Fridley will conduct a Public Hearing at the Community Education
Center at 6085 Seventh Street N.E. on Tuesday, May 9, 1989, at 7:30
p.m. for the purpose of:

Ms. McPherson stated this property is located in an R-1 Sinqle
Family Residential District and is surrounded on all sides by R-1.
She stated this ie a fairly new subdiviBion. The petitiane�r is
requesting to construct an enclosed lb ft. by ib ft. porch over the
existing patio. The petitioner is asking for the variance to be
granted because of the fact that the back of their house faces the
back of the windowless side yard of the property to the north, and
they do not feel they would be visually encroachinq into ths
neighbor's side yard.
Ms. McPherson stated staff pointed out to the petitioner that if
the building had been rotated 90 deqrees, there would have been
greater lot depth for the rear yard and probably not a need .,for
this variance. The petitioner has stated that the builder had
recommended how the house should be placed on the �ite.
Ms. McPherson stated staff is recommending the Appeais Commisaion
deny the variance on the basis that it does qreatly reduce the
separation between the house to the north and the house to the
south. Staff is recommendinq the petitioner construct a ecr�+ened-
in porch at the rear of the qarage which would meet code and would
meet the need for outdoor recreation and entertainment gurposes.
Ms. Jackson stated she is the owner of the windowle�s house to the
north, 6616 Arthur Street N.E. She stated she is representinq the
petitioner, William Carlson, who was unable to attend the meatinq
because he was called away on an emergency just before leavinq for
the meeting. She stated Mr. Carlson had asked her to request that
if the Commission did not approve the variance, he would like tZ�is
Commission to table it until the next meeting when he could bs in
attendance.
Ms. Jackson stated Mr. Carlson has polled the neiqhborhood, a�d no
one has any objection to this variance or the construction of the
porch. She submitted a letter from Chris and Mary Lawther, 14?2 -
66th Avenue N.E. , who stated they did not in any way oppo�se ;the
grantinq of the variance. She stated she and her husband do nct
obj ect, because the porch would face their side yard, and ti�ey have
no real interest in their side yard. They do not use it.
Ms. Jackson stated another significant thing about this area is it
is wide open. All the neighbors' yards continue into each others,
like one huge park. She would urge the Appeals Commiesion m�mbers
to support this request.
Mr. Barna stated he would be more comfortable waitinq until the
petitioner could be at the meetinq as he had some questions about
the construction.
Mr. Sherek stated he had some problems with the site lines with the
property to the west on Lot 12.

Ms. Savage stated in looking at the property, these are bsauti!'ul
houses, but the area seemed quite crowded. She would be more
comfortable tabling this item until the petitioner could be
present.

Ms. McPherson stated this item was first before the Appeals
Commission on May 9. Because the petitioner could not be present,
it has remained on the table since that meeting.
Ms. McPherson stated this is a corner lot, and it is in an R-1,
Single Family Residential District. The petitioner is proposing
a 16 ft. x 16 ft. enclosed three season porch which would require
a rear yard variance from the required 25 feet to 13.8 feet.
Ms. McPherson stated staff is recommending denial on the basis that
a variance would greatly reduce the separation between the
petitioner's house and the single family house to the north. Also,
the house is oriented toward the long side of the lot, therefore
creating a short lot depth which leads to an encroachment of the
proposed porch.
Ms. Savage stated that because of the corner lot situation, if the
back yard was considered a side yard, would a variance be required?
Ms. McPherson stated if the rear yard was the side yard, then a
variance would not be needed because the required side yard setback
is 10 feet.
Ms. McPherson stated a 35 ft. front yard setback is maintained on
the Creek Park Lane side, leading staff to believe the Creek Park
Lane frontage is the front yard.
Ms. Savage stated that later in the meeting the Commission will be
considering an ordinance amendment to change the required rear yard
setback on corner lots from 25 feet minimum to 10 feet minimum.
If this amendment is approved, then a variance would not be
required.
Ms. McPherson stated that is correct.
Dr. Vos stated that in the staff report, staff is suggesting that
a 9 ft. by 24. ft. addition can be constructed to the rear of the
garage without a variance.
Ms. McPherson stated this alternative is not as appealing as what
the petitioner is reguesting because of access to the house, but
it is a potential alternative. The petitioner would still have the
concrete patio for recreational purposes.
Ms. Savage asked the peti�ioner's opinion of the alternative
suggested by staff.
Dr. Carlson stated if he did not get the variance, he probably
would not construct a 9 ft. by 24 ft. porch. For one thing, they
would have to access the porch by either going outside the house
or going through the garage. Their family room is on the north

