Dear Mr. & Mrs. Peabody:
On December 17, 2001, the Fridley City Council officially approved your request for a Special Use
Permit, SP #01-13, to build a home in a Flood Fringe District. Permit is specifically required for
homes proposed to be elevated, but not built on fill, generally located at 608 Cheryl Street.
Approval of this special use permit is contingent upon the following stipulations:
1. Prior to submittal of building plans, all structural and soil engineering shall be
reviewed and approved by a structural engineer.
2. All necessary permits shall be obtained from the City prior to construction.
3. Siding and landscaping shall be used to minimize the impact of flood-proofing
materials.
4. The petitioner shall submit an elevation certificate as part of a verifying survey prior
to the foundation being capped, which shall verify that the minimum first floor
elevation is 823.9 feet.
5. The petitioner shall flood-proof the garage in accordance with current Federal and
State flood-proofing requirements to the minimum of the 100-year flood elevation.
6. Planter boxes shall be installed at least 4 feet from the home on both the east and
west sides. They shall be reviewed and approved by city staff prior to issuance of
any building permits.
7. The petitioner shall submit new grading and drainage plans integrating the planter
boxes into the landscape areas on the east and west sides of the home.
8. The verifying survey shall confirm stipulation #7. (Note to Surveyor: hydrant
elevation has changed since 1994, verify elevation)
9. Erosion control measures shall be installed along all lot lines prior to any work done
on site.
10. The petitioner shall execute and record against the property a hold harmless
agreement releasing the Ciry from liability if damage occurs as a result of flooding.
11. The petitioner shall agree to preserve mature trees to the extent possible. All trees
required to be removed for the new home shall be marked and approved by city staff
prior to issuance of building permits.
12. The height of the structure shall not exceed 30 feet as measured from the top of
curb elevation.
13. Special Use Permit approval is dependent upon approval of Variance #01-15.

Ms. Stromberg stated the petitioners are seeking a variance to reduce the minimum floor area of
a split entry design home from 768 square feet to 492 square feet to construct a new home at
608 Cheryl Street.
Ms. Stromberg read the petitioners' hardship summary: "We the petitioners are proposing to
build a primary residential home at 608 Cheryl Street. This lot has special circumstances since
we will be building in a one percent (1 %) chance flood plain and need to make special
requirements. We need a variance approved to build each level less than 768 square feet
guidelines. Our current proposed structure has four levels, each of which is 492 to 495 square
feet. This design we are proposing will allow us to build according to FEMA 1972 addition
standards (the fill needs to extend a minimum of 15 feet from the structure), preserve all but one
of the beautiful, mature trees on our lot, place the home in the area the neighborhood was most
satisfied with, and avoid drainage problems into our neighbor's yard."

Ms. Stromberg stated that the parcel is located at Broad Avenue and Cheryl Street. It is zoned
R-1, as are all surrounding properties. It meets code requirements for a minimum lot size of
9,000 square feet at 9,350 square feet. It meets City Code requirements for minimum lot width
of 75 feet at 85 feet: The home also meets setback and lot coverage requirements. FEMA
regulatior�s limit the design of the home, and the Citjr Code do�s nat..address..square footage:
requirements for four level homes. In essence, #he petitioners are requesting a: variance due to�
the City's Code inability�to recognize square footage dimensions on split levels other than_a two-
level split foyer design. The front elevation will be facing Broad Avenue and the tuck-under
garage would be accessed from Cheryl Street. If the Appeals Commission grants this variance,
staff would ask that the Commission recommend that the City Council direct staff to modify this
section of the code to clarify square footage dimensions based on modem floor plan designs.
Staff recommends approval as there are unique circumstances found on this property.
Mr. Kuechle asked for more information on the code requirements for the square footage
ordiraa�ce. T� f_ootprint of.the house is roughly 42 by 25, which is well over the square footage
area.
Ms. Stromberg stated that the code does not address three or four-level split designs. It only
specifies finro levels needing to be 768 square feet per level. This four level design would not
meet those requirements. Staff is asking Council and Commission to give direction to clarify the
code to recognize modern floor plans.
Ms. Anna Peabody, petitioner, stated that the reason for the variance is because the tuck-under
garage is half of 1,000 square feet. The next level is the other half which is 20 by 25 square
feet, and the staggering levels create the different square footage. As soon as one level is put a
little above another, some cities consider it a separate level. They are separate levels and
staggered, and each level is about 492-495 square feet.
Dr. Vos stated that the footprint is greater than 495 feet. The garage and wherever you step up
still has to have foundations.
Ms. Peabody stated that the step up from the garage is on top of a crawl space and is about half
of the footprint of the house. Then you walk up to the next level and so forth. That is finro levels
above the garage and two levels on the other side.
Mr. Zinter asked why the Code states it should be 768 square feet. Is it a cost issue or safety
issue? -- - -
Ms. Stromberg stated that this part of the code was written in the 1960s and was a standard of
square footage for two story homes.
Mr. Kuechle stated that the goal was to keep the standards of homes in Fridley up rather than
ending up with a lot of small homes.
Mr. Zinter stated that there was a permit in 1994.
Ms. Peabody stated they deviated from the permit because they would have had a house which
was not up to code. It would have been too small at 960 square feet. -Also, it would have been
on six feet of fill which did not allow for controlling the drainage. That was not the wisest thing to
do, so they waited and came back with a better plan.

