ADMINISTRATIVE STAFF REPORT

A. PUBLIC PURPOSE SERVED BY REQUIREMENT:
Section 205.053, 4B, requires a minimum side yard setback of
10 feet for living area.
Public purpose served by this requirement is to maintain a
minimum of 20 feet between living ar��s in adjacent structures
and 15 feet between garage and living'area in adjacent structures
to reduce exposure to conflagration of fire. It also all.ows
for aesthetically pleasing open areas around residential structures.
B. STATED HARDSHIP:
. Verification survey necessary �o obtain a bui�ding perinit for
this addition shows that the house is sitting crooked on the
lot. The plans had to be drawn up to meet construction in the
flood plain, and were approved by the Planning Corunission and
City Council and the Department of Natural Resources. It would
be costly and very time consuming t� change the plans now because
, of a two foot variance.

The pe�itioner's house is presently 32,31 feet from their east
lot line. There proposed addition o� 25 feet would result�in
a side yard setback of 7.31 feet. The neighbor's home to the

areas. Since r.iore than 20 feet will exist between the strucures,
the staff have no stipulations to suggest if this request is

Mr. Qureshi, City Manager, stated this house is located in the flood plain
area and the �lanning Commission has recom�ended approval of the special
use permit to a11ow the addition with the stipulation that the electrical
services be 2 feet above the flood plain level (100 year flood elevation).
MOTION by Councilman Fitzpatrick to concur Hiith the recommendation of the
Planning Commission and grant SP #79-12 with the stipulation that the

elevation). Seconded by Councilwoman htoses. Upon a voice vote, all voting
aye, Mayor Nee declared the motion carried unanimously.
CONSIDERATION OF LOT SPLIT REQUEST, LS �79-08, BY GRAND W. PASCHKE,
7150 COMMERCE CIRCLE WEST AND 200 COMMERCE CIRCLE SOUTH:
Mr. Qureshi, City Manager, stated this lot split request was to correct a
surveyor's error and the Planning Commission has recommended approval.
MOTIOy by Coun�ilwoman Moses to concur with the recorrunendation of the
Planning Commission and approve LS #79-08. Seconded by Councilman Schneider.
Upon a voice vote, all voting aye, Mayor�Nee declared the motion carried
unanimously.

RECEIVING THE MINUTES.OF THE POLICE CIVIL SERVICE COMMISSION MEETING OF
NOVEMBER 27, 1979:
MOTIGN by Councilman Barnette to receive the minutes. Seconded by Councilman
Schneider. Upon a voice vote, all voting aye, Mayor Nee declared the motion
carried unanimously. '
Mr. Jim Hill, Public Safety Director, reported on the new recruitment system
for police officers. He stated they are pleased they have a validated system
and stated the candidates completed the written exams and agility tests and
the oral interviews are now in process. He stated the candidates will also
have a medical exam, psychological screening, and a background check. Mr.
Hill stated, out of the top 18 candidates, 7 are female. He stated they hoped
to have an eligibility list by January.
I CONSIDERATIO(J OF BENEFIT INCREASE FOR FRIDLEY FIRE RELIEF ASSOCIATION:

Mr. Charles McKusick, President of the Fridley Volunteer Firefighter's
Relief Association, appeared before the Council regarding ratification of
the Fire Department Relief Association retirement benefit increase.

Mr. McKusick stated the Volunteer Firefighter's Relief Association Member-
ship approved an increase of its base service pension from $160 to $192 per
month, effective January 1, 1980 and.requested ratification by the Council.
He stated the 9ncrease has been studied by their actuary and this increase
can be made without any unfunded liability and will not require any tax sup-
port and the pension fund will continue to be fully fu��ded.
Mayor Nee stated he was a member of this Board and went through the process, ttt
and it seems the members have been very conservative in their claim for the I
benefits and this seems to be a very reasonable proposal. j
MOTION by Councilman Fitzpatrick to concur and grant the request of the
Fridley Volunteer Firefighter's Relief Association to increase its base
service pension from $160 to $192 per month effective January 1, 1980.
Seconded by Councilman Schneider. Upon a•voice vote, all voting aye, Mayor
Nee declared the motion carr.ied unanimously.
CONSIDERATION OF SIGN PLAN FOR 6440 UNIVERSITY AVENUE, J& S INVESTMENTS:
Mr. Boardman, City Planner, stated there is an existing canopy which the
owners wish to use as a sign base for the property at 6440 University Avenue.
Mr. Boardman stated staff has made recommendations regarding the sign plan
and these have been agreed upon by the owner and should be included as part
of the approval of the sign plan. The recommendations are as follows:
1. That all signs shall be 4 feet in height and should be located in a
straight line at a height of 3 feet above the existing canopy.
2. The length of the sign should be regulated by the allowable square
footage for the sign as allowed under the present sign code, provided that
the sign length is no greater than 2 feet on either side of the six division
lines of the building as shown on the attached plan.
3. All signage shall be attached to a background which meets the above re-
quirement and should be attached to the building surface.
4. All signage material shall be approved by the building owner prior to
City approval.
5. If lighting of the sign is required: The sign must be interior lit
or exterior lighting incorporated into the building design.
MOTION by Councilwoman Moses to approve the sign plan with the above five
recortanendations made by staff. Seconded by Councilman Fitzpatrick. Upon
a voice vote, all voting aye, Mayor Nee declared the motion carried unani-
mously.
CO�SIDERATION OF RENEWAL OF JOINT USE RENTAL AGREEMENT N0. 67 WITH METRO
WASTE CONTROL COMMISSION:
MOTION by Councilman Barnette to approve the renewal.of joint use rental
agreement No. 67 with the Metro Waste Control Commission. Seconded by
Councilman Fitzpatrick. Upon a voice vote, all voting aye, Mayor.Nee de-
clared the motion carried unanimously.
CONSIDERATION DF RENE4JAL OF JOINT USE RENTAL AGREEMENT N0. 191 WTTH METRO
4JASTE CONTROL COMMISSION:
MOTION by Councilman Fitzpatrick to approve the renewal of joint use rental
agreement No. 191 with the Metro Waste Control Commission. Seconded by
Councilman Schneider. Upon a voice vote, all voting.aye, Mayor Nee de-
clared the motion carried unanimously.
CONSIDERATION OF CHANGE N0. 2, 1979 MISCELLANEOUS CONCRETE CURB AND
GUTTER CONTRACT:
Mr. Qureshi, City Manager, stated it would be to the City's advantage to
extend this contract for miscellaneous concrete curb and gutter as the con-
tractnr, Halvorson Construction, has indicated a willingness to do this
work for the same price it was done for in 1979.

hearing closed at 7:45 p.m.
Mr. Barna stated that the addition to the house wi11 not disrupt the visuaT
aspects of the neighborhood since there are a variety of different housing
styles wittiin a four-block area of thi.s house. The split-entry aspect will
probably look very nice. '
Ms. Gabel stated that the intent of the cod� is more than well met and she
would not have any problem with it.
MOTION by Mr. Barna, seconded by Mr. Remper, to approve variance request