side with access through the patio door to the concrete patio.
They would like to remove the patio door and put in French doors
to the porch from the family raom. Also, 9 feet is not very wide.
He did not know how truly functional a porch of those dimensions
would be, other than just for some chairs. There is also a mature
tree in the back yard, and an addition off the garage would come
very close to that tree.
Dr. Carlson stated Sue Jackson, 6616 Arthur Street, the immediate
neighbor to the north, and other surrounding neighbors do not have
� any objections to this variance and the construction of the porch.
Mr. Sherek stated he is a little concerned about the sight lines
for the neighbor on Lot 12.
Ms. Savage stated that viewing the property from Arthur Street,
the back yard looks crowded now.
M�TION by Mr. Sherek, seconded by Dr. Vos, to close the public
hearing.
UPON A VOICE VOTE, ALL VOTING AYE, CHAIRPERSON BARNA DECLARED THE
PUBLIC HEARING CLOSED AT 8:20 P.M.
Mr. Sherek stated that, in general, he does not like houses close
together. He likes open space and sight lines. The fact that
there is a hardship in the way the property and house were arranged
was not enough to convince him to vote in favor of the variance.
However, the fact that the neighbor to the west who is the most
affected by this addition does not object and the fact that the
Commission will be considering some changes in the ordinance for
rear yard setbacks on corner lots made him more inclined to vote
in favor of the variance.
Dr. Vos stated if the change to the ordinance had been done before
this petitie��, the variance would not be needed. Also, the
neighbor tc��:;.�e north has no sight line problems, and there are no
windows on the south side. He stated this is not his favorite
place to put a three season porch, but Yie will vote in favor of the
variance.
Ms. Savage stated her first impression when visiting the property
was that the houses are very crowded, which is not the petitioner's
fault. In view of the fact that staff is recommending an ordinance
change, it did not make much sense to deny this variance request.
She, too, would vote in favor of the variance.
Mr. Barna agreed. In this situation, he sees the hardship as the
fact that the builder oriented the house with the frontage on
Creek Park Lane. If the house was turned and fronted Arthur
Street, then this would be the side yard, and there would not be

any problem. He stated he is in favor of the variance. However,
because of staff objection, this item will go on to City Council
for final action.

The petitioners, William Carlson and Carroll Brennan, are
proposing to construct a 16 ft. x 16 ft. screened-in porch
over their existing concrete patio on Lot 11, Block 2,
Creekridge, the same being 1495 Creek Park Lane. The porch
would encroach into the rear yard by 11.4 ft., reducing the
required rear yard setback from 25 feet to 13.8 feet.
Analysis
The house is located at the intersection of Creek Park Lane
and Arthur Street. The house fronts Creek Park Lane,
utilizing the shorter 95 ft. depth. If the house fronted
Arthur Street, the' depth of the lot would have been great
enough to include the proposed addition. The proposed addition
would be 23.8 ft. from the windowless wall of the neighbor to
the north.

BY WILLIAM CARLSON AND CARROLL BRENNAN:
Ms. Dacy, Planning Coordinator, this is a request to reduce the
rear yard setback from 25 feet to 13.8 feet in order to construct
an enclosed 16 by 16 foot porch at 1495 Creek Park Lane. She
stated the Appeals Commission recommended approval of the variance,
however, staff is recommending denial as there are other
alterna*_ives ko meet the requirements of the code.
Councilman Schneider asked about the status of the recommendation
to change the Zoning Code concerning corner lots.
Ms. Dacy stated this recommendation would be presented to the
Planning Conunission at their meeting this Wednesday and will be
brought to the Council at the meeting on August 28.
Councilman Schneider stated if the Zoning Code is changed
concerning corner lots, this variance would not be required.
Ms. Dacy stated she did feel the existing code is too restrictive
as far as setbacks for corner lots, however, staff is submitting
their recommendation based on the code as it now exists.
Dr. Carlson stated he wanted the variance in order to construct a
screened in porch. He stated if the house had been constructed in
a different direction (fronting on Arthur Street), he probably
would not be facinq this problem now. Dr. Carlson stated the home
next to him has no windows which would face this porch and the
property owner has no objection to the variance. He stated because
of the bugs and mosquitoes in Minnesota, he wished to have the
enclosed porch.
Councilwoman Jorgenson stated she did not feel a 9 by 24 foot porch
would be as beneficial as a 16 by 16 foot addition. She stated she
personally did not have a problem and this is the reason for
reviewing the ordinance regarding the setbacks for corner lots.
Councilman Schneider stated the neighbors cancur with this request
and it makes good sense, but the hardship may be more difficult to
ascertain. He stated if there is a change in the ordinance, this
becomes a non-issue. He felt it would be consistent to grant the
variance.
MOTION by Councilman Schneider to concur with the recommendation �

Ms. Dacy, Planninq Coordinator, stated this request is for a
variance to increase the lot coverage from 40 to 4 percent to
allow the construction of additional warehouse and o ice space at
78�� Rancher's Foad. She stated the petitioner pla to expand the
building by adding another 7,700 square feet. s. Dacy stated
staff has identified �two alternatives to the va iance. She stated
the current 21,000 square foot builciing occupi 35 percent of the
lot coverage. She stated one alternative wa to only add half of
the space or construct a two story ad tion with warehouse
facilities on the first floor and offices n the upper level. She
stated because of these alternatives, st f is recommending denial
of the variance.
Ms. Dacy stated the Appeals Commiss' n felt the proposed addition
would be consistent with the ' tent of the ordinance and
recommended approval with five s pulations which she outlined.
Mr. Guy Reithmeyer stated the mpany needs the warahouse space and
a smaller addition or a two story building would not meet their
needs. He stated the parki on the site is well in excess of what
is needed. He stated add' ional landscaping will be provided and
a retention area to reli e pressure on the existing storm drainaqe
system.
Councilman Billing asked if Cortron was the owner of this
property.
Mr. Jerry Pitts one of the owners, stated Cortron Corporation does
own the proper y.
Mr. Herric , City Attorney, stated he felt this was a significant
variance d if it was qranted, it would set a precedent and make
it diff' ult for the Council to deny similar requests in the
future He stated Elo Engineering had an almost identical request
vhich as denied.
Mr Herrick stated if the Council feels they want to change the
dinance to allow more than 40 percent lot coveraqe, the staff
ould review it.