Mr. Zinter asked if there were special landscaping issues with this.
Ms. Stromberg stated that was being addressed with their special use permit because they are
building in the flood fringe district. The special use permit was reviewed last week with the
Planning Commission and still needs to be approved by the City Council on December 17,
2001. Planter boxes will be put in front of the home to minimize the height of the home on the
neighborhood. -
MOTION by Mr. Zinter, seconded by Dr. Vos, to close the public hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE
MOTION CARRIED AND THE PUBLIC HEARING WAS CLOSED AT 7:50 P.M.
Dr. Vos stated that the zoning code has not kept up with modem construction. It is wise to get a
variance rather than just to go ahead and do the project. He would vote for apprQVal because
the footprints seem to be reasonable.
Mr. Kuechle stated he concurred. He believed the petitioners have met the spirit of the code
requirements, and the footprint would still be well over the limit with completely level floors. He
would vote for approval.
Mr. Zinter stated that it is adaptable for the area and is a sound floor plan.
MOTION by Dr. Vos, seconded by Mr. Zinter, to approve VAR #01-15 with the following
stipulation::
1. Variance approval is dependent upon approval of Special Use Permit, SP #01-13.

Dr. Vos asked if there was anything the Commission needs to do about recommending that City
staff look at the zoning code regarding square footage.
Ms. Stromberg stated that if the Appeals Commission recommends that this issue be brought to
the City Council for changing, a zoning text amendment would need to be made to the R-1
zoning district.
MOTION by Dr. Vos, seconded by Mr. Zinter, to recommend that City Council approve a
request that City staff look at City Code, Section 205.07.04, to make it more appropriate for
current building construction.

REQUEST
Petitioners, Troy and Anna Peabody are request�ng a variance to reduce the minimum
floor area of a split entry design home from 768 �quare feet to 492 square feet to allow
the construction of a new home at 608 Cheryl St�eet.
ANALYSIS
The vacant parcel is located on the comer of Ch�ryl Street and Broad Avenue. It is
zoned R-1, Single Family as are all adjacent pro�erties. The property meets city code
requirements for lot size and width as the lot is 9�350 square feet and is 85 feet wide.
The petitioner has stated that they intend to keep the location of the home primarily in
the same location as was submitted in the 1994 $urvey. The northeast corner would
remain the same, with the south wall of the struc�ure six inches shorter and the west
wall one foot longer. The proposed home will als;o meet lot coverage and setback
requirements.
Ordinance #1056 states that a special use permit imay be issued to construct a home
using alterative elevation methods, such as a tuck under garage as in this case,
provided that all living space is located at an elev�tion above flood level. These
altemative methods must be designed and certifi�d by a registered engineer or
architect as being in compliance with applicable b�ilding codes, including federal
standards for flooding. The petitioners' special us�e permit was approved by the

Planning Commission on December 5, 2001 and will go to the City Council on
December 17, 2001.
Due to FEMA regulations, the petitioners are limited to the design of their home. They
are asking to construct a four level, which has 492-495 square feet per level. City Code
section 205.07.4.B. (1) ((d)) states that two (2) level dwelling units of the split entry
design of three (3) bedrooms or less shall have a minimum of 768 square feet of gross
floor area in each level. The City Code does not address square footage requirements
for four level homes, so in essence the petitioner5s are asking for a variance to the City
Codes' inability to recognize square footage dim�nsions on split levels other than two
level split foyer designs. If the Appeals Commission grants this variance, City Staff
would ask that they recommend that the City Co�ncil direct staff to modify this section
of the City Code to clarify square foot dimension� based on modern floor plan designs.
City staff has received no comments from neighboring property owners.

