On August 13, 2003, the Fridley Appeals Commission officially approved a request for variance,
VAR #03-18, to allow the construction of a new accessory structure in the front yard (new
accessory structure will replace the existing structure) on Lot 8, Block 1, Murdix Park, generally
located at 573 Cheri Lane NE, with the following stipulations:
1. The proposed structure shall be set back five feet from the side yard property line.
2. The petitioner shall obtain all necessary building permits prior to construction.
3. The structure shall not be used for a home occupation or_living area.
4. All vehicles shall be stored on a hard surface as approved by the City.
5. The garage shall be architecturally compatible with the existing home and finished with
complementary siding and color scheme. '
You have one year from the date of the Appeals Commission action to initiate construction. If
you cannot begin construction during this time, you must submit a letter requesting an

Mr. Paul Bolin, Planning Coordinator, stated the petitioner, Brian Born, is requesting a
variance to allow the construction of a new accessory structure in the front yard of his
residence at 573 Cheri Lane. The new accessory structure will be replacing the existing
garage. Mr. Bolin showed a view of the property and showed that the rear of the home
faces the street.
Mr. Bolin stated a summary of the petitioner's hardship states that Mr. Born's house
faced Hwy 100, now I-694, when originally built, the garage was built behind it so it faces
the alleyway. A freeway wall was then built and the alley became the only entrance to
the lot. The alley eventually became Cheri Lane.

Mr. Bolin stated the property is zoned R-1, single-family, as are ail the surrounding
properties. The home actually faces and is squared up to the I-694 sound wall. Cheri
Lane borders the property on the south side. City Code states that accessory buildings
need to be located in the side or rear yard; therefore the petitioner is applying for this
variance so the structure can continue to be located in the defined front yard. Replacing
the garage in this location would be consistent with all the other homes on the north side
of Cheri Lane.
Mr. Bolin stated City staff has received no comments from any of the neighboring
property owners. This variance is within previously granted dimensions; therefore, staff
has no recommendation. A variance for the front yard was approved in 2002 for a lot
along Logan Parkway and in 1999 for a home that fronted on the river along Riverview
Terrace. Staff recommends that if the variance is granted, the following stipulations be
attached:
1. The propo�ed ��a-�cture shall _be set, back fi�re feet from 1he, side yard property
line.
2. The petitioner shall obtain all necessary building permits prior to construction.
3. The structure shall not be used for a home occupation or living area.
4. All vehicles shall be stored on a hard surFace as approved by the City.

Mr. Bolin gave the Commission, for their review, a survey done of the site. He stated the
proposed garage will be set back comparably to the neighboring garages. The survey
showed that the garage would be set back three feet from the property line, but it is
stipulated that the garage be set back five feet so that it complies with the City side yard
setback requirement.
Mr. Kuechle asked Mr. Bolin to explain the five-foot setback versus the three-foot
setback.
Mr. Bolin explained that the setback can be three feet if the garage is located in the rear
yard. If the garage is directly to the side of the home, it would need a five-foot setback.
If the garage is located entirely behind the home, then it can be three feet from the
property line. The side or front yard setback is five feet. The five-foot setback is

The petitioner, Brian Born, 573 Cheri Lane, said he had nothing to add to Mr. Bolin's
presentation.
Ms. Jackson asked the petitioner if he would be able to move the garage over two feet.
Mr. Born stated that he could move it over two feet.
Mr. Zinter asked if the neighbor from the east would have any problems with the garage,
because that neighbor would be the most affected.
Mr. Born said the neighbor to the east has no problems with his request.
MOTION made by Mr. Jones, seconded by Mr. Zinter, to close the public hearing.

REQUEST
Petitioner, Brian Born is seeking a variance to allow the construction of a new
accessory structure in the front yard of his residence at 573 Cheri Lane. The proposed
accessory structure will replace their existing garage.
ANALYSIS AND CODE REQUIREMENTS
The property is zoned R-1 Single Family and is located on Cheri Lane, east of 7th
Street. The existing home was built in 1964 and the existing detached garage was built
in 1965. As was stated in the petitioner's hardship letter, the original home was built
facing Hwy 100, which is now Interstate 694. The existing detached garage was then
built south off the home, facing the alley, which is now Cheri Lane. When Hwy 100
became Interstate 694, access from Interstate 694 was cut off, leaving Cheri Lane as
the only way to receive access for the property owners.

City Code states that accessory buildings must be located in the side or rear yard only.
Due to the way the home and garage were originally constructed facing Hwy 100
(Interstate 694), the petitioners are seeking a variance to allow an accessory structure
in the front yard. This new structure will replace the existing garage. Replacing a new
garage in this area wouldn't be atypical for this neighborhood as all the homes on this
side of Cheri Lane have a similar situation.

The existing structure is 400 square feet and the proposed structure is 960 square feet,
therefore the size of the structure will be increased by 560 square feet. The proposed
structure meets lot coverage. The petitioners plan to use the structure for vehicle
parking and storage. City staff has received no comments from neighboring property
owners.

The roof will be at a 5/12 pitch (same as the house and neighboring homes
and garages} and the elevation will be 12'6" at the midpoint of the slope.
The Garage will be constructed of 2x4, 2x6 etc. lumber, along with
plywood, Z dual pane sliding windows, insulated steel access door, one 16'
insulated and one 8' insulated garage door, 25 year fiberglass shingles, vinyl
siding (typical modern cunstruction materials).
The driveway, garage floor and footing will be made of cement reinforced
with 1/2" steel rebar. The footing will be 12" with a single row of block. The
Garage floor will be 5" and the driveway will be 4".
