UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY. 1. PUBLIC HEARING• CONSIDERATION OF VARIANCE REQUEST, VAR #99- 10. BY WILLIAM HEID: Per Section 205.07.04.D.(2).(b) of the Fridley Zoning Code, to decrease the required side yard setback between a garage and the side property line from 5 feet to 3 feet to allow the expansion of an existing garage on Lot 14, Block 2, Melody Manor 3�d Addition, generally located at 7412 Concerto Curve. MOTION by Mr. Jones, seconded by Ms. Mau, to open the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AIVD THE PUBLIC HEARING OPEN AT 7:32 P.M. Ms. Daniels stated the petitioner is requesting a two-foot variance to allow the expansion of an existing attached garage. The property is zoned R-1, Single Family, and is surrounded by single family properties. Ms. Daniels stated the hardship statement from Mr. Heid states that the current garage is too narrow to exit a vehicle when two vehicles are inside the garage making it necessary for passengers to exit the vehicle prior to parking the vehicle in the garage. The driver must squeeze out to exit the vehicle once it is parked inside the garage. ihe � � APPEALS COMMISSION MIh�TES, JULY 28, 1999 PAGE 2 attached garage measures 18.5 feet ftom inside wall to inside wall. Two feet is taken up by entry steps and a chimney that are located inside the garage. Two midsize cars measure 12 feet. This leaves 4.5 feet (54 inches) to exit two vehicles. It takes a minimum of 28 inches to exit from both sides of each vehicle. This leaves them 28 inches shortto reasonably exit the vehicles. Ms. Daniels stated the petitioner is currently 5 feet from the property line as is the neighbor toward the south. The variance request is to move two feet closer to the property line. The petitioner will expand the existing garage by 24 inches which will provide him with the inside room that he needs. Ms. Daniels stated the City has previously granted six or seven similar variances. Because the request is within previously granted variances, staff has no recommendation. Ms. Daniels stated staff had not received any phone calls regarding this request. Mr. Heid stated he had spoken with the neighbors, and they have no problem with the request. Mr. Kuechle asked if the petitioner planned to move the garage door as well. Mr. Heid stated they will widen the garage door from a 16-foot door to an 18-foot door. Ms. Mau stated the staff report recommends two stipulations, one of which is that the exterior wall be constructed with a one-hour firewall. Did the petitioner have any problem with the stipulations? Mr. Heid stated he did not have a problem with that, but he thought that had been taken off. Ms. Daniels stated the building code stated that less than 3 feet requires a firewall so that stipulation will be deleted. That is no longer a requirement since the request is within the distance allowed to not have a one-hour firewall. MOTION by Ms. Mau, seconded by Mr. Jones, to close the public hearing. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED AND THE PUBLIC HEARING CLOSED AT 7:37 P.M. Ms. Mau stated the hardship is well based. The petitioner does have the disadvantage of having the chimney and steps inside the garage which take up the extra two feet needed to exit vehicles. Considering the fact that this is within the hardship and within previously granted variances, she sees no problem as long as the neighbors have no objections. Mr. Jones stated he agreed as long as the neighbors do not object. Also� if comparing this to previously granted variances� it looks like the neighbor that would be most . -� ^ APPEALS COMMISSION Il JTES, JULY 28, 1999 PAGE 3 affected already has a two-car garage and could also expand a couple feet if he/she chooses to do so with a variance. He can appreciate the fact that it is difficult to live with a narrow garage and two normal size cars. He would have no problem approving the request. Mr. Kuechle concurred. Anyone that is willing to go through that amount of expense to add two feet to his garage obviously is feeling some hardship. Since it is within previously granted variances, he would tend to vote for approval. MOTION by Mr. Jones, seconded by Ms. Mau, to approve Variance Request, VAR #99- 10, by William Heid, to decrease the required side yard setback between a garage and the side property line from 5 feet to 3 feet to allow the expansion of an existing garage on Lot 14, Block 2, Melody Manor 3� Addition, generally located at 7412 Concerto Curve, with the following stipulation: 1. Property owner shall obtain building permits prior to construction. UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON KUECHLE DECLARED THE MOTION CARRIED UNANIMOUSLY. 2.