Ms. Stromberg stated that the parc-�l is-located at Broad Avenue and Cheryl Street. It is zoned
R-1, as are all surrounding properties: It meets code requirements for a minimum lot size of
9,000 square feet at 9,350 square fee�. Ft meets City Code requirements for minimum lot width
of 75 feet at 85 feet. The home also meets setback and lot coverage requirements. FEMA
regulations limit the design of the home, and the City Code does not address square footage
requirements for four level homes. In essence, the petitioners are requesting a variance due to
the City's Code inability to recognize square footage dimensions on split levels other than a two-
level split foyer design. The front elevation will be facing Broad Avenue and the tuck-under
garage would be accessed fcom Cheryl Street. If the Appeals Commission grants this variance,
staff would ask that the Commission recommend that the City Council direct staff to modify this
section of the code to clarify square footage dimensions based on modem floor plan designs.
Staff recommends approval as there are unique circumstances found on this property.
Mr. Kuechle asked for more information on the code requirements for the square footage
ordinance. The footprint of the house is roughly 42 by 25, which is well over the square footage
area.
Ms. Stromberg stated that the code does not address three or four-level split designs. It only
specifies two levels needing to be 768 square feet per level. This four level design would not
meet those requirements. Staff is asking Council and Commission to give direction to clarify the
code to recognize modern floor plans.
Ms. Anna Peabody, petitioner, stated that the reason for the variance is because the tuck-under
garage is half of 1,000 square feet. The next level is the other half which is 20 by 25 square
feet, and the staggering levels create the different square footage. As soon as one level is put a
little above another, some cities consider it a separate level. They are separate levels and
staggered, and each level is about 492-495 square feet.
Dr. Vos stated that the footprint is greater than 495 feet. The garage and wherever you step up
still has to have foundations. .
Ms. Peabody•stated that the step up from the garage is on top of a crawl space and is about half
of the footprint of the house. Then you walk up to the next level and so forth. That is two levels
above the garage and two levels on the other side.
Mr. Zinter asked why the Code states it should be 768 square feet. Is it a cost issue or safety
issue?
Ms. Stromberg stated that this part of the code was written in the 1960s and was a standard of
square footage for two story homes.
Mr. Kuechle stated that the goal was to keep the standards of homes in Fridley up rather than
ending up with a lot of small homes.
Mr. Zinter stated that there was a permit in 1994.
Ms. Peabody stated they deviated from the permit because they would have had a house which
was not up to code. It would have been too small at 960 square feet. Also, it would have been
on six feet of fi�l which did not allow for controlling the drainage. That was not the wisest thing to
do, so they waited and came back with a better plan.

Ms. Stromberg stated the December 29, 2001, and January 9, 2002, meetings have been
canceled because of no variance requests.
Mr. Kuechle asked if she had the number of building permits issued for residential for the past
year in Fridley.

Dear City of Fridley:
We. the petitioners, are proposing to build a primary reside�tial home on 608 Cheryl Street N.E. This lot
has special circumstances since we will be building in a 1% chance floodplain and need to meet special
requirements. The building is a multi-leve139'6" x 25' structau�e with an attached garage and will have
appro�cimately 1800 sq. ft. of finished living space when it is completed.
We need a variance approved to build each level less than the 768 sq. ft. guideline (205.07.04). Our current
proposed strucUue has four levels, each of which are 492 - 4,'95 sq. ft. This design we are proposing will
allow us to; build according to the FEMA 1972 Addition Standazds (the fill needs to extend a minimum of
15' from the structure), presen+e all but one of the beautiful, nnature trees on our lot, place the home in the
area the neighborhood was most satisfied with, and avoid drainage problems into our neighbor's yards.
We have enclosed a preliminary site plan, the proposed 1994 site plan, the soil imrings, specifications for
the soil work and footings, a full set and two 8 1/2" x 11" sebs of house plans, and a location map. Please

The Appea�ls Commission is given the power to review vcaicmce requests. The Laws of Minnesota
have griven the Appeals Commission the following responsibilities:
1. To hear cmd decide appeads where it is cicdmed that there is a mistccke in cmy order,
requirement, decision, or deternaination made by a City Official in enforcing the zoning
ordincmce.
2. To he�a� vcuicmce requests where strict enforcement of the code would cause undue
haa�dship because of conditions unique to the properly, cmd to grcmt these requests when it
is shown that the grQnting of the vcaiamce w�l be in keeping with the intent of the ordincmce.
What is undue hc�dship?
Undue hardshiv is defined by the law as:
1. The property ccmnot be put to reasonuble use if used under the requirements of the code.
2. The need for the vaa•icmce is due to the conditions unique to the property �d not created
by actions of the lmldowner.
3. The varicmce, if grcmted, will not Qlter the chcQacter of the neighborhood.
Money alone shclll not constitute a hcudship if rearsonuble use of the�property exits under the
requirements of the code. The appliccmt should review all possible alternatives which would meet
the code requirements prior to applying for a varicmce. Wi�h a sufficient hcQdship statement from
the appliccant, the smallest possible vcuicmce should be requested.

SIGN VARIANCE CONDITIONS
For Sign Variances, per Section 214.21.02 of the City Code, it is the responsibility of
the applicant to prove:
A. That there are exceptional or extraordinary circumstances applicable to the property
or to the intended use that do not apply generally to other property in the same
vicinity and district.
B. That the variance is necessary for the preservation and enjoyment of a substantial
property right possessed by other property in the same vicinity and district; but
which is denied the property in question.
C. That the strict application of this Chapter would canstitute an unnecessary hardship.
D. That the granting of the variance would not be materially detrimental to the public
health, safety, or general welfare or detrimental to the property in the vicinity or
district in which the property is located.
