of any building or structure, or for any addition to any existing building or structure,
or for any alteration or repairs to any existing building ar structure, upon application
therefore, require the payment by the applicant for such permit of fees to the amount
herein below set forth and in the manner herein provided to-wit:
NEW CONSTRUCTION: Single Family Homes and Garages: $4.00/1,000 cubic feet..
PLAN CHECK: 25 percent of building permit fee.
DRIVEWAY DEPRESSION: (Concrete Curb Streets Only) .
Alternate A: Removal and replacement of concrete curb and
gutter only; Driveway width plus 6 feet x$11.75
Alternate B: Removal and replacement of concrete curb and
gutter and install a 3 f�t wide approach with

ADDITIONAL INFOR�IATION
For the purpose of computing fees for building permits, the cubical contents of any
building or addition, is determined by multiplying the ground area covered from a
point si3: (6) inches below the floor line of the basement or th� cellar to the �
average heights of the upper surface or to the average height of the roof surface
of the main gable of a pitched roof. `
For repairs or alterations to an existing structure, the fee shall be at the rate
of $3.00 per each five hundred dollars ($500.00) or fraction thereof in the cost
of all proposed work.
In�no case shall the fee charged for any permit as set forth in Section 2 be less
than $7.50 plus $.50 state surcharge. .
VERIFICATION OF �OUNDATION
1�OTE: Permits for construction will be issued a minimum of 24 hours from the time
of application�to allow for proper review of the proposed structure and of the
construction site. . '
A Certificate of Survey of the lot, showing the location of the foundation once it
has been constructed will be required before proceeding with the framing.

Application for a Certificate of Occupancy shall be made ten (1G) days prior to the
us� or occupancy of any structure for which a building pexmit has been issued; and

Four field density tests w�ere conducted at the referenced
project on July 19 and 21, 1977. The tests were done using
the Densat�i of Soil in Place by th� Sand Cone Me�hod procedure
(ASTI�!! D 1556 ) .
A Modified Proctor Density Test (Moisture-Density Relation of Soils usi
a 10 lb Rammer and 18 inch Drop ASTM D 1557-70), was also conducted.
Relative density was then computed by dividing the field density
by the Pro�tpr den�ity, expressed as a percentage.

As you see, the front corner of the garage encroaches 2.2 feet �� �r
and the back corner encroaches .6 feet into a drainage and utitity
easeme��.
The lot Certificate Survey that I used to apply for my buitding
permit did not show the easement. Subsequently, I placed ihe house
at a side yard set back for the garage that met the 5' City of Fridley
code.
The reason the house was placed to the extreme west of the 1ot
wlas because of a wet. peat bog on the east side of this lot and the
ty�st side of the next lot. Having already bu11t the house on the
r�ext lbt, I realized the incred9ble expense af removing peat� f111ing
with sand, compacting etc. As sho�n by the dotted circle, the peat
also extended into Lot 8. Therefor'�,,, to reduce my expense but moreso
to get,as much of the house on so11d so11, I located the foundation
as far west as feasible, allowing a couple of feet variation to make
sure I would be in the minimum 5' setback.
. I don't know what can be done about it now except for you to
qrant an encroachment approval or whatever is proper. The home is
completed, occupied, and closed. The City of Fridley, the lendinq
institution, and the owr�er would feel at ease if you would be very
considerate in this matter.

UPON A VOICE VOTE TAKEN ON THE ABOVE MOTION, a19 voted aye, and Mayor Nee
declared the motion carried unanimously. .
Mr. Sobiech, Public Works Director, stated a public hearing regarding this
plat was held last week and, based on comments from that meeting, an agree-
ment was written which indicates certain stipulations to the final plat
approval.. He stated these have been agreed upon by the owner and potential
developer. He stated the agreement indicates that the owner and developer
agree to plat the property into 10 lots with two family dwellings on each
lot. All utilities will be constructed and paid for by the developer and
owner, with the City approving thP plans and specifications. Petitioner
also understands there is an engineering escrow required to cover costs
associated with reviewing the plans and specifications and providing in-
spection of construction. There will be a park fee in the amount of $300
per lot and a 15 foot easement will be dedicated to the City for street pur-
poses, adjacent to 73rd Avenue. He stated the developer and owner recogniae
that the property linP between the proposed street and east line of the plat
be dedicated to the property owner to the east to insure there is proper
setback and with the dedication, it will be properly graded and so�ded.
� MOTION by Councilman Schneider to approve the final plat for subdivision
P.S..#77-07, Evert's Additi�n and approve the propused agreement. Seconded
by Councilman Barnette. Upon a voice vote, all voting aye, Mayor Nee de-

i ' Mr. Sobiech stated the utility companies have no objection to this encroach-
, ment, and the staff also has no objection, as there is still adequate space
in the remaining easement to allow for any grading that would be necessary
, to provide proper drainage.

by DaVerne Corporation for 5467 East Danube Road. Seconded by Councilman

SPECIAL USE PERMIT SP �77-16, JAMES DOWDS - 51 37TH AVENUE N.E.:
Mr. Sobiech, Public Works Director, stated the petitioner intends to expand
their operation to what was previously the Dunkley Surfacing Company yard.
,� He stated the Planning Commission recormn2nded approval of this special use
j permit with some stipulations. One of t..he stipulations was that a11 customer
/ � parking be within the fenced area and aphropriate signing to direct them to
� the parking site. Another stipulation was that the petitioner work with the
staff to further landscape the area to make it as attractive as possible.
Since the Planning Commissior� meeting, Mr. Sohiech felt it would help to
control the parking, if curbing was installed with appropriate driveway en-
trances�on 37th Avenue.

Councilman Fitzpatrick asked if they were requestiny different uses n different
parts of the parcel. .
M Sobiech stated, the area south of the Dunkley Surfacing bu ding would be
for amaged or used autos and north would be the parking. H stated the access
to t parking lot would be from East River Road.
Council. n Fitzpatrick asked if Mr. Dowds had plans for s gning that would in-
sure that the parking would be ins9de.
Mr. Dowds st ted "No Parking" signs would be put alon East River Road, when
the auction i held, and didn't anticipate any perm ent parking on East River
Road. He state he understood the Planning Commis on didn't want any parking
outside the fenc area or on East River Road.
MOTION by Councilma Fitzpatrick to approve Spe al Use Permit SP #77-16 with
the stipulations tha all r_.ustomer parking be 'nside the fenced area and that
efforts be made to ha "No Parking" signs an that the petitioner work with

parking and dirPcting them where h y can park, there wouldn't be any problem.

Mr. Dowds felt the Council was sking him to take a tremendous risk, as an
individual who is running a sm i busi ess, with the stipulations added for
the reviewal and renewal of t e special use permit.
Councilman Fitzpatrick poin d out this b siness does require a special use
permit under the code and e request now s to greatly expand this operation.
If the operation continues in compliance, C uncilman Fitzpatrick doubted if
Mr. Dowds would be denied a special use perm t to continue his business.
Councilman Schneider po' ted out that the burd of proof for denying a special
use pern�it falls on th Council. •

VERIFICATION OF FOUNDATION
Permits for construction will be issued a minimum of 24 hours from the time of application to allow for proper
review of the proposed structure and of the construction site.
A Certificate of S�uvey of the lot, showing the location of the foundation once it has it has been constructe� will
