STATED HARDSHIP: "The shape of the lot (rear yard)" B. ADMINISTRATIVE STAFF REVIEW: Request The petitioner requests that a variance be granted to reduce the rear yard setback from 25 feet to 7 feet. The request is for Lot 2, Chesney Acres, the same being 123 Chesney Way N.E. Site Located on the property is a single family dwelling unit with a detached two-car garage. The property is zoned R-1, Single Family, as are all surrounding parcels. Analysis Section 205.07.03.D.(3).(a) of the Fridley City Code requires a rear yard setback of not less than 25% of the lot depth with not less than 25 feet permitted or more than 40 feet required for the main building. Public purpose served by this requirement is to provide rear yard space to be used for green areas which enhance the neighborhood. The petitioner proposes to construct a 16 foot by 18 foot addition to the rear of the dwelling unit. The existing dwelling unit does not meet the required setback of 25 feet as it is located 23 feet from the rear property line. The lot is unique as the greater dimension of 165 feet is parallel to the street as opposed to perpendicular. The lot is 80 feet deep. The proposed addition would not adversely impact adjacent properties as there is adequate room between the proposed addition and the adjacent structure to the south. • � APPEALS COMMI83ION MEETING, AIIGDST 17, 1993 PAGE 3 Mr. Phillips stated Ms. Kroone brought up a legitimate concern. He stated he would definitely try to stack the snow on the other side of the driveway to alleviate any vision problems. Ms. McPherson stated she believed the construction of the garage will improve the parking situation. When staff inspected the site earlier, there was a car parked diagonally across the driveway pad. With the garage, ther_e will be an extra 24 feet so cars can pull in and have 19 feet plus the 12 foot alley to make turns and back out into the alley. MOTION by Mr. Kuechle, seconded by Ms. Smith, to close the public hearing. IIPON A VOICE VOTE, ALL VOTING AYE� CHAIRPERSON SAVAGE DECLARED THE MOTION CARRIED AND THE PIIBLIC HEARING CLOSED AT 7:45 P.M. Mr. Kuechle stated that the hardship proposed for not moving the garage to another location on the lot is not severe; however, he believed the spirit of the code is being met as the garage will be set back quite a way from the corner and there will be a good line of sight from the alley to the street. He believed moving the garage farther away from the existing driveway pad would adversely impact the back yard. The garage would get pretty close to the house. He stated he would vote to approve the variance. Ms. Smith agreed. She stated she did see a hardship in putting the garage closer to the house and eliminating a lot,of the back yard. Ms. Savage stated another important consideration is the existing mature tree. Ms. Beaulieu stated she agreed with the other Commission members. MOTION by Mr. Kuechle, seconded by Ms. Smith, to approve variance request, VAR #93-19, by Thomas Phillips, per Section 205.07.03.D. 2.(c).((3)) of the Fridley Zoning Code, to reduce the setback of an accessory structure facing an alley from 25 feet to 19 feet; and per Section 205.07.03.D.2.(c).((1)) of the Fridley Zoning Code, to reduce the side yard setback on the street side of a corner lot from 17.5 feet to 13 feet, to allow the construction of a detached triple car garage on Lots 29 and 30, Block 9, Hyde Park, the same being 5981 Main Street N.E. Ms. McPherson stated the petitioner is proposing to construct a 16 foot by 18 foot addition to the rear of the dwelling unit. The lot is very unique in the fact that the greatest dimension of 165 feet is parallel to the street as opposed to perpendicular to the street. They thought about moving to another home, but they like the neighborhood so decided to try to get a variance. They have talked about this with their neighbors, and the neighbors are in favor of their proposal. Ms. Beaulieu asked why the addition could not be built onto the east side of the house. Mr. Carrigan stated the bedrooms are on the east side of the house, and that would not be a good place for this type of addition. As proposed, the addition would be off the dining room area. Ms. Savage agreed that this is certainly a unique neighborhood with uniquely shaped lots. Mr. Carrigan stated there is quite a bit of distance between his house and any of the other houses around him. She believed granting the variance would still meet the spirit of the code. The addition is not going to create any problems for the neighbors. She would be in favor of approving the variance. Mr. Kuechle stated he agreed. There is more than adequate space between the petitioner's structure and adjacent structures on all sides. Ms. Savage agreed. Ms. Beaulieu stated there is 150 feet between the petitioner's house and the house to the south. Adding 16 feet to the rear of the petitioner's house is not going to affect that at all.
