Notice is hereby given that the Appeals Commission of the City of
Fridley will conduct a Public Hearing at the Fridley Municipal
Center at 6431 University Avenue N.E. on Tuesday, November 22,
1994, at 7:30 p.m. for the purpose of:
Consideration of variance request, VAR #94-
31, by Bernard and Nancy Gross, pursuant to
Section 205.07.03.D.(2).(a) of the Fridley
City Code, to reduce the side yard setback
for living space from 10 feet to 5 feet to
allow the construction of an addition on Lot
8, Block 7, Pearsons Craigway Estates 2nd
Addition, generally located at 290 Craigbrook
Way N.E. (see map on reverse side for

intersection of Alden and Craigbrook Ways. The property is zoned
R-1, Single Family.
REOIIEBT:
To reduce the side yard setback for living apace from 10 feet to
5 feet to allow the construction of a 16' x 16' addition.
ANALYSIB:
Seotion 205.07.03.D.(2).(a) requires a side yard setback of 10
feet between any living area and side property line.
Public purpose served by this requirement is to maintain a
minimum of 20 feet between living areas in adjacent structures
and 15 feet between garages and living areas in adjacen�
structures to reduce the possibility of fire and to allow for
aesthetically pleasing open areas around residential structures.
The subject parcel is a corner lot, with the garage accessing
Alden Way and the dwelling facing Craigbrook. The existing
dwelling is located 5 feet from the side lot line. The
petitione�s investiqated complying with the ordinance, however,
due to roof lines and an adjacent window, they chose not to
pursue that option. The petitioners are proposing to continue
the line of encroachment with the addition. The adjacent
dwelling to the east is located 20 feet from the shared lot line,
providing 25 feet of separation between structures. The living
space side of the adjacent dwelling is located adjacent to the
shared lot line. The addition does not impact the rear yard
setback or the creek. The City does not have a setback
requirement from the creek.

10 feet to 5 feet to allow the construction of an addition
on Lot 8, Block 7, Pearson's Craigway Estates 2nd Addition,
generally located at 290 Craigbrook Way N.E.

Ms. McPherson stated the subject parcel is located at 290
Craigbrook Way at the intersection of Alden Way and Craigbrook
Way. The parcel is zoned R-1, Single Family Dwelling. The
petitioners are requesting a variance to reduce the side yard
setback for the living space side of the dwelling from 10 feet to
5 feet in order to allow the construction of a 16 foot x 16 foot
addition.
Ms. McPherson stated the subject parcel is a corner lot with the
dwelling fronting Craigbrook Way to the north. The garage
accesses Alden Way. The existing dwelling is located at 5 feet
from the side lot line. The petitioners are proposing to build
an addition off the rear of the dwelling following the existing
line of encroachment. The adjacent dwelling is approximately 20
feet from the lot line providing 25 feet of separation between
dwellings. The living space side of the adjacent dwelling is
located adjacent to the shared lot line. If the neighbors to the
east were to add on, the separation between the two dwellings
could possibly be reduced down to 15 feet. The addition does not
impact the rear yard setback nor does it impact the creek to the
rear. The City does not at this time have a minimum setback from

the creek. The request is within previously granted variances.
Staff has no recommendation regarding this request.
Ms. Beaulieu asked if the house now had a 5 foot setback.
Ms.�McPherson stated yes.
Ms. Beaulieu asked if there was a variance for this setback.
Ms. McPherson stated this was an existing encroachment. There is
nothing in the file indicating why this was permitted.
Dr. Vos asked the impact on the neighbor to the east if the
request is approved.
Ms. McPherson stated the neighbor to the east would be able to
build up to 10 feet. There is no adverse affect. The houses are
slightly offset. The house to the east is actually forward of
the petitioner's dwelling.
Ms. Beaulieu asked if the variance should be reworded to allow
for the existing encroachment and to allow for the new
construction.
Ms. McPherson stated the request could rephrased to reduce the
side yard setback to allow the construction and to acknowledge
the existing encroachment, if so desired.
Mr. Gross stated they were adding more bedroom space to make a
master suite. They are expanding an existing bedroom and adding
a bath. If we were to move it back 5 feet, we would be cutting
into existing windows in an adjacent room.
Ms. Beaulieu asked if they built the house.
Mr. Gross stated no. The house was built in 1962 and was the
first house in this particular subdivision.
Ms. Savage asked if the neighbors had any objections.
Mr. Gross stated the neighbors had no objections and provided
letters from the neighbors at 289 Stonybrook and 270 Craigbrook
supporting the proposed additian.

letters from Jean and Joe Sambrio, 289 Stonybrook, and Kenneth
Carsen, 270 Craigbrook Way, supporting the petitioner's request.

On the inspectors had been out to view the construction, it was
oted that a portion of the deck encroached into the rear yard
