A. PUQLIC PuRPOS� SERVED BY REQUIREMEP�T:
Section 205.07.03, D, l, requires a front yard a�ith a depth of not less
than 35 feet.
Public purpose served by this requirement is to provide adequate open
space around residential structures for aesthetic and fire fighting
purposes. -
Section 205.07.03, D, 2, b, requires a side yard of 5 feet between an
attached accessory building or use and side property lines.
Public purpose served by this requirement is to allo►r for off-street
parking without encroaching on the public right-of-way and also the
aestl�etic consideration.of the n2ighborhood to reduce the building "line
of sight" encroachment into the neighbor's front yard.
6. STATED HARDSHIP:
"I ar� requesting a variance in order to put an addition on my existinq
garage.
lJe need this garage because we have a new driver in the family and have
added a third car. We want to keep the car off the street because we
have had incidents in our neighborhood of damage to cars parked in the

putting an addition on our house and it is more convenient and less

garage will give a more complete appearance to our total yard rather than

chan�ed through no fault of ours. As we did not own the property at the
tine and nothing was said about restrictions when we purchased the house
10 years ago, we feel the circumstances of the garage being too close to
the street as it is now were beyond our control but we do want the
addition to be part of the existing structure. The plans from our builder
call for the existing structure and the addition to have a cor�mon roof
and look to be all one unit.
Thank you. We have obtained letters from both our neighbors to the
east and to the west stating they have no objection to our proposed
addition."

This is a double frontage lot. On the north is I-694 (formerly Higliway
100). This was at one time the lot's access to the street. Later,
Cheri Lane was improved and access to the north was cut off. Residents
started building garages off Cheri Lane at various setbacks (some were
set back 24 feet, while others were as close as 7 feet.
The side yard setback to the garage addition should not ever be adjacent
to another garage because the house to the west has a new attached garage
bel�ind the garage. Therefore, tlie 3 foot setback would neet the building
code.
If the Appeals Commission should approve this request, staff has no
stipulations to suggest.
f•1r. �etzold stated tliere v�ere two letters in the agenda from t1r. Ken Seekon
and �1r. Jar�es Calhoun stating they had no objection to the addition to
i�r. Fisher's garage.
t•tr. Fisher stated he �vas in need of additional storage space. He stated the
siding on the existing garage �vas quite shabby and he would be improvin� the
garage by putting on alur�inum siding and new roofing. Instead of it looking
like an addition, they will move the peak over, with 5/12 pitch. Everything
vaill match the house. He stated he will then tear the old shed down, and he
felt tl�is v�ould be a definite improvenent to his property.

Dr. Vos stated that in looking at the Tocation and how the property was
squaslied fror� both sides by I-694 and Cheri Lane, he felt this was a legitinate
request for a variance. If the garage aras noved to the east, it v�ould block
tl�e house, and the garage was blockin� enough of the house already. There was
a legitimate hardship for this variance because of the road beinq blocked off
from tlie north.
�a t1r. Qarna s±ated since the code addressed liaving larger garages, it woulci
_ ir�ipose a hardship on the petitioner to require him to move the garage closer
to the house fartlier away fron tl�e lot line, so he I�ad no probleM with grantina
the front yard and side yard setback variances.
�•1s. Savage agreed. She stated she had no problem with the variances as
requested.
t1r. Qetzold also agreed, lie stated this was a unique neighhorhood.

Section 205.07.03, D, 1, requires a front yard with a depth of not less
than 35 fe�t.
Public purpose served by this requireaent is to prov ide adequate open
sp�ace around residential structures for aesthetic and fire fighting
purposes.
Section 205.07.03, D, 2, b, requires a side yard of 5 feet between an
attached accessory building or use and side property lines.
Public purp�se servec7 by this requir�nent is to allow for off-street
parking without encroac:hing on the public right-of-way and also the
aesthetic wnsideration of the neighborhood to reoluce the building
"line of sight" encroachment into the neighbor's front yarcl.

C. AIi�IINIS�TIVE Sl'AF'F REYIEW:
This is a double frontac�ee lot. On the north is I-694 (formerly Hwy.
100). This was at one ti� the lot's access to the street. Later,
Cheri Lane was impraved and access to the north was cut off. RQSidents
started building garages off of Cheri Lane at various setb�acks (some
were set back 24 feet, while others were as close as 7 feet).
The side yard setback to the garage addition shoulcl not ever be
adjacent to another garage because the house to the west has a new
attached garage behind the garage. Therefore, the 3 foot setback would
meet the building oode.
If the Appeals Commi.ssion should approve this request, staff has no
stipulati.ons to suggest.

To Whom It May Concern,
I am requesting a variance in order to put an addition on my
existing garage.
We need this garage because we have a new driver in the family
and have added a third car. We want to keep the car off the street
because we have had incidents in our neighborhood of damage to cars
parked in the street. We will also have a fourth driver within 12
years which will mean parking space wi11 be at a premimum. We are
also in the process of put�ing an addition on our house and it is
more convenient and less expensive to have the garage done at the
same time.
We also have need of extra storage space beeause of pool
supplies and deck furniture, bikes and yard equipment. We feel
that the additional garage will give a more complete app�a�nce to
our total yard rather than a storage shed.
�e feel that we should be allowed to build the addition to the
garage next to the existing structure because when the house was
built 694 was not there. As a result of the new highway the lay of
our house was changed through no fault of ours. As we did not own
the property at the time and nothing was said about restrictions when
we purchased the house 10 years ago we feel the circvmstances of the
garage being to close to the street as it is now were beyond our
control but we do want the addition to be a part of the existing
structure. The plans from our builder call for the existing struct-
ure and the addition to have a common roof and look to be all one
unit.
Thank you. We have obtained letters from both our neighbors to
the east and to the west stating that they have no objection to our
proposed addition.
