Pursuant to our meeting July 28, 1987 at the subject property
regarding the proposed construction of a detached garage,
enclosed find three ground plans.
Upon review, please advise if the proposed plans meet zoning and
setback requirements. Although the plans show a 2-car garage
(22'x26'), consideration is also being given for the possible
construction of a 3-car garage (26'x30'). The red area on the
plan(s) is the new right-of-way to be acquired by Anoka County.

Dennis Plack has requestec7 a�iilding �i�''�to modify an existing attached
garage which is located on the s�uthwest corner c� Craig Way and East River
Road. Mr. Plack's property has been impacted by the East River Road
ric�t-of- way aaquisition Presently Mr. Plack has a driveway which extends
out to East River Road �e garage doors also face East River Road. Mr.
Plack's proposal is to relocate the garage doors on the north side of the
garage so that the cbors will faoe Craig Way. Mr. Plack will then renwe the
existing driveway to East River Road and construct a new driveway out to
(Yaig Way.
�is meno is being written to clarify the nonaonforming status issue and the
varianoe involved with the ric�t o� way taking whereby the setback is being
reduoed to 12 feet f ran the new ric�t of way lir�e.
Althouc� the structure is nonwnforming becatse the setback is only 12 feet
after the taking, activities proposed under the permit will make the
structure mo�e in oomplianoe. Garages with a drivaaay aooessing or�to a side
street �ast River Road) require a 25 foat aetback versus only 17.5 feet if
there is no driveway. In addition, nonoonforming uses are allawed to be
t�graded to create safer aonditions. This certainly would be the case by
renaiing a neoessity to acoess and egress the pcoperty by way of East River
Road. �e garage alteratio�n does not extend or intensify the nonconforming
use in any way and does imprwe the livability o� the property. Given these
criteria, I feel that the permit may be issued without the need f or a
varianve.
Jock, we should be p�epared to deal with future permit applicatians which may
invalve an increase in the ir�ensity af a rnnconforming use. As you know,
there are several ho�ses impacted whic3� are rnt being renaied. Should these
cwrers wish to add on to their residenoe, we would be faaed with the problen
af expanding nono�nf orm ing use.

The Chief Building Official shall, before issuing permits for the erection of any building or structure, or for any
addition to any existing building or structure, or for any alteration or repair to any existing building or structure,
upon application therefore, require the payment by the applicant for such permit of fees to the amount herein
below set forth and in the manner herein provided to-wit:

VERIFICATION OF FOUNDATION
Pemuts for construction will be issued a minimum of 24 hours from the time of application to allow for proper
review of the proposed siructure and of the construction site. .
A Certificate of Survey of the lot, showing the location of the foundation once it has it has been constructed will
