that this
ia another case of apot zoning which he is against.

Mr. Bob Naegele aad Mr. Harry Harlmneyer were present to preaeat the request.
Mi. Naegele explained the siga will be located a few feet East of the temporary
sign that is up now. It will be a back to back sign and this i+ould be the
best location to catch the view of both the West bound and East bo�md traffic.
It will be a painted sign with a permaaent message. It will be a free
standing siga without any guide wires and will be illuminated. The total
height of the siga will be 25 feet.
He explaiaed the sign has been tested for wind pressure and it will with-
stand 30 pounds per square feet.
Ahonen asked Mr. Naegele why the sign had to be so large.
Mr. Naegele answered that it was partly because of the amouat of letters to
be ptit on the sign and to make it readable while driving in freeway traffic.
He added further that Mr. Boahwitz, of Plywood Minaeaota, had waated a sign
that told peopl� that h� oold plywood and that thia was the home of PlyNOOd
Minnesota.
Chairman Mittelstadt read, to the Board membere and the applicant, the parts
of the Sign Ordinance that applied ia this case.

Seconded by Harris. Upon a voice vote, there being no nays, the motion
carried unanimously.
Z�OTION by Ahonen to table the request to allow the members to view the size
of the signs in the same area.
The motioa died for lack of a second.
MOTION by Minish to recommend to the City Council approval of the request
for the following reasons:
1. The number of letters that make up the sign make it difficult to keep
the sign within the confines o� the Sign Ordinance.
2. It is located by the freeway and a larger sign is needed to make it
easily readable in fast moving tr�ffic.
3. It will be the same size as the "Welcame to Fridley" siga located on
University Avenue.
4. The petitioner was made awa�e o� the requirements he has to meet a��i
he agreed to them.

as recommended by�the Planning Ccmmission. Seconded by Councilman Sheridan.

MOTION by Counci7.;«an Liebl to receive the Minutes.of the Plaiining Commission
Meeting of March 4, 1970. Seconded by Councilman Sheridan.
The City Engineer pointed out that the Planning Commission p�ssed a resolution
co�cerning making the information contained in the Land Use and Tax Survey
Report available to public use. Councilman Sheridan asked if there should not
be a fee fpr this survey. Councilman Harris said that much time and effort
went into this suryey and suggested a fee of $25.00. Mayor Kirkham said that
he felt that this would be a..fair f�.gure. The City Engineer said that some
infoxmation relating tq legal descriptions. valuations and census data
relative to individual parcels should be taken out.
MOTION AMENDED`by Councilman Ha�ris to direct the Administration to prepare
a summary of the report for public use;and set a.fee of $25.00. Seconded by �
Councilman Sheridan. Upon a voice vote, all voting aye, Mayor Kirkham declarec'!
the a�nendment carried unanimously.

The City Enqinesr explained that this request ia for a variance of fro�tit
yard, rear yard, and lot area requireiuents. The Board of Appeals r.ecoamended
denial. The property is zoned R-3. There was sane land taken fran this pro-
per�y for the development of I. 694, for the 7th Street underpass. The property
is zoned for apart�ments, but is not big er►ough for anything but a duplax.
Mra. Roqer Axinark, 532 High�tay 100 N.E., said that she and Mrs. Willia�s M.
Remarke, 510 Cheri Lane N.E. eaid that they represented some of tbe people rriio
petitioned against the qrantinq of these variances, as it was felt that the
property vcas ta�o �sall for a duplex. -_. • -

property was taken for the street, but they felt that it was atill larqe
enouqh for a double bunqalow. They felt that because of the proper zoniAq,
it should be granted.
Councila�an Liebl asked vhere the people lived that siqned the petition. Mrs.
l�oark said that the �etition was aupposed to be submitted to the City Council.
The n►ajority of the people live along Che�ri Lane. Thsre is ars apartsent
buildinq on 7th Street and the reaidents suffer fram this. She ssid tiiat there
are always cars parked there that create problems in the winter. She said that
they realize that the property is properly zoned, but felt that this is an
example of spot zoning. She said they.did not feel that there-was enoaqh
property to take care of the people that would be living there. Obviously
there is a City Code, and she believed that it should be follawed.
MOTION by Councilman Sheridan to aoncur with the Board of Appeals and c�eny
the request for a double bunqalow for the reasons autlined by the Board.

Fridley" sign. The Board of Appeals recaanmended approval of the requeat sub-

Councilman Liebl asked to see the sign and Mr. Harry Harlaneyer came forward
with the renderinq of the siqn for the Council and the audience to see. He
said that it would be a mansard roof and there would be shrubs and flovzers
below the sign.
MOTION by Counci]man Harris to approve the request for a sign by Plywood
Minnesota, as outlined in the Barard of Appeals Minutes. Tiie motion was
seconded and upon a voice vote, all voting aye, Mayor Kirkham declared the
zaotion carried.
MOTION by Councilman Liebl to rec eive the Minutes of the Board of Appeals
Meeting of March 11, 1970. Seconded by Councilman Breider. Upon a voice vote,
all ayes, Mayor Kirkham declared the motion carried unanunonsly.

The City Enqiaeet:said.that these were the bids for the street project for the
year 1970. When the estimate was figured, they used last years fiqure� and added
on 20$ and they thought that would be high. However, he said that he was sorry
to report that the bids were up 25� over la�t year's bid. Last year the bids
Were let about this same time of the year. Hs said that they were studying to
see if the costs would still stay under the estimate qiven to the public. He
asked that the bids only be received and not awarded at this time aa tthe lo�w
bidder is a new company and he would like some tiune to check on the campany.
Stinaon Boulevard is also included in the City street improvement project and
New Brighton ia holdinq their public hearing March 24th to see if the resi-
dents want the street in, and he would like to wait for that.
MOTION by Councilman Harris to receive the following bids for Street Improve-
ment Prcject St. 1970-1 and Municipal State Aid Street•Improvement Project
St. 197fA-2. Seconded bg Councilman Sheridan. Upon a voice vote, all voting

petitioned against the qranting of these variances, as it was felt that the

�` A Representative of .Twin City Ap�rtrnent Developers-Ino., said.that sane:of the
'property was taken for the street, but they felt that it was still large
enough for a double buz�galow. They felt that because of the proper zoninq,
it should be granted.
Councilman Liebl asked where the people lived that siqned tiie petitian. Mrs.
,. Aa�me� said that thc �et�i.tiom was suppas�ed to be submitted to t.he -City Council.
The major'ity of the people live along Cheri Lane. Th�re is an apartment
building on 7th Street and the residents suffer fran this. She said that there
are always cars parked there that create problems in the winter. She said that
they realize that.the property is properly zoned, but felt that this is an
exaauple of spot zoninq. She said they.did not feel that there.was enouqh�
property to take care of the people that would be living there. Obviously
there is a City Cod.e, and she believed that it should be followed.
MOTION by Councilman Sheridan to concur with the Board of Appeals and c�eny
the request for a double bungalow for the reasons outlined by the Board.
Seconded by Councilman Harris. Upon a voice vote, all votinq aye, Mayor

NOTICE IS HEREBY GIVEN THAT the Board of Appeals of the City of Fridley
will meet in the Council Chamher of the City Hall at 7:30 P.M. on Wednesday,
March 11, 1970 to consider the following matter:
A request for variances of Section 45.063,
Paragraph 4A to reduce the front yard
requirement from 35 feet to 28 feet, Section
45.063,Paragraph 4C to reduce the rear yard
requirement from 25 feet to 10 feet and
